A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE EXECUTION
OF AN AGREEMENT WITH THE COUNTY OF ORANGE
FOR THE WIDENING OF A PORTION OF BALL ROAD
AND FOR ROADWAY CONSTRUCTION ON A PORTION
OF GILBERT STREET IN UNINCORPORATED TERRITORY.
WHEREAS, considerable traffic congestion presently
exists and is progressively increasing on Ball Road between
Loara Street and Sherrill Street, in that large commercial
and residential facilities are being completed in this area
in the City of Anaheim which will be adding to the traffic
on Ball Road between said Loara Street and Sherrill Street;

WHEREAS, portions of Bali Road are two -lane
roadways; and
WHEREAS, in order to relieve existing traffic con-
gestion and in order to facilitate the orderly flow of traffic
on Ball Road, widening of said street to four traffic lanes
will be required; and
WHEREAS, a portion of Gilbert Street, from the cen-
terline of Ball Road to 1330 feet south of the centerline of
Bali Road, is unimproved and, as a result, a hazardous traffic
condition exists, and in order to relieve existing traffic and
drainage conditions, roadway construction in the unimproved
portion of the roadway and capping of the existing roadway
along said Gilbert Street will be required; and
WHEREAS, a portion of said Ball Road and Gilbert
Street is in unincorporated territory and the relief of
traffic congestion and drainage conditions requires the cooper-
ation of the City of Anaheim and the County of Orange; and
WHEREAS, the County and the City desire to enter into
an agreement for the widening of said portion of Bali Road and
for roadway construction on said portion of Gilbert Street in
unincorporated territory, and to specify the proportionate share
of the costs that are to be borne by the County and the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that an agreement be made and entered
into by and between the City of Anaheim and the County of Orange
for the widening of a portion of Ball Road and for roadway
construction on a portion of Gilbert Street in unincorporated
territory, more particularly hereinafter described, upon the
following terms and conditions and for the proportionate
share of the costs hereinafter set forth:
1. City of Anaheim shall:
(a) Prepare detailed plans, specifications, and
estimates for the project.
(b) Have jurisdiction of the construction area
within the unincorporated area of the County (the same being
Ball Road from 993 feet, more or less, easterly of the center-
line of Gilbert Street to 15 feet easterly of the centerline

of Gilbert Street, and Gilbert Street from 30 feet south of
the centerline of Ball Road to 1330 feet, more or less, south
of the centerline of Bali Road) during the period of time
from the commencement of the project until its completion.
(c) Be designated as contracting and construction
agent for the County and City.
2. County of Orange shall:
(a) Approve plans and specifications as to design
and construction features affecting the construction of the
portion of the project within the unincorporated area.
(b) At all times during the progress of the con-
struction of the project have access to the work for the purpose
of inspection thereof and should the County deem any remedial
measures to be necessary, it shall notify the engineering
department of the City of Anaheim thereof.
3. Upon completion of the project Countyts share
of the project shall be the actual construction costs of the
project within the unincorporated County territory at the
time the project is advertised for bids, the estimate of
which is as follows:

The actual costs to be based on contract unit prices.
L. Upon completion of the project the City shall
submit full, true, and correct copies of documents, certifi-
cates, and itemized bills to the County and the County shall
reimburse the City within thirty (30) days upon submission of
statement of °such costs for the full cost of the construction
within the unincorporated area.
5. The costs of design, survey, construction en-
gineering and supervision shall be borne by the City.
6. After completion of the project, the jurisdiction

of the unincorporated area shall immediately revest in the
County, and the County shall thereafter assume the cost of
maintenance of the unincorporated area covered by this agree-
ment.
BE IT FURTHER RESOLVED that the Mayor and the
City Clerk be, and they are hereby, authorized to execute
an agreement with the County of Orange for the widening and
improvement of said portions of said streets hereinabove
referred to, upon the terms and conditions and for the
proportionate share of the costs hereinabove set forth.
THE FOREGOING RESOLUTION is approved and signed
by me this 3rd day of July, 1962.
