A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANLH,EIM AUTHORIZING
THE SALE OF CERTAIN CAPACITY RIGHTS IN THE MAGNOLIA
TRUNK SEWER AND PUMPING PLANT AND FORCE MAIN TO STANTON
COUNTY WATER DISTRICT, FIXING THE PRICE AND CONDITIONS
OF SALE AND AUTHORIZING THE CITY OF ANAHEIM, AS CONTRACT-
ING AGENT FOR THE CITIES AND SANITARY DISTRICTS HEREINAFTER
NAMED, TO EXECUTE A CONTRACT FOR AND ON BEHALF OF SAID
CITIES AND SANITARY DISTRICTS FOR THE SALE OF SAID CAPACITY
RIGHTS.
WHEREAS, the Cities of Anaheim, Fullerton, Orange, and Buena Park, and
the Garden Grove, La Habra, and Placentia Sanitary Districts, hereinafter referred
to as Sellers, and each of them, are owners of certain undivided fractional interests
in certain portions or sections of the Magnolia Trunk Sewer generally described and
commonly known as Section A, Section B, Section C, Section D, Section E and
Section E', and the Force Main and Pumping Plant, all of which said property is
located in the County of Orange, State of California, and more particularly de-
scribed as follows:
Section A: The 78" sewer main on Bushard Street from the
pumping plant at Ellis Avenue to and including
the manhole at Talbert Avenue.
Section B:
Section C:
Section D:
Section E
Section E':
The 48" sewer main on Bushard Street from the
manhole at Talbert Avenue to and including the
manhole at Slater Avenue.
The 48" sewer main on Bushard Street from the
manhole at Slater Avenue to Smeltzer Avenue,
thence on Smeltzer Avenue to Cannery Street,
thence on Cannery Street to and including the
manhole on Bolsa Avenue.
The 48" sewer main on Cannery Street from
Bolsa Avenue to Westminster Avenue.
'The 42" sewer main on Cannery Street from
Westminster Avenue to Garden Grove Boulevard,
along Garden Grove Boulevard from Cannery
Street to Magnolia Avenue; thence on Magnolia
Avenue from Garden Grove Boulevard to 1310
feet north of Lampson Avenue.
The 39" sewer main on Magnolia Avenue from
1310 feet north of Lampson Avenue to Katella
Avenue.
Force Main and Pumping Plant: The pumping plant at Ellis
and Bushard Streets and the 18" sewer force
main on Ellis Avenue and Bushard Street to
the existing grit chamber southerly of Ellis
Avenue at the County Sanitation Districts of
Orange County Treatment Plant No. 1.
and
WHEREAS, said Sellers at the present time are jointly operating said
Magnolia Trunk Sewer for the purpose of collecting and disposing of sewage arising
in their respective areas, and
WHEREAS, Stanton County Water District, hereinafter referred to as Buyer,
desires to purchase and Sellers are willing to sell to said Stanton County Water
District capacity and capacity rights in those portions of the Magnolia Trunk Sewer
and Pumping Plant and Force Main hereinabove described from the contingent capacity
rights allotted to the following described territory in contingent area No. 4:
Beginning at the intersection of the center line of
Miller Street with the Westerly prolongation of the center
line of Broadway, said point of intersection being the
Northwest corner of the South one -half of the North one-
half of Section 15, Range 11 West, Township 4 South,
S.B.B. &M. and running thence Easterly along said extended
center line of Broadway to the intersection of said center
line of Broadway with the center line of Date Street;
thence continuing Easterly along said center line of
Broadway 1328 feet more or less to an intersection with
the East line of the Southern California Edison Company
right of way; thence Southerly along said East line to
an intersection with the center line of Bryant Avenue
also known as Orangewood Avenue; thence Westerly along
said center line of Bryant Avenue to an intersection
with the Southerly extension of said center line at
Miller Street, last mentioned point of intersection
being the Westerly one quarter corner of Section 27 of
said Township and Range; thence Northerly along said
Southerly extension of the center line of Miller Street
and the center line of Miller Street to the point of
beginning.
in the amounts hereinafter set forth in Exhibit A hereto attached so as to enable
the Buyer to discharge into said portions of said Magnolia Trunk Sewer and Pumping
Plant and Force Main sewage collected within the boundaries of the above described
territory, at the prices and at the time and upon the terms herein stated, and
said Buyer is willing to purchase said capacity and capacity rights in the above
described portions of the Magnolia Trunk Sewer and Pumping Plant and Force Main
at the prices and upon said terms and conditions, and
WHEREAS, the City Council
of the City of Anaheim
does hereby find and determine that the above mentioned amounts of capacity
and capacity rights in the above mentioned sections of said Magnolia Trunk Sewer

Fnd Pumping Plant and Force Mainffr said contingent area No. 4 are not now needed
by the Sellers for present use or for any foreseeable or anticipated use, and that
it would be to the advantage of the Sellers to sell the capacity rights in said
sections of said Magnolia Trunk Sewer and Pumping Plant and Force Main to said
Stanton County Water District as hereinafter more particularly set forth, and thus
obtain a partial reimbursement of the cost of the construction thereof;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim
that the sale of the capacity and capacity
rights in Sections A, B, C, D, E" and Et of the Magnolia Trunk Sewer and in the
Pumping Plant and Force Main, in the amounts and for the prices as shown on "Exhibit
A" hereto attached and made a part hereof, to the Stanton County Water District of
Orange County, California be, and the same is hereby, approved and authorized for the
price and upon the terms and conditions as set forth in the agreement hereto at-
tached and made a part hereof.
AND BE IT FURTHER RESOLVED that the participation capacity rights in the
over -all remaining contingent capacity hereby authorized to be sold to said Stanton
County Water District, as shown on said "Exhibit A," shall not entitle said Stanton
County Water District to the use of said participation capacity rights for the
discharge of sewage into said Magnolia Trunk Sewer and Pumping Plant and Force
Main.
AND BE IT FURTHER RESOLVED that the City of Anaheim, as contracting
agent for the Cities and Sanitary Districts hereinabove mentioned, be and it is
hereby, authorized to make and enter into an agreement in the form hereto attached
with Stanton County Water District of Orange County, California, for the sale of
the capacity and capacity rights in said Sections A, B, C, D, E" and El, and the
Force Main of the Magnolia Trunk Sewer and Pumping Plant and Force Main hereinabove
described, for the price and upon the terms and conditions as set forth in said
agreement hereto attached and made a part hereof.
THE FOREGOING RESOLUTION is signed and approved by me this 7th
day of December 1954.

of the City of Anaheim that all cast iron
fittings hereinafter hereinafter specified shall conform to the specila--
cations therefor prepared by the Superintendent of the Light,
Water and Power Department of the City of Anaheim and herein-
above approved; and
BE IT FIHTHEh RESOLVED that there shall be purchased
for the Water Department of the City of Anaheim cast iron pipe
and fittings in the following, approximate quantities, and of
the following sizes and descriptions:
AND BE IT FURTHER RLSOLVED that the City Clerk be,
and she is hereby, authorized and directed to publish a notice
in the Anaheim Bulletin, in the manner and form as required by
law, inviting sealed proposals for the furnishing of said pipe
and fittings above described, and notifying all prospective
bidders that said sealed proposals will be received at the
Office of the City Clerk in the City of Anaheim not later than
8:00 o'clock P.M. on the 28th day of December, 1954: and
BE IT FURTHER RESOLVED that said notice shall be
published on the 10th and 17th days of December, 1954.
THE FORTING RESOLUTION is signed and approved by
