A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 1510
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from
RUDOLPH WESNER, owner
of certain real property situated in the City of Anaheim, County
of Orange, State of California, described as follows:
The Northerly 129 feet, measured along the Easterly line
of that portion of Lots 9 and 10 of the Miles Rancho, as
shown on a map thereof recorded in Book 4, page 7 of Mis-
cellaneous Maps, records of Orange County, California,
bounded and described as follows:

Beginning at a point in the center line of the unnamed road
shown on said map adjoining said Lots 9 and 10 on the North

line with the Northerly prolongation of the Easterly line of
said Lot 10, said point of beginning being the intersection
of said center line with the Easterly line or the Northerly
prolongation thereof, of the tract of land described in the
deed executed by Bank of America National Trust and Savings
Association, in favor of David Corderman and wife, recorded
July 29, 1942 in Book 1156, page 18 of Official Records;
thence South 0 24' 00" East along said Easterly line of the
Corderman tract of land, 238 feet; thence South 89 43' 20"
West parallel with said center line of Romneya Drive, 363.58
feet to the center line of the unnamed road shown on said
map adjoining said Lots 9 and 10 on the West and known as
West Street; thence North 0 29' 10" Jest along said center
line of West Street, 238 feet to said center line of Romneya
Drive; thence North 89 43' 20" East along center line of
Romneya Drive 363.94 feet to the point of beginning;
Excepting from said Northerly 129 feet, the Easterly 263
feet measured along said center line of Romneya Drive.

WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. 435 Series
19 62 recommending that Variance No. be granted
subject to certain conditions therein set forth ;and
WHERL4-,S, thereafter, within twen..y -two (22) days from
the date of the adoption of said resolution, the City Council did
elect, upon its own motion, to review the action taken by the City
Planning Commission in granting said variance and did set
a public hearing thereon to be held on the 4th day of September
19 62 at 7:00 otclock P.M. in the City Hamel n the City of Anaheim
and notice of such public hearing was duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:
ATTEST:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the ,intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone,
2. That such a variance 'is necessary for the preserva-
tion and enjoyment of a substantial property right
possessed by other property in the same vicinity
and zone and denied to the property in question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
l That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and the
same is hereby granted permitting a waiver of the rear and side
yard building setback requirements on the property hereinabove
described, subject to the following conditions:
That Variance No. 1510 is granted subject to the
conditions set forth in Resolution No. 62R -801
adopted by the City Council on September 4, 1962
in Reclassification Proceedings No. 62 -63 -5, with
the exception of Condition No. 7, which shall not
apply, and subject to the completion of said re-
classification proceedings.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner, his
heirs, successors or assigns, to comply with the Anaheim Municipal
Code and regulations and the conditions herein. Said variance is
granted for the term prescribed by the Anaheim Municipal Code un-
less otherwise specified herein.
THE FOREGOING RESOLUTION is signed and approved by me
this 4th day of September, 1962.
