A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING VARIANCE NO. 1457.
WHEREAS, the City Planning Commission of the City
of Anaheim did receive a petition for zoning variance from
DIETRICH LE BEAU DEVELOPMENT CO., owner of certain real prop-
erty situated in the City of Anaheim, County of Orange, State
of California, described as follows:
The East 75.00 feet of that portion of the northeast
quarter of the northeast quarter of section 27,
Township 4 South, Range 10 West, in the Rancho San
Juan Cajon de Santa Ana, city of Anaheim, county of
Orange, state of California, as shown on a map re-
corded in book 51 page 10 of Miscellaneous Maps,
in the office of the county recorder of said county,
described as follows:
Beginning at a point on the North line of said section,
South 89 54' 30" West 545.00 feet from the northeast
corner of said section; thence South 1 19' 30" East
265.06 feet parallel with the East line of said section
to a line parallel with and southerly 265.00 feet from
said North line; thence South 89 54' 30" West 369.62
feet along said parallel line to the southeast corner
of the land described in the deed to Louis M. Rubin
recorded March 4, 1960, in book 5130 page 186 of
Official Records; thence North 1 20' 15" West 265.06
feet to the northeast corner of said land of Rubin;
thence North 89° 54' 30" East 369.68 feet to the point
of beginning.
AND WHEREAS the City Planning Commission did hold
a public hearing at the City Hall in the City of Anaheim on
March 19, 1962, notice of which said public hearing was
duly given as required' by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and
in its behalf, and after due consideration of all evidence
and reports offered at said hearing, did adopt Resolution No.
266, Series 1961 -62, granting said Variance No. 1457; and
WHEREAS, thereafter, within twenty -two (22) days
from the date of the adoption of said resolution, a written
appeal was filed with the City Council of the City of Anaheim
protesting the action of the City Planning Commission granting
said variance, and said appeal was set for public hearing on
May 1, 1962, at 7 :00 o'clock P.M. at the City Hall in the
City of Anaheim, and notice of such public hearing was duly
given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, the City Council did find that the action
of the City Planning Commission in granting said variance
should be disapproved, and that Variance No. 1457 should be
denied, and did thereupon adopt Resolution No. 62R -422 denying
said variance; and

WHEREAS, a request for rehearing
of additional evidence was received by the
the petitioner for said variance, and said
public hearing on June 6, 1962, and notice
was duly given as required by law; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all
the evidence and reports offered at said hearing, the City
Council does find and determine that:
1. There is no substantial property right possessed
by other property in the same vicinity and zone
and denied the subject property.
2. It appears that the subject property can be
adequately developed and used under the present
zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the petition for Variance No. 1457
permitting the construction of a two -story professional office
building on the property hereinabove described be, and the same
is hereby, denied.
TIIE FOREGOING RESOLUTION is approved and signed by
me this 10th day of July, 1962.
