56R-3180 RESOLUTION NO. 3180 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE .",...- . WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning varianoe from the prop- erty owner and/or agent of certain real prop- erty situated in the City of Anaheim, County of Orange, State of California>> described as follows: The North 125 feet of the South 316.5 feet of Lot 5, Block B of Tract 110. 13, City of Anaheim. (Said property is located at 9432 Brookhur.t Street, Anaheim, California) AND WHEREAS, the City Planning Commission did hold a pub- lic h~aripg at toe City Hall in the City of Anaheim upon said peti- tion on March 5, 1956, notices of whioh said publio he_ring were duly given as required by law and the provisions of Seotion 9200.17 of the Anaheim Municipal Code; and WHEREAS>> said Commission, after due inspeotion, investiga- tion and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 143 >>reoommending to the City Ooun- cil of the City of Anaheim that Variance No. 509 be granted upon the conditions stated in said resolution; and WHEREAS>> the City Counoil does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vioinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. /,.-. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the oomprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to Chas. E. Drummond, Inc., 9432 Brookhurst, An~eim, California, -1- to alter the present residential dwelling on the property hereinabove described to permit the establishment of a dental office and the practice of dentistry upon the following conditions: ' .- 1. That the owner or owners of subject property deed to the CitY" of Anaheim a strip of land 20 feet in depth along Brookhurst Street for street widening purposes. -- . 2. The installation of street improvements, curbs, gutters, sidewalks, etc., as required by the City Engineer. 3. That subject varianoe is granted for a period of two years from date thereof. The City Counoil hereby reserves the right to revoke such varianoe permit for good cause or failure of said owner~~~~~ .Tf f successors or assigns, to comply with the Anaheim unioipal Cole and regulations and the conditions herein.
