A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 219.
WHEREAS, the City Planning Commission of the City
of Anaheim did receive a request for a Conditional Use Permit
from ARDMDRE DEVELOPMENT CO., 1129 Westwood Boulevard,
Los Angeles 24, California, to construct a planned unit devel-
opment on the following described property:
Those portions of the southwest quarter of the
northeast quarter and the south half of the northwest
quarter of section 8, Township 4 South, Range 10
West, in the Rancho Los Coyotes, city of Anaheim,
county of Orange, state of California, as said
section is shown on a map recorded in book 51 page 10
of Miscellaneous Maps, in the office of the county
recorder of said county, described as a whole as
follows:
Beginning at the northwest corner of Tract No. 3095,
as per map recorded in book 122 pages 24 and 25 of
said Miscellaneous Maps; thence South 0 211 06t'
East 585.64 feet along the westerly line of said
Tract to the northeast corner of the land described
in the deed to the Orange County Flood Control
District, recorded January 6, 1960, in book 504.3
page 114 of Official Records; thence North 89°
43t 41" West 12 09,66 feet along the North line
of said Flood Control deed and along the North
line of the land described in Parcels 1 and 2 of the
deed to said Flood Control District recorded
October 17, 1961, in book 5881 page 950 of Official
Records, to the beginning of a curve in said North
line which is concave northerly, having a radius of
693.00 feet; thence westerly 398.76 feet along said
curve through a central angle of 32 58 07 thence
North 56° L5 34." West 26.12 feet to the most northerly
corner of said Parcel 2; thence South 33° 141 26"
West 107.08 feet along the northwesterly line of said
Parcel 2 to the northeasterly line of the land
described in Parcel 1 in the deed to the State of
California, recorded September 26, 1951, in book 2234
page 416 of Official Records; thence North 56° 451
34" West 674.03 feet along said northeasterly line
to the most southerly corner of the land described
in Parcel 2 in said deed recorded in book 2234 page
4.16 of Official Records; thence North 33 141 26"
East 5.00 feet to the most easterly corner of said
Parcel 2; thence North 56° 45t 34" West 232.36 feet
to an angle point in the northeasterly boundary of
said Parcel 2; thence North 11 45 34" West 42.4.3
feet to an angle point on the southerly line of lot 26
in Tract No. 1721, per map recorded in book 50 pages 37
to 39 inclusive of said Miscellaneous Maps; thence
South 89 58 5o" East 2427.19 feet along the southerly
line of said Tract and along the southerly line of
AND WHEREAS, the City Planning Commission did hold
a public hearing at the City Hall in the City of Anaheim upon
said request on March 19, 1962, notices of which said public
hearing were duly given as required by law and the provisions
of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection,
investigation and studies made by itself and in its behalf,
and after due consideration of all evidence and reports offered
at said hearing, did adopt its Resolution No. 271, Series 1961 62,
granting Conditional Use Permit No. 219 subject to the conditions
therein set forth; and
WHEREAS, thereafter within twenty -two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action of the City
Planning Commission in granting said Conditional Use Permit and
did thereupon fix the 24th day of April, 1962, as the time
and the Council Chamber in the City Hall of the City of Anaheim
as the place for a public hearing upon said Conditional Use
Permit, and notices of such public hearing were duly given as
required by law and the provisions of Title 18, Chapter 18.76
of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to
be heard and did receive evidence and reports, and did close
said hearing and defer action thereon to this date; and
WHEREAS, the City Council finds, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing,
that:
Tract No. 1802, 1803, 3139 and 2082, per maps recorded
respectively in book 55 pages 27 and 28, book 55
pages 45 to 47 inclusive, book 119 pages 16 and 17
and book 65 pages 32 and 33, all of said Miscellaneous
Maps, to the point of beginning.
1. The proposed use is properly one for which a
Conditional Use Permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and develop-
ment of the area in which it is proposed to be
located.
3. The size and shape of the site proposed for
the use is adequate to allow the full develop-
ment of the proposed use in a manner not detri-
mental to the particular area nor to the peace,
health, safety and general welfare.
4. The traffic generated by the proposed use will
not impose an undue burden upon the streets and
highways designed and improved to carry the
traffic in the area.
5. The granting of the Conditional Use Permit under
the conditions imposed will not be detrimental
to the peace, health, safety and general welfare
of the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission granting said Conditional Use Permit be, and the
same is hereby sustained; and that Conditional Use Permit
No. 219 be, and the same is hereby, granted permitting the
construction of a planned unit development upon the property
hereinabove described, subject to the following conditions:
1. That this Conditional Use Permit is granted
subject to the reclassification of subject
property from R -A, Residential- Agricultural
Zone to R -3, Multiple Family Residential Zone,
and subject to the granting of Variance
No. 1354.
2. That subject property shall be developed
substantially in accordance with plans
marked "Exhibits 1, 2, 3, and 4" on file
with the City of Anaheim.
3. That elevation plans shall be provided for
each section, as delineated on the maps of
Tracts 4107, 4617, 4618, 4619, 4620, and 4621,
said elevation plans to be submitted to and
approved by the Architectural Control Committee
prior to the issuance of building permits for
the respective sections.
4. That final maps of the following tracts shall
be recorded in the Office of the County Recorder
of Orange County:
Tracts Nos. 4107, 4617, 4618, 4619,
4620, and 4621;
and said maps shall be recorded in the order
listed, with the exception that the final map
of Tract No. 4621 shall be recorded concurrently
with or prior to the recordation of the final
map of Tract No. 4620; and FURTHER, that the
final map of each tract shall be recorded prior
to the issuance of a building permit for
construction or development of said tract.
5. That said tracts above mentioned shall be
developed in the following order: 4107, 4617,
4618, 4619, 4620 and 4621, with the exception
that Tract No. 4621, including the park and
recreation facilities, which are a part thereof,
shall be developed prior to or concurrently
with Tract No. 4620,
6. That prior to the occupancy of any tract a looped
private roadway, 24 feet in width, shall be
constructed betw1 Street "A" and Street "B" on
the contiguous westerly tract. In the event
subject property is not developed to the ultimate
plans, a permanent easement and 64 -foot wide
street shall be dedicated to the City of Anaheim.
ATTEST:
7. That a modified cul -de -sac shall be provided
at the termini of Nutwood and Fern Streets,
subject to the approval of the City Engineer,
prior to final building inspection of the
first phase of development.
8. That the parkway and easement planting areas
shall be subject to approval of the Super-
intendent of Parkway Maintenance. Trees
planted along the north property line of
subject property shall be of a variety that
will not interfere with electric and telephone
lines.
9. That drainage facilities, satisfactory to the
City Engineer, shall be provided to discharge
drainage water into the Flood Control Channel.
10. That the sum of $25 per dwelling unit shall
be paid to the City of Anaheim to be used
for park and recreation purposes, said amount
to be paid at the time the building permit
is issued.
11. That a bond in an amount and form satisfactory
to the City of Anaheim shall be posted with
the City to guarantee the construction of
temporary roadways prior to final building,
inspection of the first plans of development.
12. That written approval of fire protection facilities
for each stage of development shall be oliained
from the Fire Department prior to final building
inspection of each stage of development.
The City Council hereby reserves the right to revoke
such Conditional Use Permit for good cause or failure of said
owner, its heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions
herein.
THE FOREGOING RESOLUTION is approved and signed by
