A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 362.
WHEREAS, the City Planning Commission of the City
of Anaheim did receive a petition from the owner of certain
real property situated in the City of Anaheim, County of
Orange, State of California, described as follows:
(1) Lots 1 to 67, inclusive, of Tract No, 1769, in
the City of Anaheim, County of Orange, State of
California, as per map recorded in Book 66,
pages 45 and 46, Miscellaneous Maps, in the Of-
fice of the County Recorder of said Orange
County;
(2) Lots 1 to 94, inclusive, of Tract No. 2286, in
the City of Anaheim, County of Orange, State of
California, as per map recorded in Book 66, Pages
43 and 44 of Miscellaneous Maps, in the Office of
the County Recorder of said County.
(Said property is further described as:
Bounded on the north by the Southern California
Edison Co, right of way, on the east by South
West Street, on the south by Katella Avenue and
on the west by Walnut Street, and consists of
approximately 40 acres.)
AND WHEREAS, the City Planning Commission did hold
a public hearing at the City Hall in the City of Anaheim on
the 13th day of June, 1955, notices of which said public
hearing were duly given as required by law and the provisions
of Section 9200.17 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in
its behalf, and after due consideration of all evidence and
reports offered at said hearing, did adopt Resolution No.
184 Series 1954 -55, denying Variance No. 362 requesting
permission to construct a Major Commercial Development, for
the reasons set forth in said resolution; and
WHEREAS, thereafter, within twenty (20) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council of the City of Anaheim re-
questing a review of the action taken by said Planning Com-
mission, and said appeal was set for public hearing on June
28, 1955 at the hour of 7:00 o'clock P.M. at the City Hall in
the City of Anaheim, and notice of such public hearing was
duly given as required by law and the provisions of Section
9200.17 of the Anaheim Municipal Code; and
WH,REAS, after due investigation and studies made
by itself and in its behalf, and after due consideration of
all the evidence and reports offered at said hearing, the
City Council does find that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.

2. Such a variance is necessary for the preserva-
tion and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.
The granting of such a variance will not be
materially detrimental to the public welfare
or injurious to the property or improvements
in such vicinity and zone in which the property
is located.
That the granting of such variance will not ad-
versely affect the comprehensive general zoning
plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that a conditional zoning variance be,
and the same is hereby, gri ted to MANLEY -KUHNS CORPORA'ION,
512 NORTH LA BREA AVENUE, LOS ANGELES 36, CALIFORNIA, for the
construction and use of a Major Commercial Development on the
above described property, as requested in Application No.
362, upon the following conditions:
1. That a P -L, PARKING LANDSCAPING ZONE, approxi-
mately LSO feet in width, be established along
Walnut Street.
2. That the shopping center shall be constructed
in accordance with the specific plans submitted
to the City Council on June 28, 1955.
3. All engineering requirements of the City of
Anaheim shall be complied with, and shall be
subject to approval by the City Engineer.
4.. A reduction in the number of entrances from
Walnut Street, to be determined by the City
and the architect employed by Manley -Kuhns
Corporation.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner
or its heirs, successors or assigns to comply with the Anaheim
Municipal Code and regulations, and the conditions herein. Said
variance is granted for the term prescribed by the Anaheim
Municipal Code unless otherwise specified herein,
THE FOREGOING RESOLUTION is signed and approved by me
this 28th day of June, 1955.
