A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING A SEALED PFDPOSAL AND
AWARDING A CONTRACT TO TEE LOWEST RESPONSIBLE
BIDDER FOR THE FURNISHING OF ALL PLANT, LABOR,
SERVICES, MATERIALS AND EQUIPMENT AND ALL
UTILITIES AND T'FANSPCRTATI CN, INCLUDING POWER,

WHEREAS, the City Council of the City of Anaheim did
cause to be published in a newspaper of general circulation,
printed, published end circulated in the City of Anaheim, to wit:

All plant, labor, services, materials and equipment, and all utili-
ties and transportation, including power, fuel and water, and per-
forming all work necessary to construct and complete, in a good
and workmanlike manner, in strict accordance with the plans and
specifications on file in the Office of the City Clerk of the City
of Anaheim, the following public improvement, to wit: The construc-
tion, installation and completion of a new street lighting system
along the south side of Center Street from the east property line
of South Claudina Street to the east property line of South Helena
Street, and alone the north side of Center Street from the west
property line of North Claudina Street to the east property line of
North Helena Street, in the City of Anaheim, by the removal of 33
existing street lighting standards -18 from the south side and 15
from the north side of Center Street- -and the construction and in-
stallation of 26 new street lighting standards -J4 on the south side
and 12 on the north side of Center Street luminaires, ballast,
cables, conduit, foundations, and miscellaneous appurtenances as
indicated on the plans, Work Order No. 2185.
in accordance with the designs, plans, profiles and specifications
of said public improvement on file in the Office of the City
Clerk of the City of Anaheim; and
WHEREAS, said notice inviting sealed proposals for said
public improvement did provide that sealed proposals would be re-
ceived by the City Council of the City of Anaheim at the Office
of the City Clerk of the City of Anaheim up to the hour of 7:00
o'clock P.:M. on the 13th clay of September 195 i for the
furnishing of all plant, lu'eer, so; vi ee materials and equipment,
all uti.l.i: _es and tra.nsportati c n, n eluding power, fuel and water,
and performing all we necessary to cons t: u.ct and complete, in a
good and workmanlike manner, the public improvement hereinabove
more particularly mentioned and described and which notice did
state and declare that pursuant to the provisions of Section 1770
of the Labor Code, the C t Y Counci of the City of Anaheim had
ascertained the prevailing rate of wages in the locality in which
this type of labor is to be performed for each craft or type of
workman or mechanic needed to execute the contract and did set
forth the prevailing hourly wage scale so ascertained; and
WHEREAS, the City Council of the City of Anaheim did
receive the following sealed proposals rior to 7:00 o'clock P.M.
on the lath day of September 195 5 in response to the
notice aforesaid inviting sealed proposals, to wit:

hEREAS, the City Council did thereupon refer said bids
to the Suptt. of Light, Power and Water for examination, tabu-
lation and report to the City Council, and said Superintendent Qf
Lint, Power and water did examine and tabulate said
sealed proposals and did report to the Council the result of his
examination and tabulation; and
WHEREAS, the City Council finds that the sealed proposals

is the lowest responsible proposal submitted for the furnishing of
all plant, labor, services, materials and equipment, all utilities
and transportation, including power, fuel and water and performing
all work necessary to construct and complete in a good and workman-
like manner in strict accordance with the specifications, plans
and drawings therefor on file in the office of the City Clerk of
the City of Anaheim of the public improvement hereinabove mentioned
and described together with the appurtenances thereto and as speci-
fied in the notice inviting sealed proposals and that said proposal
of said above named bidder should be accepted and a contract award-
ed to said bidder in accordance therewith; and

WHEREAS, the City Council finds that the above mentioned
sealed proposal is the lowest responsible proposal received and
that the person, firm or corporation submitting said proposal ie a
responsbile person, firm or corporation and that the proposal sub-
mitted is the best suited and fitted for the public improve.,ient to
be constructed.
NOW, THER:FORE, BE IT RE SOLVED BY THE CITY COUNCIL OF THE
ITY OF ANAHEIM that the sealed proposal submitted by NEWBE Y__
LEQTRIC CORPORATION, 1038 VENICE BOUTLTNARD LOS ANGELS LS CALIFORNIA,
for the furnishing of all plant, labor, services, materials and
eauipment, all utilities and transportation, including power, fuel
and water and performing all work necessary to construct and com-
plete in a good and workmanlike manner in strict accordance with
the specifications, plans and drawings therefor on file in the
cffice of the City Clerk of the City of Anaheim and the notice in-

above more particularly mentioned and described, together with the
appurtenances thereto, be, and the same is hereby, accepted, and
that a contract for the construction and completion of said public
improvement be, and the same is hereby, awarded to the said above
named bidder.
AND EE IT FURTHER RESOLVED that the successful bidder or
bidders uporr each contract awarded as hereinabove set forth shall
be, and they are hereby required to execute a contract in the re-
quired form with the City of Anaheim upon the terms and conditions
specified in the notice inviting sealed proposals and the proposal
submitted by said successful bidder or bidders and in accordance
with the plans :and specifications for said public improvement
hereinabove described and in accordance with the terms, conditions
and provisions of this resolution, and that said successful bidder
or bidders to whom each contract is awarded shall be required to
furnish a surety bond in an amount equal to one hundred per cent
(100 of the contract price for all labor, materials and equipment
to be furnished and performed as set forth in the sealed proposals
submitted by said bidder for the construction of said public im-
oroveinent together with the appurtenances:;,thereto or such portion
thereof as is covered by said contract as security for the faith-
ful performance of said contract and a separate surety bond in an
amount equal to one hundred per cent (100,x) of the construction
cost of said public improvement covered by said contract as
security for the payment of all persons performing labor and furn-
ishing material for said project.
AND BE IT 7°RTHER RESOLVED that said successful bidder
or bidders be, and they are hereby, required to furnish to the
City of Anaheim in companies satisfactory to the City of Anaheim
public liability, property damage, compensation, and other insur-
ance in the amounts and for the purposes as set forth and specified
in the notice inviting sealed proposals and subject to the approval
of the City Attorney as to form and sufficiency.
AND BE IT FURTHER RESOLVED th& t the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, authorized
and directed to make, execute and enter into for and on behalf of
the City of Anaheim a written contract with said successful bidder
or bidders for the furnishing of all plant, labor, materials, and
equipment and performing all work as hereinabove more particularly
described for the construction, installation and completion of
said oublic improvement hereinabove described upon the terms and
conditions as specified in the notice inviting sealed proposals,
the detailed design, plans, profiles, drawings and general specifi-
cations and detailed specifications and drawings and all addenda
thereto and all modifications incorporated therein prior to the
date of the opening of bids, on file in the office of the City
Clerk of trove City of Anaheim and in strict accordance with the
terms, conditions and provisions of this Resolution, and in accord-
ance with all the contract documents herein specified.
THE FOREGOING RESOLUTION is signed and approved by me

RECORD OF CANVASS OF RETURNS OF SPECIAL ANNEXATION ELECTION
HELD AUGUST 23, 1955
The City Council of the City of Anaheim hereby makes a record of canvass
of returns of special annexation election.
Said special annexation election was held on the 23rd day of August, 1955,
in the manner provided by law.
That for said election said City Council duly established one voting
precinct which was designated as the EAST SYCAMORE ANNEXATION VOTING PRECINCT.
That the polling place for such election was established and maintained
at Wanda L. Stankey residence PATIO, 7741 Placentia Avenue, Orange County,
California, which was within the hereinafter described unincorporated territory.
The description of the property proposed to be included in the annexa-
tion known as the EAST SYCAMORE ANNEXATION is as follows:
A parcel of land being a portion of Fractional Sections 1 and 2 and
Section 11 Township 4 South, Range 10 West, San Bernardino Base and Meridian and
more particularly described as follows:
Beginning at an angle point in the existing Anaheim City Limits Line
as established by the Acacia Street Annexation to the City of Anaheim, Annexation
No. 35 as passed by Ordinance No. 841 on April 14, 1953 and filed with the
Secretary of State on May 18, 1953, said point being the intersection of a line
parallel to and 30.00 feet northerly, as measured at right angles of southerly
line of said Fractional Section 2 (said southerly line also being the centerline
of La Palma Avenue) and the westerly line of SE4 of SW4 of SE4 of said Fractional
Section 2; thence,
1. Northerly 630 feet, more or less, along said existing Anaheim City
Limits line and said westerly line of SE4 of SW4 of SE4 of Fractional Section 2
to the most southwesterly corner of Lot 21 of Golden State Tract No. 2 as shown
on a map thereof in Book 4 at Page 68 of Miscellaneous Maps, Records of Orange
Co.; thence,
2. Continuing northerly 640 feet, more or less, along said existing
Anaheim City Limits Line and also along westerly line of said Lot 21, to a point
in a line 20.00 feet southerly, as measured at right angles, from the north line
of said Lot 21 (said north line also being the centerline of Romneya Drive) and
said point also being in the south line of the East Romneya Drive Annexation to
the City of Anaheim, Annexation No. 41 as passed by Ordinance No. 889 on April 2,
1954 and filed with the Secretary of State on May 10, 1954; thence,

easterly prolongation, and also along said existing Anaheim City Limits line to
a point in a line parallel to and 20.00 feet easterly, as measured at right
angles from the easterly line of said Lot 21 (said easterly line also being the
centerline of Baxter Street); thence,
4. Northerly 679 feet, more or less, along a line parallel to and
20.00 feet easterly, as measured at right angles, from the westerly line and
its southerly prolongation of Lot 16, and also along said existing Anaheim City
Limits Line to a point in the north line of said Lot 16; thence,
5. Westerly 680 feet, more or less, along said existing Anaheim City
Limits Line and also along the north line of Lots 16 and 17 of said Golden State
Tract No. 2 to the northwest corner of said Lot 17, said point also being
located in the east line of said Acacia Street Annexation; thence,

southwesterly as measured at right angles, from the centerline of proposed State
of California Freeway to be known as Route 175 Section B; said parallel line also
being the southwesterly right of way line of said freeway; thence,
16. Southeasterly 1570 feet, more or less, along said line parallel to
centerline of Route 175 Section B to a point in a line parallel to and 20.00
feet easterly, as measured at right angles from the westerly line of E2- of said
Fractional Section 1 (said westerly line also being the centerline of Sunkist
Street); thence,
17. Southerly 1550 feet, more or less, along said line parallel to
westerly line of E2 of Fractional Section 1 to a point in a line parallel to
and 30.00 feet northerly, as measured at right angles, from the south Section
line of said Fractional Section 1 (said south section line also being the
centerline of La Palma Avenue); thence,

Anaheim City Limits line as established by the Roberts Annexation to the City

19. Continuing westerly 990 feet, more or less, along said parallel
line and also along said existing Anaheim City Limits line to a point in a line
parallel to and 330.00 feet easterly as measured at right angles, from the west
Section line of said Fractional Section 1 (said west Section line also being
the centerline of Placentia Avenue) and said parallel line being the east line
of the East Anaheim Annexation, Annexation No. 8, to the City of Anaheim, as
passed by Ordinance No. 700 on April 9, 1946 and filed with the Secretary of

20. Northerly 395 feet, more or less, along said line parallel to west
Section line of Fractional Section 1 and also along said existing Anaheim City
Limits line to a point in a line parallel to and 425.00 feet northerly as
measured at right angles from said south section line of Fractional Section 1;

most southwesterly corner of Lot 4 of the Monroe E. Wallace Subdivision as
shown on a map thereof recorded in Book 11 at Page 46 of Miscellaneous Maps,
Records of Orange County, said point also being the most southeasterly corner of
the Monroe E. Wallace Annexation to the City of Anaheim, Annexation No. 23, as
passed by Ordinance No. 798, on March 11, 1952 and filed with the Secretary of
State on April 10, 1952; thence,
26. Northwesterly 1340 feet, more or less, along said existing Anaheim
City Limits line and also along westerly line of Lots 4 and 2 of said Monroe E.
Wallace Subdivision to a point located 30.00 feet southerly, as measured at
right angles from said southerly Section Line of Fractional Section 2, said
point also being located at an angle point in said Acacia Street Annexation;
thence,
27. Northerly 60 feet, more or less, along said existing Anaheim City
Limits line and crossing said southerly section line of Fractional Section 2 at
right angles to a point in a line parallel to and 30.00 feet northerly, as
measured at right angles, from said southerly Section Line of Fractional
Section 2; thence,

28. Easterly 1340 feet, more or less, along said line parallel to
southerly Section Line of Fractional Section 2 and also along said existing
Anaheim City Limits Line to the point of beginning.
That the proposition submitted to the electors residing within said
unincorporated territory was:

Shall EAST SYCAMORE ANNEXATION be annexed to the
City of Anaheim, California, and the property in YES
said EAST SYCAMORE ANNEXATION be, after such
annexation, subject to taxation equally with the
property within said City of Anaheim to pay its
pro rata portion, based upon assessed valuation,
of all bonded indebtedness of said City of NO
Anaheim outstanding on July 22, 1955, or thereto-
fore authorized?
That said City Council met at its regular meeting after the expiration
of three days from and after the date of said election to canvass the returns of
said election, and at said regular meeting did make and complete its canvass of
such returns.
That from and by its canvass of such returns, said City Council finds:
1. That the whole number of votes cast at such election was 46.
2. That the number of votes cast at such election in favor of annexa-
tion was 36.
3. That the number of votes cast at such election against annexation
4. That the number of ballots received as absentee votes was 0.
