A RESOLUTION OF THE CITY COUNCIL OF TH; CITY
OF ANAHEIM APPROVING THE ACTION OF THE CITY
PLANNING COMMISSION GRANTING VARIANCE NO. 369,
UPON THE FURTHER CONDITION THAT THERE SHALL
BE A MINIMUM 25 -FOOT BUILDING SETBACK.
WHEREAS, the City Planning Commission of the City
of Anaheim did receive a petition from the property owner
and /or agent of certain real property situated in the City
of Anaheim, County of Orange, State of California, described
as follows:
Lot 14 in Block "D" of California Palomar
Tract, in the City of Anaheim; and further
described as 600 South Palm Street.
AND WHEREAS, the City Planning Commission did hold
a public hearing at the City Hall in the City of Anaheim upon
said petition on May 31, 1955, notices of which said public
hearing were duly -given as required by law and the provisions
of Section 9200.17 of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection, in-
vestiation and studies made by itself and in its behalf, and
after due consideration of all evidence and reports offered
at said hearing, did adopt its Resolution No. 179 Series
1954 -55 recommending to the City Council of the City of
Anaheim that Variance No. 369 be granted upon the conditions
stated in said resolution; and
NHEiEAS, thereafter, within twenty (20) days from
the date of the adoption of said resolution, written appeals
were filed with the City Council of the City of Anaheim re-
questing a review of the action taken by the City Planning
Commission in granting said variance, and said appeals were
set for hearing on June 28, 1955 at 7:00 o'clock P.M. in the
City Hall in the City of Anaheim, and notice of such public
hearing was duly (given as required by law and the provisions
of Section 9200.17 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made
by itself and in its behalf, and after due consideration of
all the evidence and reports offered at said hearing, the
City Council does find that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the preserva-
tion and enjoyment of a substantial property right
possessed by other property in the same vicinity
and zone and denied to the property in question.
3. That the granting of such a variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.

L.. That the granting of such variance will not ad-
versely affect the comprehensive general zoning
plan.
NO •J, THER TsFORE, BE IT RESOLVLL) by the City Council
of the City of Anaheim that Variance No. 369 requesting per-
mission to construct a professional building to accommodate
one doctor and one dentist, on the property hereinabove de-
scribed, be and the same is hereby granted to URBIN N.
HARTMAN, 559 South Clementine Street, Anaheim, California,
upon the conditions set forth in Resolution No. 179 Series
1954 -55 of the City Planning Commission, namely:
1. The development of this property in accordance
with precise plans which have been submitted to
the City of Anaheim;
2. That off- street parking be provided in the rear
of the property;
AND TTPON THE FTJ TITER CONDITION that there shall be
established a minimum building setback of 25 feet.
The City Council hereby reserves the right to re-
voke such variance permit for good cause or failure of said
owner, his heirs, successors or assigns, to comply with the
Anaheim Municipal Code and regulations, and the conditions
herein. Said variance is granted for the term prescribed by
the Anaheim Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is signed and approved by
me this 12th day of July, 1955.
