A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM CONSENTING TO AN .EXTENSION
OF TINE WITHIN WHICH AN ACTION MAYBE
BROUGHT UPON BOND NO. 4455473 EXECUTED BY
PAUL VUKICH CONSTRUCTION COMPANY AND THE
TRAVELERS INDEMNITY COMPANY.
W EREAS heretofore, to wit, on or about the 27th
day of April, 1954, the City Council did adopt Resolution
No. 2401 awarding a contract to Paul Vukich Construction
Company for the construction of the following public im-
provement, to wit:
The Raymond Romneya Sewer Improvement, con-
sisting of the construction of V.C.P. sewer
laterals, size as indicated on the plans,
including excavation, manhole construction,
4 -inch V.C.P. wye branches, resurfacing, and
appurtenant work, Job No. 1005;
AND WHEREAS, the City of Anaheim did thereafter,
to wit, on the 28th day of April, 1954, make and enter into
an agreement with said Paul Vukich Construction Company for
the construction of said public improvement in accordance
with the design, plans, profiles, drawings and /or specifica-
tions prepared by George E. Holyoke, City Engineer; and
WHEREAS, as required by the notice inviting sealed
proposals for the construction of said public improvement and
the terms of the agreement aforesaid, a labor and material
bond, numbered 455473, was duly executed and delivered to the
City of Anaheim by Paul Vukich Construction Company as
principal and The Travelers Indemnity Company as surety, in
the amount of $42,933.00; and
WHEREAS, notice of completion of said public im-
provement was filed by the City of Anaheim on the 17th day
of August, 195L in the Office of the County Recorder of Orange
County, California and recorded in Book 2794, Page 370; an d
WHEREAS, it is provided by statute that suit against
the surety on said contractorts bond may be brought by any
claimant, or his assign, at any time, if the claimant has
ceased to perform labor or furnish material or both, and un-
til the expiration of six (6) months after the period in which
verified claims may be filed, as provided in Section 1184e of
the Code of Civil Procedure; and
WHEREAS, it is the mutual desire of the principal
and surety named in said bond and the City to extend the time
within which such suits may be couunenced;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that consent be, and the same is hereby,
given and granted to the extension for a period of sixty (60)
days, of the time within which suit may be commenced by any
claimantsor assigns upon the above mentioned bond; provided,
however, that the principal and surety shall not be exonerated,

discharged or relieved of liability upon said bond for and
during the extension of time within which suits may be com-
menced upon said bond by claimants or their assigns, as
provided by law, as a result of the extension of said period
of limitation.
THE FOREGOING RESOLUTION is signed and approved
by me this 8th day of March, 1955.
