A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE ISO. 303.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition from the property owner of
certain real property situated in the City of Anaheim, County
of Orange, State of California, described as follows:
Eight acres, more or less, located at the Southwest
corner of Broadway and West Streets, bounded on the
South by Santa Ana Street and on the West by State
Highway right -of -way, and more particularly described
as follows:
That portion of Lot 33 of Anaheim Extension, in the
City of Anaheim, County of Orange, State of California,
as shown on a Map of Survey made by Wm. Hamel and
filed in the Office of the County Recorder of Los
Angeles County, California, a copy of which is re-
corded in Book 3, pages 163, et seq., entitled "Los
Angeles County Maps," records of said Orange County,
described as follows:
Beginning at the center line intersection of Santa Ana
and West Streets (being, for the purposes of this
description, the Southeast corner of said Lot 33);
thence North 152 West 12.70 chains; thence South
742 West 10.35 chains to the center line of Walnut
Street; thence along the center of Walnut Street,
South 13.13 chains; thence North 74-:. p East 13.70
chains to the point of beginning.
EXCEPTING THEREFROM that portion thereof lying
Southerly of the Northerly line of the 60 -foot
strip of land described in the deed to the Southern
Pacific Railroad Company, recorded May 27, 1899 in
Book 42, page 225 of Deeds.
AT. EXCEPTING therefrom that portion of said land
included in West Broadway.
ALSO EXCEPTING therefrom that portion conveyed to the
State of California by deed recorded March 3, 1943
in Book 1166, Page 473, Official Records;
AND WHEREAS, the City Planning Commission did hold
a public hearing at the City Hall in the City of Anaheim upon
said petition on February 21, 1955, notices of which said
public hearing were duly given as required by law and the
provisions of Section 9200.17 of the Anaheim Municipal Code;
and
WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered
at said hearing, did adopt its Resolution No. 90 Series
1954 -55, recommending to the City Council of the City of
Anaheim that Variance No. 303 be granted upon the conditions
stated in said resolution; and
WHEREAS, the City Council does find that:

1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the pre-
servation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.
That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
That the granting of such variance will not ad-
versely affect the comprehensive general zoning
plan.
NOW, TIEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that a conditional zoning variance be,
and the same is hereby, granted to the WALTER H. LEIMERT
COMPANY, 4306 Crenshaw Boulevard, Los Angeles 8, California,
for subdivision of the above described property into lots
with a minimum frontage of 60 feet, but containing a mimimum
area of 8100 square feet, subject to the following conditions:
1. The filing of deed restrictions covering
the type of buildings to be erected on the
property.
2. That there will be no driveway entrances
from the front of the lots, and all entrances
to garages will be from the alleys.
3. That subject property be reclassified to
R -3, MULTIPAL FAMILY _YESIDENTIAL ZONING,
with the exception of Lots 16, 17, 24, 25,
26, 27, 28 and 29, which shall be classified
R -1, SINGLE FAMILY RESIDENTIAL ZONE.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner
or its heirs, successors or assigns to comply with the Anaheim
Municipal Code and regulations and the conditions herein. Said
variance is granted for the term prescribed by the Anaheim
Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is signed and approved by
me this 5th day of April, 1955.
