AHA-2025-006RESOLUTION NO. AHA-2 0 2 5— 0 0 6 A RESOLUTION OF THE GOVERNING BOARD OF THE ANAHEIM HOUSING AUTHORITY DECLARING CERTAIN AUTHORITY - OWNED REAL PROPERTY LOCATED AT 703 AND 705 SOUTH ANAHEIM BOULEVARD, ANAHEIM, CALIFORNIA, AS EXEMPT SURPLUS LAND PURSUANT TO THE SURPLUS LAND ACT, CALIFORNIA GOVERNMENT CODE SECTIONS 54220, ET SEQ.; AND MAKING CERTAIN FINDINGS UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the Anaheim Housing Authority ("Authority") is a California housing authority duly organized and existing under the California Housing Authorities Law, Part 2 of Division 24, Section 34200, et seq., of the Health and Safety Code ("HAL"), and has been authorized to transact business and exercise the power of a California housing authority pursuant to action of the City Council ("City Council") of the City of Anaheim; and WHEREAS, the City of Anaheim is a California charter city and municipal corporation ("City"); and WHEREAS, the Authority also serves as the housing successor to the former and dissolved Anaheim Redevelopment Agency pursuant to Division 24, Part 1.85, of the California Health and Safety Code, Section 34170, et seq. ("Dissolution Law"); and WHEREAS, together, the HAL, Dissolution Law, and applicable related statutes of the California Health and Safety Code are referred to as the "HSC"; and WHEREAS, the Surplus Land Act, codified in California Government Code sections 54220, et seq. ("SLA"), defines "surplus land" as land owned in fee simple by any local agency for which the local agency's governing body takes formal action in a regular public meeting declaring that the land is surplus and is not necessary for the agency's use; and WHEREAS, effective January 1, 2020, Assembly Bill (AB) 1486, and most recently amended by Senate Bill (SB) 747 and Assembly Bill (AB) 480, effective January 1, 2024, amended the SLA to require the Authority to formally declare properties as "surplus land" or "exempt surplus land" prior to taking action to dispose of such properties; and WHEREAS, a declaration of "exempt surplus land," as permitted by the SLA, is a process adopted in State law; and WHEREAS, pursuant to California Government Code section 54221(f)(1)(B) of the SLA, "exempt surplus land" includes, "Surplus land that is less than one-half acre in area and is not contiguous to land owned by a state or local agency that is used for open -space or low- and moderate - income housing purposes;" and WHEREAS, the Authority owns in fee simple certain parcels of real property located at the common addresses of 703 and 705 South Anaheim Boulevard, Anaheim, California, which together comprise approximately 0.31 acres (together, the "Property"); and WHEREAS, this declaration of "exempt surplus land" does not obligate the Authority to subsequently dispose of the Property and the Authority may in the future determine that the Property is necessary for its use and not move forward with any disposition of any specific property. NOW, THEREFORE, THE GOVERNING BOARD OF THE ANAHEIM HOUSING AUTHORITY FINDS AND RESOLVES AS FOLLOWS: Section 1. The Authority hereby finds and determines that the foregoing recitals are true and correct and are a substantive part of this Resolution. Section 2. The Governing Board hereby declares the Property to be "exempt surplus land" pursuant to Government Code section 5422 1 (f)(1)(B), which applies to "surplus land that is less than one-half acre in area and is not contiguous to land owned by a state or local agency that is used for open -space or low- and moderate -income housing purposes," because the Property is only .31 acres and is not contiguous to land owned by any governmental entity for open -space or affordable housing purposes. Section 3. This Resolution has been reviewed with respect to the applicability of the California Environmental Quality Act (Public Resources Code Section 21000, et seq.), including the CEQA Guidelines (together, "CEQX ). The declaration of the Property as "exempt surplus land" does not have the potential for creating a significant effect on the environment and no further review or action under CEQA is required pursuant to CEQA Guidelines Section 15060(c)(3) (not a project as defined by CEQA Guidelines Section 15378), Section 15312 (the sale of surplus government property), and Section 15061(b)(3) (no possibility that the action will have a significant effect on the environment). Section 4. This Resolution shall be effective upon adoption. Section 5. The Authority Secretary shall certify to the adoption of this Resolution.
