A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING A REFUND OF MONEY
`DEPOSITED BY ANAHEIM GARDEN HOMES AS
FOR THE CONSTRUCTION AND INSTALLATION OF
WATER LINES OUTSIDE OF TRACT NO. 2121.
WHEREAS, Anaheim Garden Homes, a copartnership com-
prised of George L. Mallery Co., Inc., Neal F. Harte, Frances
A. Harte and Alethea Koehler, the owners and subdividers of
Tract No. 2121, did on or about the 26th day of August
1954, deposit with the City of Anaheim the sum of One Thousand
Four Hundred Dollars (1,Ij00) to cover the material cost of
the construction and installation of water mains and lines ex-
tending along Romneya Drive from the existing City water mains
to said Tract No. 2121; and
WHEREAS, it was understood and agreed by and be-
tween said copartnership and the City of Anaheim that said
sum of One Thousand Four Hundred Dollars ($1,100) would be re-
turned to said Anaheim Garden Homes when the adjoining area
developed so that the City of Anaheim would receive reimburse-
ment for the cost of said material from adjoining properties;
an d
WHEREAS, said adjoining properties have been and
are being rapidly developed and the City of Anaheim is assured
of receiving reimbursement for the material cost of said water
mains and lines, and said sum of One Thousand Four Hundred
Dollars (41,400) should be returned to said Anaheim Garden
Homes.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the sum of One Thousand Four Hundred
Dollars ($1,400), deposited with the City of Anaheim by Anaheim
Garden Homes, the copartnership above described, be, and the
same is hereby refunded to said Anaheim Garden Homes; and that
the City Auditor be, and she is hereby authorized and directed
to issue a warrant for the refund of said money as herein
directed.
THE FOREGOING RESOLUTION is signed and approved by me
this 15th day of March, 1955.
