A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO, 1486
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from
o cer a n rea property s tua e• in the ity of Ana eim, ounty
of Orange, State of California, described as follows:
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on June 11, 1962 notice of which said public
hearing was duly given as required by law and the provisions
of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No, 355 Series
196.1 -62 recommending that Variance No. 148 be denied_

Original Building Lot 5, as shown on a map of Lands
of Anaheim, recorded in book 4, pages 629 and 630,
Deeds, Records of Los Angeles County, California;
EXCEPTING THEREFROM that portion thereof as granted
to Peter J. Weisel in deed recorded January 6, 1904,
in book 98, page 364, Deeds, records of said Orange
County;
ALSO EXCEPTING THEREFROM that portion thereof as
granted to Frederick W. Kellogg, in deed recorded
March 20, 1923, in book 462, page 94, Deeds, records
of said Orange County.
WHEREAS, thereafter, within twenty =twc (22) days from the
date of the adoption of said resolution, a written appeal was
filed with the City Council of the City of Anaheim protesting
the action of the City Planning Commission denying said
variance, and said appeal was set for public hearing on

a n t ie ty off` Anahe im, and notice of such public hearing
was duly given as required by law and the provisions of Title 18,
Chapter 18,76 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the preserva-
tion and enjoyment of a substantial property right
possessed by other property in the same vicinity
and zone and denied to the property in question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
N0W, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that a conditional zoning variance be, and the same
is hereby granted permitting the establishment of a light furniture
re- upholstery service on the property hereinabove described, subject
to the following conditions:
1. That the owner of subject property shall deed to the
City of Anaheim a strip of land 40 feet in width,
from the centerline of the street, along Los Angeles
Street, for street widening purposes.
2. That adequate areas for trash storage, accessible to
trash =truck pickup, shall be provided as determined
and required by the Street Maintenance and Sanitation
Division of the Public Works Department, which areas
shall be enclosed with a solid fence or wall prior to
the issuance of a Use and Occupancy Permit.
3. That the sidewalks along Los Angeles Street shall be
repaired as required by the City Engineer, and in ac-
cordance with standard plans and specifications on file
in the Office of the City Engineer.
4. That the Anaheim Municipal Code parking requirements shall
be waived for a period of one year; provided, however,
that parking spaces shall be provided to accommodate two
cars in the rear yard and to accommodate two cars in the
driveway area.
5. That Conditions Nos. 1 and 3, hereof, shall be complied
with within a period of 180 days from the date of this
resolution, or such further time as the City Council may
grant.
The City Council hereby reserves the right to revoke such
variance permit for good cause or failure of said owner, his heirs,
successors, or assigns to comply with the Anaheim Municipal Code and
regulations and the conditions herein. Said Variance No. 1486 is
granted for the term of one year from date hereof, or such further
time as the City Council may grant.
