1962-0937RESOLUTION NO. 62R -937 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 244 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from DARRYL WALKER, 2112 Nyon Place, Anaheim, California for a Conditional Use Permit to establish a motel on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Commencing at the Northwest corner of the North- east quarter of the Northeast quarter of Section 17, in Township 4 South, Range 10 West, in the Rancho Los Coyotes, as shown on a map thereof recorded in book 51, page 7, et seq., Miscellaneous Maps, records of said Orange County; running thence South along the West line of said Northeast quarter of the Northeast quarter 425 feet; thence East parallel to the North line of said Northeast quarter of the Northeast quarter 102 -1/2 feet; thence North parallel to the West line of said Northeast quarter of the Northeast quarter, 425 feet; thence West 102 -1/2 feet to the point of beginning; EXCEPTING THEREFROM the North 66 feet of said land as granted to the state of California for highway purposes, by deed recorded July 5, 1955, in book 3126, page 429, Official Records, in the office of the County Recorder of said Orange County. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on August 20 19 62 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 452, Series 1962 -63 denying Conditional Use Permit No. 244 and -1- WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in denying, said Conditional Use Permit and said appeal was set for public hearing on October 9 19 62 at the City Hall, in the City of Anaheim, and notices of 1 hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion denying said Conditional Use Permit be, and the same is hereby disapproved and that Conditional Use Permit No. 244 be, and the same is hereby, granted permitting the establishment of a motel on the property hereinabove described, subject to the following conditions: 1. That all engineering requirements of the City of Anaheim along Lincoln Avenue, including preparation of improvement plans and installation of all improve- ments, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 2. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be as far removed from residentia •ro.ert as is reas_ona •ossible, and s a be enc ose• wit a so i ence or wa prior to final building inspection. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Lincoln Avenue, for street lighting purposes. 4. That access drives shall be provided, with a minimum vertical clearance of 14 feet. 5. That a site screen shall be located along any second story portion of subject property for the full length of the property. 6. That a planting area of a minimum width of 5 feet shall be provided along the westerly boundary of subject property, with planting of a sufficient height to provide a screen for the residential property; that plans for said planting or land- scaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 7. That the owner of subject property shall dedicate to the City of Anaheim all access rights to Embassy Avenue. 8. That a modified cul -de -sac shall be provided at the terminus of Embassy Avenue. That engineering services for said cul -de -sac shall be provided by the City, but that said cul -de -sac shall be constructed by the developer of subject property. 9 That two -story construction shall not project southerly from the north property line of that property presently owned by one Homer Wilson, if said north property line were extended easterly from its present northeast corner. 10. That a garbage disposal shall be installed in each unit of said motel. 11. That development and construction shall conform to plans marked "Exhibit 1, Revised," on file with the City, EXCEPT that the building layout shall conform to the revised plan, marked "Exhibit A," dated October 16, 1962, signed by Mayor Coons, and on file with the City of Anaheim. J 12. That the final plans for the development of subject property shall be subject to review by and approval of the City Council. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
