A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM SUSTAINING THE ACTION OF THE CITY
PLANNING COMMISSION DENYING VARIANCE NO. 3714..
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition from the owner of certain real
property situated in the City of Anaheim, County of Orange,
State of California, described as follows:
That portion of Lot 9 of a Replat of the Orchard
Park Tract, in the City of Anaheim, County of
Orange, State of California, as per map thereof
recorded in Book 7, page 6 of Miscellaneous Maps,
records of said Orange County, more particularly
described as follows:
Beginning at a point in the Southerly line of said
Lot 9, 320.00 feet Westerly from the Southeasterly
corner of said Lot 9, said point being in the center
line of West Vermont Street 66.00 feet in width;
thence Northerly parallel to the Easterly line of
said Lot 9, 150.00 feet; thence Westerly parallel
with the Southerly line of said Lot 9, 80.00 feet;
thence Southerly parallel to the Easterly line of
said Lot 9, 150.00 feet to the Southerly line of
said Lot 9 and the center line of West Vermont
Street; thence Easterly along the Southerly line
of said Lot 9, 80.00 feet to the point of begin-
ning.
AND WHEREAS, the City Planning Commission did hold
a public hearing at the City Hall in the City of Anaheim on
June 13, 1955, notices of which said public hearing were
duly given as required by law and the provisions of Section
9200.17 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in
its behalf, and after due consideration of all evidence and
reports offered at said hearing, did adopt Resolution No.
185 Series 195 -55 denying Variance No. 371 for the reasons
therein stated; and
WHEREAS, thereafter, within twenty (20) days from the
date of the adoption of said resolution, a written appeal was
filed with the City Council of the City of Anaheim protesting
the action of the City Planning Commission denying said
variance, and said appeal was set for public hearing on the
12th day of July, 1955 at 7 :00 o'clock P.M. at the City Hall
in the City of Anaheim and notice of such public hearing was
duly given as required by law and the provisions of Section
9200.17 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all
the evidence and reports offered at said hearing, the City
Council does find and determine that:
1. There is no substantial property right
possessed by otherproperty in the same
vicinity and zone and denied the sub-
ject property.

2. It appears that the subject property can
be adequately developed and used under the
present zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission denying said Variance No. 37L, requesting per-
mission to erect a four -unit apartment building on the above
described property, be and the same is hereby sustained, and
that Variance No. 374 be, and the same is hereby, denied.
THE FOREGOING RESOLUTION is signed and approved by
me this 26th day of July, 1955.
