A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXECUTION OF AN AGREIN;ENT FOR DFT) I CATION
BETWEEN THE CITY OF ANAHEIM AND R. D. TAYLOR
AND NINA. VIOLA. TAYLOR.
WHEREAS, the final inspection and clearance for use
and occupancy of a building of said R. D. Taylor and Nina
Viola Taylor, husband and wife, is being withheld by the City
pending clarification of the requirements for dedication and
improvement; and
WHEREAS, R. D. TAYLOR and NINA VIOLA TAYLOR, husband
and wife, and the City .ofAnaheim have an existing controversy
as to the propriety of certain buildings of the said Taylors
and the requirements of dedication and improvement of public
right of way abutting the property of said Taylors on Ball
Road, said requirements being requirements of the City. of
Anaheim; and
WHEREAS, the City of Anaheim contemplates major im-
provements on Ball Road and letting of a contract for the
improvements in connection with such improvement and widening;
an d
WHEREAS, the City of Anaheim and the said Taylors
wish by agreement to settle all matters of controversy between
them; and
WHEREAS, a form of agreement to be made and entered
into by the City and said Taylors,purporting to settle said
matters of controversy, has this day been submitted to the City
Council, the terms and conditions of which the City Council
finds to be satisfactory and should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the agreement this day submitted
to the City Council entitled "Agreement for Dedication," to
be made and entered into between R. D. Taylor. and Nina Viola
Taylor, husband and wife, and the City of Anaheim, containing
the following terms and conditions:
1. That R. D. Taylor and Nina Viola Taylor, husband
and wife, will dedicate to the City of Anaheim for street and
highway purposes all that portion of the hereinafter described
property lying 53 feet south of the center line of Ball Road
measured at right angles to said center line.
2. That the said Taylors shall dedicate, give and
set over to the City the residential structure located on
the hereinafter described property as personal property to be
removed from the premises wherein it is located. Said resi-
dential house is described as: A ten -room residential structure
frame and stucco, shingle roof, approximately 2500 square feet,
commonly known and designated by street address as 2112 West
Ball Road, Anaheim, California.
3. That the City shall provide all engineering in
connection with the installation of improvements and shall
install, at its own cost and expense, all street paving in-
volved in the improvement of the road and shall bear the cost

of any relocation of pipes and other such items at its own cost
and expense, and shall supervise and let all contracts for street
construction and for the construction of curbs, gutters, and
driveways abutting property of the said Taylors, such work by
the City to be done at the time and in conjunction with the
major project of the City in the improvement and widening of
Ball Road.
Z}.. That the City shall remove the residential house,
hereinabove described, prior to the time the street improvements
are made. Said Taylors shall be allowed to occupy the residential
house until June 1, 1962, or such other time as may be extended
by the City. Said date of June 1, 1962, is the date presently
scheduled by the City for the widening and improvements on Ball
Road as before set forth; and should said date of improvements
be set for a later date, said Taylors shall be notified and shall
be allowed to occupy the residence, without any further compensa-
tion to the City, until the scheduled date of the improvement
of Ball Road.
5. That the City of Anaheim shall install City of
Anaheim Standard Type A concrete curb and gutters along the
property of said Taylors, being approximately 220 lineal feet,
complete in place. The City shall also install two City of
Anaheim Standard concrete driveways (being the driveway from
the street traveling to the property line) twenty -five feet wide
in locations as designated by said Taylors. The City of Anaheim
shall grade only two areas approximately twenty -five feet by
forty -seven feet directly south of the two standard concrete
drives to be installed. The slope of said graded area shall not
exceed five per cent (5%) of grade. The cost of grading as
described above shall be borne by the City. The cost for con-
crete curb, gutters and concrete driveways shall be borne by
said Taylors. All charges for curbs, gutters, and concrete
driveways shall be based upon unit price paid by the City upon
contract let to the lowest responsible bidder in conformity
with provisions of law and said Taylors shall pay such amounts
promptly to the City upon presentation of billing by the City.
6. That upon completion of dedication and the signing
off 4 d agreement, the City shall immediately consummate the
final inspection of the building of the said Taylors and shall
release the building for use and occupancy. The description
of the property of said Taylors, referred to herein, is as
follows:
be, and the same is hereby, approved; and that the Mayor and
City Clerk be and they are hereby authorized to execute said
agreement for and on behalf of the City of Anaheim.
