A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18
OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING
SHOULD BE AMENDED AND THAT THE BOUNDARIES OF
CERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of Anaheim
did hold a public hearing in Reclassification Proceedings No.
61 -62 -92 to consider an amendment to Title 18 of the
Anaheim Municl7l Code relating to zoning, and to consider a change
in the boundaries of the zone or zones hereinafter mentioned and
described, and at said hearing did receive evidence and reports from
persons interested therein and from its staff; and
WHEREAS, within a period of forty days following said
hearing thereon the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence pre-
sented at said hearing, and a recommendation that the proposed
amendment be adopted by the City Council and that certain zone or
zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of evi-
dence, report of findings, and recommendation of the City Planning
Commission the City Council did fix the 8th day of 1k
19 62 as the time and the City Council Chambers in the City Hall
of the City of Anaheim as the place for a public hearing upon said
proposed amendment to Title 18 of the Anaheim Municipal Code, and
the exclusion of said property, hereinafter described, from the zone
or zones in which it is now situated, and the incorporation thereof
in the zone or zones hereinafter set forth; and did give notice
thereof in the manner and form as provided in said Title 18 of the
Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public hearing,
and did give all persons interested therein an opportunity to. be
heard, and did receive evidence and reports, and did thereupon con-
sider the summary of evidence presented at said public hearing
before the Planning Commission, its report of findings, and recom-
mendation; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should be
adopted and that the property hereinafter described should be
excluded from the zone or zones in which it is now situated and
incorporated in the zone or zones as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby, amended and that the following des-
cribed property, situated in the City of Anaheim, County of Orange,
State of California, to wit:
PARCEL 1.
The northerly 130.00 feet of the southerly 170.00 feet
of the westerly 167.00 feet of the west half of the
west half of the southwest quarter of the southeast
quarter of section 7, Township 4 South, Range 10 West

in the Rancho Los Coyotes, city of Anaheim, county
of Orange, State of California, as said section is shown
on a map recorded in book 51 page 10 of Miscellaneous
Maps, in the office of the county recorder of said county.
EXCEPT that portion thereof described as follows:
Beginning at a point on the North line of the south
40.00 feet of said section 7, distant easterly along
said line 60.00 feet from the West line of said southwest
quarter; thence westerly along said North line to said
West line; thence northerly along said West line to a
line which is parallel with and northerly 20.00 feet,
measured at right angles, from said North line; thence
easterly along said parallel line 40.00 feet; thence
southeasterly in a direct line to the point of beginning.
PARCEL 2.
The southerly 307.00 feet of the west half of the west
half of the quarter of the southeast quarter
of section 7, Township 4 South, Range 10 West, in the
Rancho Los Coyotes, city of Anaheim, county of Orange,
state of California, as said section is shown on a map
recorded in book 51 page 10 of Miscellaneous Niaps, in
the office of the county recorder of said county.
EXCEPT the southerly 40.00 feet thereof.
ALSO EXCEPT the northerly 130.00 feet of the southerly
170.00 feet of the westerly 167.00 feet thereof.
PARCEL 3.
That portion of the west half of the west half of the
southwest quarter of the southeast quarter of section
7, Township 4 South, Range 10 West, in the Rancho Los
Coyotes, city of Anaheim, county of Orange, state of
California, as said section is shown on a map recorded
in book 51 page 10 of Miscellaneous Niaps, in the office
of the county recorder of said county, bounded northerly
by the southerly line of the southerly 2 acres of the
northwest quarter of the west half of the southwest
quarter of the southeast quarter of said section and
bounded southerly by the northerly line of the southerly
307.00 feet of said southeast quarter.
be excluded from R -A, RESIDENTIAL AGRICULTURAL ZONE and incor-
porated in the following zones upon the conditions hereinafter
set forth:
That Parcel 1, above described, be changed
to C -3, HEAVY-COMMERCIAL ZONE;
That Parcel 2, above described, be changed
to C -1, NEIGHBORHOOD COMMERCIAL ZONE; and
That Parcel 3, above described, be changed
to R -3, TM FAMILY RESIDENTIAL ZONE,
upon the following conditions:
1. That the owner of subject property shall place of
record City of Anaheim C -3 Deed Restrictions covering
Parcel 1, approved by the City Attorney, which
restrictions shall limit the C -3 uses of Parcel 1
to a service station only.
2. That the owner of subject property shall place of
record City of Anaheim C -1 Deed Restrictions
covering Parcel 2, approved by the City Attorney, which
restrictions shall limit the C -1 uses of Parcel 2
to business and professional offices only.
3. That all buildings now located on subject property
shall be removed within a period of two years from
date hereof, or at the time of the commencement of
the commercial development, if commenced before the
expiration of said two -year period; and in the interim,
the existing residences, shall not be used for other
than residential purposes.
4. That all buildings constructed on Parcel 3 shall
be limited to one -story in height, and that the
owner of subject property shall place of record
City of Anaheim R -3 Deed Restrictions covering
Parcel 3, approved by the City Attorney, which res-
trictions shall limit the height of all buildings
constructed on said parcel to one story in height.
5. That the owner of subject property shall pay to
the City of Anaheim the sum of $25.00 per dwelling
unit, to be used for park and recreation purposes,
said amount to be paid at the time the building
permit is issued.
6. That the final tract map of subject property shall
be recorded in the Office of the County Recorder
of Orange County.
7. That adequate areas for trash storage accessible
to trash -truck pickup shall be provided as determined
and required by the Street Maintenance and Sanitation
Division of the Public Works Department, which areas
shall be enclosed by a solid fence or wall prior to
final building inspection.
8. That subject property shall be developed substantially
in accordance with plans marked 'Exhibits No. 1
through No. 5, as amended.
9. (a) That a 6 -foot masonry wall shall be constructed
along the easterly boundary of subject property; and
(b) that a bond in an amount and form satisfactory
to the City of Anaheim shall be posted with the City
to guarantee the construction of said wall within a
period of two years from date hereof.
10. That Conditions Nos. 1, 2, 4, 6 and 9(b), above
mentioned, shall be complied with within a period of
180 days from date hereof, or such further time as
the City Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an ordinance amending Title 18 of the Anaheim
Municipal Code to accomplish the objects herein found and de-
termined to be necessary and proper.
