1955-2691WHEREAS, the alteration of an existing grade crossing of a public road, highway or street with a railroad by widening the crossing or changing the elevation or alignment of the tracks is governed by General Order No. 88 of the Railroad Commission of the State of California; and WHEREAS, said General Order No. 88 provides that where public authorities, having jurisdiction over the highway involved, and the railroad corporation are in agreement as to public necessity for altering an existing crossing at grade and as to a plan of such improvement, as well as apportion- ment of cost of the same, said parties are a uthorized to make such changes in the protection of an existing grade crossing after having given the Commission notice thereof not less than 20 days in advance of the time it is planned to commence the work of such improvement; and WHEREAS, the Southern Pacific Railroad Company, a Corporation of the States of California, Arizona and New Mexico, and its lessee, Southern Pacific Company, a corporation of the State of Delaware, have tendered to the City of Anaheim and said City has accepted, a Street or Highway Indenture granting to the City of Anaheim the right to construct, reconstruct, maintain and use a street or highway upon and across the following described real property, subject to the reservations, covenants and conditions in said Street or Highway Indenture: and, RESOLUTION NO. 2691 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING AND DIRECTING THE CITY ENGINEER OF TEE CITY OF ANAHEIM TO GIVE NOTICE TO THE RAILROAD COMMISSION OF THE STATE OF CALIFORNIA OF INTENTION TO WIDEN AND IMPROVE THE ELLSWORTH AVENUE CROSSING OVER THE LINE OF THE SOUTHERN PACIFIC RAILROAD COMPANY. A piece or parcel of land situated in the City of Anaheim, County of Orange, State of California, being all that certain portion of Vineyard Lot G as shown on a map recorded in Book 4, Pages 629 and 630 of Deeds, Records of Los Angeles County, California, more particularly described as follows, to -wit: BEGINNING at the southeasterly corner of Lot 49, Mother Colony Square, Tract No. 497, as shown on a Map thereof recorded in Book 17, Page 38, Miscellaneous Maps, Records of said Orange County; thence North 74° 24 East along the easterly prolongation of the northerly line of Ellsworth Avenue (58 feet wide) a distance of 140.15 feet to a point in the westerly line of South Olive Street (69.5 feet wide); thence South 15° 30 East, along said westerly line of South Olive Street, 58 feet to a point which bears South 74 24 West, 34.75 feet from a point on the monumented center line of said South Olive Street, said latter point being distant Northerly 280.89 feet along said center line of South Olive Street from its intersection with the monumented center line of East Water Street; thence South 74 24' West along the easterly prolongation of the southerly line of said Ellsworth Avenue, a distance of 140.12 feet to the northeasterly corner of Lot 22 of said Mother Colony Square; thence North 15 31 30" West along the easterly boundary of said Mother Colony Square, a distance of 58 feet to the point of begin- ning, containing an area of 0.187 of an acre, more or less. WHEREAS, Ellsworth Avenue, a public street under the juris- diction of the City of Anaheim, is an existing crossing at grade over the Southern Pacific track as above described. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the City Engineer be, and he is hereby authorized and directed to give notice to the Railroad Commission of the State of California of the Cityts intention to widen and improve the Ellsworth Avenue crossing over the line of the Southern Pacific Railroad Company, as hereinabove described, pursuant to General Order No. 88 of the said Railroad Commission, which notice shall include the following required information and data: (a) The assigned number of the crossing proposed to be altered. (b) A statement showing the public benefit to be obtained by the proposed alteration. (c) A statement showing why a separation of grades is not practicable under the circumstances. (d) A statement indicating the existing and proposed signs, signals or other protection provided or to be provided at the crossing proposed to be widened. (e) A map of the immediate vicinity of the crossing proposed to be altered, on a scale of from 50 to 200 feet per inch, showing the locations of streets and roads, property lines, tracks and buildings and other obstructions to the view of the crossing proposed to be altered, the present character of surface or pavement and width of same, on the street or road adjacent to the crossing, and the nature of the proposed improvement. (f) A profile showing the ground line and the present and proposed grade lines. (g) Evidence of agreement between the parties relative to the proposed alteration.
