1962-0888WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 62 to consider an amendment to Title lb of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 9th day of October 19 62 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: RESOLUTION NO, 62R ud8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED, PARCEL 1: That portion of the southeast quarter of the southeast quarter of Section 20, Township 4 South, Range 10 West, partly in the Rancho Los Coyotes and partly in the Rancho Las Bolsas, in the City of Anaheim, County of Orange, State of California, as said southeast quarter is shown on a map of Tract 2722, recorded in book 74 pages 27, 28 and 29, Miscellaneous Maps, in the office of the county recorder of said county, described as follows: 62 -63 -24 Beginning at the southeast corner of Section 20; thence North 0 55' 00" East 1135.46 feet along the east line thereof to the true point of beginning; thence North 89 05' 00" West 150.00 feet to the southeast corner of Lot 39 of said tract; thence North 0 55' 00" East 91.14 feet along the east line of said lot; thence South 89 22' 57" East 150.00 feet to the east line of said Section 20; thence South 0 55' 00" West 91.93 feet to the true point of beginning. EXCEPT the East 50.00 feet thereof. PARCEL 2: That portion of the Southeast quarter of the Southeast quarter of Section 20, Township 4 South, Range 10 West, partly in the Rancho Los Coyotes and partly in the Rancho Las Bolsas, in the City of Anaheim, County of Orange, State of California, as per Map recorded in Book 51, page 10, Miscellaneous Maps, in the office of the County Recorder of said Orange County, described as follows: Beginning at the Southeast corner of Section 20; thence North 0 55' 00" East 1227.38 feet along the East line of said Section to the true point of beginning; thence North 89 22' 57" West 150.00 feet; thence North 0 55' 00" East 92.00 feet parallel with the East line of said Section 20; thence South 89 22' 57" East 150 feet to said East line; thence South 0 55' 00" West 92.00 feet to the true point of beginning; EXCEPT the East 50.00 feet for street purposes. be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE and incorporated in C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Euclid Street, for street widening purposes. 2. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Euclid Street, for street lighting purposes. 3. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 10. That Conditions Nos. 1, 2, and 8, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper. THE FOREGOING RESOLUTION is approved and signed by me this 9th day of October 962. 4. That subject property shall be developed substantially in accordance with plans marked "Exhibits 1 and 2" on file with the City of Anaheim. 5. That a landscaped strip of a minimum width of 6 feet shall be installed and maintained abutting the planned highway right of way line of Euclid Street, together with tree wells in the parkway along the Euclid Street right of way. That plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 6. That a 6 -foot masonry wall shall be constructed along the west and south boundaries of subject property prior to final building inspection. 7. That the display material shall be limited to one unlighted sign for each building, the size of which shall not exceed eight square feet. 8. That the owner of subject property shall place of record City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the uses of subject property to business and professional offices only. 9. That all flags and banners shall be removed from subject property, except as permitted in Condition No. 7 hereof. -3- STATE OF CALIFORNIA COUNTY OF ORANGE ss.
