A RESOLUTION OF THE CITY COTTrCIL OF THE

1E E LL AS, the City Planning Cot mission of the City
of Anaheim did receive a petition from the property owner
of certain real property situated in the City of Anaheim,
County of Orange, State of California, described as follows:
The north 216 feet of the east 100 feet of the
west 290 feet of Lot 4, Block "A" of Tract 13,
Orange County.
Said property is further described as being
located on the south side of Lincoln Avenue
approximately 150 feet east of Brookhurst
Avenue.
AND WRERLAS, the City Planning Commission did hold
a public hearing at the City Hall in the City of Anaheim on
September 6, 195 notices of which said eublic hearing were
duly given as required by law and the provisions oC Section
9200.17 of the Anaheim Municipal Code; and
WTrILT_LAS, said. City Planning Commission, after due
inspection, investigation and studies made by itself and in
its behalf, and after due consideration of all evidence and
reports offered at said hearing, did adopt Resolution No.
29 Series 1955 -56, granting said Variance No. 408 upon
the conditions therein set forth; and
NHIRTTAS, th rea_fter, within twenty (20) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning Cornission in .ranting said variance, and
did set a public hearing thereon to be held on the llth day
of October, 1955 at 7:00 o'clock P.M., in the City Hall, in
the City of Anaheim, and notice of such public hearing was
duly given as required by law and the provisions of Section
9200.17 of the Anaheim Municipal Code; and
WHEFJ AS, after due investigation and studies made
by itself and in its behalf, and after due consideration of
all the evidence and reports offered at said hearing, the
City Council does find and determine that:
1, There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the 1roperty
that do not apply generally to the property or
class of use in the same vicinity and. zone.
2. that such a variance is necessary for the
preservation and enjoyment of a substantial
property right possessed by other property
in the same vicinity and zone and denied
to the property in question.
3. That the :ranting of such a variance will not
be materially detrimental to the public welfare
or injurious to the property or improvements in
such vicinity and zone in which the property is
located.

4. That the granting of such viceeiance will not
adversely affect the comprehensive general
zoning plan.
NOW, THEEFOL E, B I'i' RLSOLV ,D by the City Council
of the City of Anaheim that Variance No. 403, requesting
permission to construct and operate a doughnut and coffee
shop on the above described property, be, and the same is,
hereby granted to PAUL J. KNAAK, 16752 East Santa Clara,
Santa Ana, California, upon the following conditions:
1. Clearing with the State Highway Department with
reference to the widening of Lincoln Avenue, and
establishiAg a building set -back line.
2. Providing improved off street parking as shown on
the plans.
3. That all plans and specifications for buildings
to he erected on the property shall be subject
to approval of an Architectural Committee con
sisting of the following:
(a) One representative of the owner, his heirs
or assigns.
(b) One representative of the City appointed by
the City Council,
(c) A neutral party to be selected by the owner
and the City of Anaheim.
This committee shall review the plans and specifi-
cations for structural recu.irements, architectural
design, building; locations, parking facilities,
and other matters, and one set of plans shall be
signed by each of the Architectural Committee and
filed with the Building Inspector of the City of
Anaheim.
L. That the property be improved in accordance with
the plans and photograph submitted to the City
Council on October 11, 1955 at said public hear
ing hereinbefore referred to, and that said
photograph and plans of the proposed Danny's
Donut Shop submitted at said hearing be filed
with the City of Anaheim and made a part of the
records,
That all requirements of the City of Anaheim
relating to sidewalks, curbs, streets, grading,
paving, and other engineerin_ requirements shall
be complied with as recom ended by the City
Engineer.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner,
his heirs, successors or assigns to comply with the Anaheim
Municipal Code and regulations, and the conditions heroin.
Said variance is granted for the term prescribed by the Anaheim
Municipal Code unless otherwise specified herein.
