1955-2747RESOLUTION NO. 2747 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE ACTION OF THE CITY PLANNING COMMISSION GRANTING VARIANCE NO. 336 UPON THE FURTHER CONDITION THAT THERE BE A MINIMUM FLOOR AREA OF 1150 SQUARE FEET OF LIVABLE AREA IN THE DWELLINGS. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the property owners and /or agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion of the South half of Lot 20, Golden State Tract No. 2, in the City of Anaheim, as shown on a map thereof recorded in Book 4., Page 68, Misc. Maps, Records of said Orange County, described as follows: Beginning at a point on the center line of Romneya Drive, (also being the South line of said Lot 20) distant thereon 236.00 feet East of the Southwest corner of said Lot 20; thence continuing along said center line East 100.09 feet; thence North 0 45' 20" West 14.6.00 feet; thence East 35.19 feet; thence North 118.64 feet; thence West 94.00 feet; thence South 85° 071 50" West 54.55 feet; thence South 215 feet to the beginning of a curve concave Northeasterly and having a radius of 15 feet; thence along said curve through a central angle of 90° a distance of 23.56 feet; thence South 30.00 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on April 18, 1955, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 140 Series 1954 -55 recommending to the City Council of the City of Anaheim that Variance No. 336 be granted upon the conditions stated in said resolution; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim re- questing a review of the action taken by the City Planning Commission in granting said variance, and said appeal was set for hearing on May 10, 1955 at 7:00 o'clock P.M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find that: -1- 1. There are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the in- tended use of the property that do not apply generally to, the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in qz es- tion. 3. That the granting of such a variance will not be materially detrimental to the public welfare or injurious to the prop- erty or improvements in such vicinity and zone in vihich the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Variance No. 336 requesting per- mission to divide the above described parcel of land into three R -1 lots, two of which will be 60' x 113.36 with the 60 frontage on Maplewood, and the balance of the property, consisting of approximately 15,000 square feet, to remain in the original homesite, be and the same is hereby granted to CLYDE S. and JOANNA L. LEAKER, 13271 Romneya Drive, Anaheim, California, upon the conditions set forth in Resolution No. 140 Series 1954 -55 of the City Planning Commission, namely: 1. The payment of §25.00 per lot for the acquisi- tion of Park and Recreation Sites; 2. The filing of a record of survey map with the City of Anaheim and the County of Orange show- ing division of property; 3. Engineering requirements All requirements of the City of Anaheim relative to the im- provement of lots must be complied with as required by the City Engineer; and UPON THE FURTHER CONDITION that there be a minimum floor area of 1150 square feet of livable area in the dwellings. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations, and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is signed and approved by me this 10th day of May, 1955.
