1962-0799WHEREAS, the City Council has authorized the City
Clerk to make tape recordings of the Council minutes in order
to assist the Clerk in the preparations of the regular written
minutes of the City Council meetings; and
WHEREAS, such tape recordings are intended for the
use of said City Clerk and for no other purpose; and
WHEREAS, the State's Attorney General has rendered
his opinion as to whether or not such tape recordings con-
stitute public records and has declared by his opinion cited
as "39 Attorney General's Opinions, 298" that such do not
constitute public records but are "other matters" in the
office of the City Clerk subject to inspection so long as they
are available without substantial inconvenience to the City
Clerk.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the tape recordings of the Council
minutes shall be retained by the City Clerk and utilized for
her convenience in preparing the written minutes of the City
Council meeting and shall be retained by her until such time
as the minutes, in written form, have been approved by the City
Council. Upon such approval of the written minutes by the
City Council the City Clerk may reuse or erase such tape record-
ings, unless specifically requested by the City Council to
retain such tapes at the time the minutes are approved.
BE IT FURTHER RESOLVED that while the City Clerk has
the tape recordings in her possession, she make them available
to any member of the public during office hours,when such
availability to the public will not inconvenience the ordinary
operation of said City Clerk's office, for inspection only and
not to be copied or rerecorded by any member of the public.
In connection with making the tapes available to the public
the City Clerk is further authorized to allow the recording
machine to be used by the public for listening purposes when
such machine is not necessary for use by the City Clerk in the
ordinary function of her office.
