A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND. DETERMINING THAT TITLE 18
OF THE ANAHEIM MUNICIPAL CODE RELA7NG TO ZONING
SHOULD BE AMENDED AND THAT THE BOUNDARIES OF
CERTAIN ZONES SHOULD BE CHANGED,
WHEREAS, the City Planning Commission of the City of Anaheim
did hold a public hearing in Reclassification Proceedings No. 61 -62 -82
to consider an amendment to Title 18 of the
Anaheim Municipal Cow relating to zoning, and to consider a change
in the boundaries of the zone or zones hereinafter mentioned and
described, and at said hearing did receive evidence and reports from
persons interested therein and from its staff; and
WHEREAS, within a period of forty days following said
hearing thereon the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence pre-
sented at said hearing, and a recommendation that the proposed
amendment be adopted by the City Council and that certain zone or
zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of evi-
dence, report of findings, and recommendation of the City Planning
Commission the City Council did fix the 1 th day of April
19 62 as the time and the City Council Chambers in the City Hall
of the City of Anaheim as the place for a public hearing upon said
proposed amendment to Title 18 of the Anaheim Municipal Code, and
the exclusion of said property, hereinafter described, from the zone
or zones in which it is now situated, and the incorporation thereof
in the zone or zones hereinafter set forth; and did give notice
thereof in the manner and form as provided in said Title 18 of the
Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public hearing,
and did give all persons interested therein an opportunity to. be
heard, and did receive evidence and reports, and did thereupon con-
sider the summary of evidence presented at said public hearing
before the Planning Commission, its report of findings, and recom-
mendation; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should be
adopted and that the property hereinafter described should be
excluded from the zone or zones in which it is now situated and
incorporated in the zone or zones as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby, amended and that the following des-
cribed property, situated in the City of Anaheim, County of Orange,
State of California, to wit:

All that certain real property situated in the
city of Anaheim, described as follows:
Beginning at a point in the center line of Broadway
distant 349.70 feet East of the point of inter-
section of the center line of said Broadway with the
center line of Landing Road (now known as Garden.
Grove Road), as shown upon the map of J. W. Clarkts
Addition to Anaheim, recorded in book 31, page 100,
Miscellaneous Records of Los Angeles County,
California, said point of intersection being the
Northwest corner of the Northwest quarter of the
Southwest quarter of the Northwest quarter of
Section 16, in Township 4 South, Range 10 West,
San Bernardino Base and Meridian; thence South 661.30
feet to a point in the South line of the Northwest
quarter of the Southwest quarter of the Northwest
quarter of said Section 16, distant 350.42 feet
East of the Southwest corner of the Northwest quarter
of the Southwest quarter of the Northwest quarter
of said Section 16; thence East 310.07 feet to the
Southeast corner of the Northwest quarter of the
Southwest quarter of the Northwest quarter of said
Section 16; thence North 662.37 feet to a point in
the center line of Broadway, at the Northeast corner
of the Northwest quarter of the Southwest quarter
of the Northwest quarter of said Section 16; thence
West along said center line of Broadway 311.67 feet
to the point of beginning;
EXCEPT that portion lying South of the South line
of Block "B" and ttCtt of said J. W. Clarkts Addition,
being a strip approximately 10 feet wide;
EXCEPT ALSO that portion of the East 7 -1/2 feet of
said premises lying South of the extended North line
of Lot 8, Block "C" of said J. W. Clarkts Addition.
be excluded from the R -A, RESIDENTIAL- AGRICULTURAL ZONE, and
incorporated in the R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon
the following conditions:
1. That subject property shall be developed
substantially in accordance with plans marked
"Exhibits 1 and 2" on file with the City of
Anaheim; PROVIDED, HOWEVER, that revised
elevation plans shall be submitted to and approved
by the Building and Planning Departments; and
PROVIDED FURTHER that City of Anaheim R -3 Deed
Restrictions, approved by the City Attorney,
shall be placed of record limiting the height of
all buildings constructed on subject property
to one story.
2. That a 6 -foot masonry wall shall be constructed
along the southerly, easterly and westerly
boundaries of subject property, where such wall
does not presently exist, and that said wall
shall be constructed prior to final building
inspection.

3. That the owners of subject property shall
deed to the City of Anaheim a strip of land
45 feet in width, from the center line of the
street, along Broadway for street widening
purposes.
L. (a) That all engineering requirements of the
City of Anaheim along Broadway such as curbs
and gutters, sidewalks, street grading and paving,
drainage facilities, or other appurtenant work
shall be complied with as required by the City
Engineer and in accordance with standard plans
and specifications on file in the Office of the
City Engineer; and (b) that a bond in an amount
and form satisfactory to the City of Anaheim
shall be posted with the City to guarantee the
installation of said engineering requirements.
5. That the owners of subject property shall pay
to the City of Anaheim the sum of $2 per front
foot, along Broadway, for street lighting
purposes.
6. That the owners of subject property shall deed
to the City of Anaheim 5 -foot public utility
easements along the easterly and southerly
boundaries of subject property.
7. That the owners of subject property shall pay
to the City of Anaheim the sum of $25 per
dwelling unit, to be used for park and
recreation purposes, said amount to be paid
at the time the building permit is issued.
8. That adequate areas for trash storage, accessible
to trash -truck pickup, shall be provided as
determined and required by the Street Maintenance
and Sanitation Division of the Public Works
Department, which areas shall be enclosed by
a solid fence or wall prior to final building
inspection.
9. That fire hydrants shall be provided as required
by the Chief of the Anaheim Fire Department.
10. That the completion of these reclassification
proceedings is contingent upon the granting
of Conditional Use Permit No. 220.
11. That Conditions Nos. 3, )4.(b), 5 and 6 above
mentioned and that portion of Condition No. 1
providing for the recordation of R -3 Deed
Restrictions, shall be complied with within
a period of 180 days from date hereof, or
such further time as the City Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an ordinance amending Title 18 of the Anaheim
Municipal Code to accomplish the objects herein found and de-
termined to be necessary and proper.
