A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 307.
WFIERyLAS, the City Planning Commission of the City
of Anaheim did receive a petition from the property owners
of certain real property situated in the City of Anaheim,
County of Orange, State of California, described as follows:
PARCEL 1: The easterly half of the easterly 150 feet
of the following described land situated in the County
of Orange, State of California, to wit: 'shat portion
of Lot 27, Anaheim Extension as shown on a Map of survey
made by William Hamel in 1868 and filed in the Office of
the County Recorder of Los Angeles County, California,
described as follows: Beginning at a point in the
center line of Vermont Avenue, distant thereon 162.09
feet Northeasterly from its intersection with the center
line of Palm Street; running thence Northeasterly along
said center line of Vermont Avenue, 300 feet; thence
Southeasterly parallel with the Easterly line of the
parcel of land described in Certificate of Title No.
7725, in the Office of the Registrar of Land Titles of
said Orange County, and the extensions of said line,
257 feet, thence Southwesterly parallel with the center
line of Vermont Avenue, 300 feet; thence Northwesterly
parallel with the Easterly line of the parcel of land
described in said Certificate of Title No. 7725, and
the extensions of said line, 257 feet to the point of
beginning.
EXCEPTING THEREFROM the Northwesterly portion included
in Vermont Avenue.
PARCEL 2: An undivided 1 /112ths interest in the follow-
ing: Beginning at a point in the North line of Lot 26,
Anaheim Extension, as shown on a Map of Survey made by
William Hamel and acknowledged by Alfred Robinson,
Trustee, filed in Los Angeles County, California, 287.60
feet South 79° 30? West from a cement monument at the
Northeast corner of said lot, said Northeast corner being
at the intersection of the center lines of Vermont Avenue
and Los Angeles Street, the point of beginning also being
in the center line of Vermont Avenue, running from said
point of beginning South 15° 30' East along a line paral-
lel to the Easterly line of said lot, 83 feet; thence
74 30' East along a line parallel to the Northerly line
of said lot, 25 feet; thence 15° 30' West along a line
parallel to the Easterly line of said 1ot, 25 feet;
thence 74 30' West along a line parallel to the Northerly
line of said lot, 58 feet to the center line of Vermont
Avenue; thence South 7L 30' West along said center line
10 feet to the point of beginning.
EXCEPTING THEREFROM that portion within Vermont Avenue.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said petition on April 4, 1955, notices of which said public
hearing were duly given as required by law and the provisions
of Section 9200.17 of the Anaheim Municipal Code; and

WHERLAS, said Commission, after due inspection,
investigation and studies made by itself and in its behalf
and after due consideration of all evidence and reports
offered at said hearing, did adopt its Resolution No. 125
Series 1954-55, recommending to the City Council of the
City of Anaheim that Variance No. 307 be granted upon the
condition stated in said resolution; and
���HLR:LAS, thereafter, within twenty (20) days from
the date o" the adoption of said resolution by the Planning
Commission, a written appeal was filed with the City Council
of the City of Anaheim protesting the action of the City
Planning Commission in granting said variance, but requiring
the deeding of 20 feet at the rear of subject property for
an alley, if and when the other property owners in the block
agreed to the deeding of 20 feet, whereupon the City Council
did fix the 26th day of April, 1955, at 7 :00 o'clock P.M.,
as the time and the City Council Chambers in the City Hall
as the place for a public hearing upon said variance; and
WH LEAS, after due investigation and studies made
by itself and in its behalf and after due consideration of
all the evidence and reports offered at said hearing, the
City Council does find that:
1. There are exceptional or extrao circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the pre-
servation and enjoyment of a substantial prop-
erty right possessed by other property in the
same vicinity and zone and denied to the prop-
erty in question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in
such vicinity and zone in which the property I s
located.

That the granting of such variance will not
adversely affect the comprehensive general
zoning plan.
NOW, THh,EFOR L, BE IT RESOLVED by the City Council
of the City of Anaheim that a conditional zoning variance be,
and the same is hereby granted to OSCAR AND GRACE SCHOLZ,
330 West Vermont Avenue, Anaheim, California, to erect a
multiple dwelling unit on the above described property, as
requested in Application for Variance No. 307; and that the
requirement of the City Planning Commission that 20 feet at
the rear of subject property be deeded to the City of
Anaheim for an alley, if and when the other property owners
in the block agreed to the deeding of 20 feet, be, and the
same is hereby, eliminated.

The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owners
or their heirs, successors or assigns to comply with the Anaheim
Municipal Code and regulations and the conditions herein. Said
variance is granted for the term prescribed by the Anaheim Munici-
pal Code unless otherwise specified herein.
THE FOREGOING R= SOLUTION is signed and approved by me
