A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE PUBLIC UTILITIES
GENERAL MANAGER TO SERVE AS ANAHEIM'S
AUTHORIZED REPRESENTATIVE IN SEEKING FINANCIAL
ASSISTANCE FOR CITY OF ANAHEIM WELLS 39 AND 47
PFAS TREATMENT SYSTEMS ("GROUNDWATER
TREATMENT PLANTS, PHASE C-2") AND, IF AWARDED,
AUTHORIZING THE ACCEPTANCE OF SUCH FINANCIAL
ASSISTANCE ON BEHALF OF THE CITY AND AMENDING
THE BUDGET FOR THE APPLICABLE FISCAL YEARS
ACCORDINGLY.
WHEREAS, the City of Anaheim ("City") wishes to submit an application to the California
State Water Resources Control Board ("SWRCB") for Drinking Water State Revolving Fund
Financial Assistance ("Financial Assistance") to fund groundwater treatment facilities;
WHEREAS, the SWRCB application requires a Certified Resolution of the Anaheim City
Council (1) authorizing submittal of the Financial Assistance application, (2) designating an
Authorized Representative who is authorized and directed to sign an agreement establishing the
terms of the Financial Assistance, and (3) authorizing the Authorized Representative to take
actions required to receive and accept Financial Assistance;
WHEREAS, the City is familiar with the terms, conditions and limitations of SWRCB's
agreement required for the Financial Assistance and is willing and able to conform to them; and
WHEREAS, the City desires to accept any such Financial Assistance that may be awarded
to the City; and
WHEREAS, the City desires to amend the annual budget of the City as required to reflect
and incorporate any Financial Assistance so awarded to the City and to increase the annual
appropriations and expenditures in the appropriate City program to reflect such award.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as
follows:
1. The Public Utilities General Manager ("Authorized Representative") or designee is
hereby authorized and directed to sign and file, for and on behalf of the City of
Anaheim ("City"), a Financial Assistance Application for a financing agreement
with the State Water Resources Control Board for the planning, design, and
construction of City of Anaheim Wells 39 and 47 PFAS Treatment Systems (the
"Project," also referred to as ."Phase C-2").
2. The Authorized Representative, or designee, is designated to provide the
assurances, certifications, and commitments required for the Financial Assistance
Application, including executing a financial assistance agreement from the State
Water Resources Control Board and any amendments or changes thereto.
3. The Authorized Representative, or Designee, is designated to represent the City in
carrying out the City's responsibilities under the financing agreement, including
certifying disbursement requests on behalf of the City and compliance with
applicable state and federal laws.
4. The City Council hereby agrees to accept, and by this Resolution does accept, any
Financial Assistance awarded to the City without the need for further action by the
City Council.
Contingent upon the award and receipt of Financial Assistance, the annual budgets
of the City of Anaheim for the applicable fiscal year(s) are hereby amended by
increasing the expense and/or revenue appropriations as needed in an amount equal
to the amount of Financial Assistance received by the City.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 4 day of November, 2025 by the following roll -call vote:
AYES: Mayor Aitken and Council Members Meeks, Balius,
Leon, Rubalcava, Kurtz and Maahs
