56R-3280 ~ ,F - RESOLUTION NO. 3280 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIl1 DENYING VARIANCE NO. 528. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Lot 16 of Tract No. 601. (Said property is located at 401 West North Street.) AND WHEREAS, said City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on April 16, 1956, notices of Which said public hearing were duly given, as required by law and the prOVisions of Section 9200.17 of the Anaheim Munioipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 166 Series 1955-56 recommending that Variance No. 528 be granted; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission granting said variance, and said ap-peal was set for public hearing on May 8, 1956, at 7:00 o'clock P.M., at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said publio hearing, the City Council d.id duly hold and oonduct suoh hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports and did thereupon close said hearing and declare that the matter would be further considered on J1ay 15, 1956; and WHEREAS, after due investigation and studies made by itself and in its behalf. and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. ;- 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning -1- -- t~ Commission granting Variance No. 528, requesting permission to complete and use the area over the present garage looated on the-above-described property for an apartment, be, and the Same is hereby Qisapproved, and tr~t Variance No. 528 be, and the same is hereby, denied.
