March, 1955, a notice inviting sealed proposals for the fur-
nishing to the City of Anaheim, in approximate quantities, of
the following cast iron, steel cylinder concrete, or transite
water pipe (and fittings for steel cylinder pipe only)

A RESOLUTION OF SHE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING SEA,FD PROPOSAL AND
AWARDING CONTRACT TO TEE LOWEST RESPONSIBLE
BIDDER FOR THE FURNISHING TO THE CITY OF
ANAHFTM OF REINFOR CED CONCRETE STEEL CYLINDER
PIPE AND FITTINGS (WORK ORDER NO. 1337).
14" x 14" x 10" fabricated tees, with
10" outlet adapted for flanged con-
nection (for steel cylinder pipe only).
Four 6" flanged outlets (for steel cylinder
pipe only).
AND WHEREAS, said notice did provide that said pipe
and fittings shall be in accordance with and conform to the
following specifications:
Concrete cylinder pipe shall comply with Federal
Specifications SS- P- 00381, dated April 2, 1953.
Cast iron pipe shall comply with Federal Specifica-
tions for cast iron bell and spigot pipe, Section
IV, Part 5, No. WW- P -L21, July 21, 1931.
Transite pipe shall comply with AWWA specification
No. C- 400 -53T, May 15, 1953.
Pipe shall be Class 150 for 150 pounds maximum
water working pressure.
AND WHEREAS, such notice inviting sealed proposals for
said cast iron, steel cylinder concrete, or transite water pipe
(and fittings for steel cylinder pipe only) did provide that
said sealed proposals would be received by the City Council of the
City of Anaheim at the Office of the City Clerk of said City up
to the hour of 7 :00 o'clock P.M. on Tuesday, the 5th day of
April, 1955 for the furnishing of said pipe (and fittings for
steel cylinder pipe only); and
WHEREAS, the City Clerk of the City of Anaheim did re-
ceive sealed proposals prior to 7 :00 o'clock P.M. on the 5th
day of April, 1955, for the furnishing of said cast iron, steel

AND WHEREAS, the City Council did thereupon submit
all bids received to the Superintendent of Light, Water
Power of the City of Anaheim for tabulation and report to the
City Council, and said Superintendent of Light, Water Power
having tabulated said bids and having submitted his report,
the City Council does find that the sealed proposal of the
AMERICAN PIPE AND CONSTRUCTION COMPANY, P. 0. BOX 3428 TERMINAL
ANNEX, LOS ANGELES 5L, CALIFORNIA, is the lowest responsible
bid for the furnishing of cast iron, steel cylinder concrete,
or transite water pipe (and fittings for steel cylinder pipe
only) as specified in the notice inviting sealed proposals and
in accordance with the specifications set forth in said notice
inviting sealed proposals, and that said proposal of the
American Pipe and Construction Company for furnishing reinforced
concrete steel cylinder pipe and fittings should be accepted
and a contract awarded to said company for furnishing the pipe
and fittings required by the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that said proposal submitted by the
American Pipe and Construction Company, P. 0. Box 3128 Terminal
Annex, Los Angeles 54, California for the furnishing of re-
inforced concrete steel cylinder pipe and fittings, as specified
in the notice inviting sealed proposals therefor, and in ac-
cordance with the specifications set forth in said notice in-
viting sealed proposals, for concrete cylinder pipe and fittings,
be, and the same is hereby, accepted, and that a contract for
the furnishing of said pipe and fittings be, and the same is
hereby, awarded to said American Pipe and Construction Company;
and
BE IT FURTHER RESOLVED that the award of a contract
to said American Pipe and Construction Company is declared to be
for the approximate quantities set forth in the notice inviting
sealed proposals; and
BE IT FURTHER RESOLVED that said American Pipe and
Construction Company be, and it is hereby, required to execute
a contract for the furnishing of said pipe and fittings, in
foi.m satisfactory to the City of Anaheim and upon the terms
and conditions specified in the notice inviting sealed pro-
posals, the proposal submitted by it, this resolution, and in
accordance with the specifications for reinforced concrete
steel cylinder pipe and fittings as set forth in said notice
inviting sealed proposals, in all required sizes and lengths,
at the prices as follow:

AND BE IT FURTHER RESOLVED by the City Council of the
City of Anaheim that said bid be, and the same is hereby, ac-
cepted and said contract awarded for the above spccified reinforced
concrete steel cylinder pipe and fittings, F.O.B. point of shipment,
with freight allowed to trenchside, Anaheim, California, said pipe
and fittings to be delivered as follows:

The design and layout drawings to be presented imme-
diately after receipt of plans and profile, and deliveries of
said pipe and fittings to be completed on or before the 3rd day
of May, 1955; and
BE IT FURTHER RESOLVED that said contract shall contain
a provision that should said American Pipe and Construction Com-
pany fail or neglect to furnish said concrete steel cylinder pipe
and fittings in accordance with said specifications and the pro-
posal submitted by it and accepted by the City of Anaheim within
the time herein specified, it shall, in addition to any other
penalties provided in the contract documents, be liable to the
City of Anaheim for all loss or damage that the latter may suffer
on account thereof.
THE FOREGOING RESOLUTION is signed and approved by me
this 5th day of April, 1955.
