A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING A SEALED PROPOSAL AND
AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE
BIDDER FOR THE FURNISHING OF LIQUID CHLORINE
TO THE ORANGE COUNTY JOINT OUTFALL SEWER.
WHEREAS, the City Council of the City of Anaheim
as contracting agent for the Orange County Joint Outfall
Sewer did cause to be published in a newspaper of general
circulation, printed, published and circulated in the City
of Anaheim, to wit: The Anaheim Bulletin, on the 15th and
21st days of July, 1954, a notice inviting sealed proposals
for the furnishing to the Orange County Joint Outfall Sewer
of the following approximate quantities of liquid chlorine:
An estimated quantity of 400,000 to 600,000
pounds of liquid chlorine of commercial
quality, supplied in containers of 2,000
pound capacity, net weight. Shipment of full
cylinders and return of empty cylinders to be
prepaid by the bidder to any location re-
quested by the buyer, a list of which loca-
tions and past usage of chlorine is available
at the Office of the Orange County Joint
Outfall Sewer in the City Hall, Anaheim,
California.
AND WHEREAS, said notice did provide that all bidders
were requested to visit all of the sites to be supplied and to
arrange for inspection of bidder's facilities by buyer; and
WHEREAS, said notice did further provide that the
contract to be awarded shall be for a period of one (1) year
from date of award of said contract, and all deliveries of
chlorine shall be in accordance with specifications therefor
on file in the Office of the City Clerk of the City of Anaheim
and the Office of the Orange County Joint Outfall Sewer in
the City Hall, Anaheim, California; and
WHEREAS, such notice inviting sealed proposals for
said liquid chlorine did provide that said sealed proposals
would be received by the City Council of the City of Anaheim,
as contracting agent for the Orange County Joint Outfall
Sewer, at the Office of the City Clerk of said City up to the
hour of 8 :00 o'clock P.M. of Tuesday, July 27, 1954 for the
furnishing to said Orange County Joint Outfall Sewer of said
liquid chlorine; and
WHEREAS, the City Clerk of the City of Anaheim did
receive sealed proposals rior to 8 :00 o'clock P.M., Tuesday,
the 27th day of July, 1954 for the furnishing of said liquid
chlorine from the following persons, firms or corporations:

FREE USE PERIOD
Buyers of Chlorine in containers of 2000 pound capacity
net weight are entitled to 30 days' free use of containers,
after which a rental charge of $8.50 per month or fraction
thereof shall be assessed. The $8.50 per month rental
will be prorated on the basis of 00.274 per day. Rentals
billed and paid are non refundable.
Should cylinders be returned in less than 30 days, buyer will
accrue free use time credit in the following manner. When
a container is shipped, a 30 -day credit is set up on buyer's
container account. When that container is returned the ac-
count is charged for the number of days which that container
has been outstanding.

At the end of each month the container account is totaled:
A. If buyer's container account has a credit
balance of days for free use time not
utilized, that cerdit balance will be ap-
plied to the next month's container account.
However, this credit balance will expire
if not used during the succeeding 90 days.
B. If buyer's container account has a debit balance
of days, a charge will be made at the rate of
0.274 per day, unless the total of such charges
amount to less than 2.00.
REPLACEMENT COSTS OF TON CONTAINERS.
Containers of 2000 pound capacity, net weight, lost or
damaged beyond repair, will be invoiced at the follow-
ing rate:
2000 pound container 4325.00 each.
AND WHEREAS, the City Council did thereupon refer
said bids to the City Engineer for examination, tabulation and
report to the City Council, and said City Engineer having
examined and tabulated said bids and having submitted his re-
port, the City Council does find that the sealed proposal sub-
mitted by JOHN WILEY JONES CO., INC., 1904 Border Avenue,
Torrance, California is the lowest responsible bid for the
furnishing of liquid chlorine as specified in the notice in-
viting sealed proposals and in accordance with the specifica-
tions therefor on file in the Office of the City Clerk of the
City of Anaheim and the Office of the Orange County Joint
Outfall Sewer, Anaheim, California, and that said proposal of
John Wiley Jones Co., Inc. should be accepted and a contract
awarded to said company for furnishing said liquid chlorine.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim, as contracting agent for the Orange
County Joint Outfall Sewer, that said proposal submitted by
John Wiley Jones Co., Inc. for the furnishing of liquid
chlorine as specified in the notice inviting sealed proposals
and in accordance with the specifications therefor on file in
the Office of the City Clerk of the City of Anaheim and the
Office of the Orange County Joint Outfall Sewer, Anaheim,
California, be, and the same is, hereby accepted, and that a
contract for the furnishing of said liquid chlorine be, and
the same is, hereby awarded to said John Wiley Jones Co. Inc.;
and
BE IT FURTHER RESOLVED that the award of said con-
tract to said John Wiley Jones Co., Inc. is declared to be
for approximate quantities as set forth in the notice inviting
sealed proposals; and
BE IT FURTHER RESOLVED that the successful bidder be,
and it is hereby, required to execute a contract in the re-
quired form satisfactory to the City of Anaheim, and upon the
terms and conditions specified in the notice inviting sealed
proposals and the proposal submitted by it, and in accordance
with the specifications for liquid chlorine on file in the
Office of the City Clerk of the City of Anaheim and the Office
of the Orange County Joint Outfall Sewer, Anaheim, California;
and

BE IT FURTHER RESOLVED that said bid be, and the
same is hereby, accepted for delivery of said liquid chlorine
at the times and locations as specified by the Manager of the
Orange County Joint Outfall Sewer; and
BE IT FURTHER RESOLVED that the successful bidder
be and it is hereby required to furnish, within ten days
after the award of the contract, a surety bond payable to the
City of Anaheim, and subject to the approval of the City
Council, in an amount not .less,than 50% of the aggregate
amount of said contract, which bond shall be conditioned upon
the faithful performance of said .contract; and
BE IT FURTHER RESOLVED ,that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, authorized
and directed to execute for and on behalf of the City of
Anaheim, as purchasing agent for the Orange County Joint Out
fall Sewer, with John Wiley Jones Co., Inc., a written con-
tract for the furnishing of said liquid chlorine in accordance
with the specifications therefor, the notice inviting sealed
proposals, the terms of this Resolution and the contract
approved by the City Attorney of the City of Anaheim; and
BE IT FURTHER RESOLVED that the term of said contract
shall be for a period of one year from date of award thereof.
THE FOEEGOING RESOLUTION is approved and signed by
me this lOth day of August, 1954.
