A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE RETURN
TO JOHN J. DWYER AND LERA M. DWYER OF
AGREEMENT AND DEED TO CERTAIN REAL PROP—
ERTY SITUATED IN THE CITY OF ANAHEIM.
WHEREAS, John J. Dwyer and Lera M. Dwyer, husband
and wife, of Anaheim, California are the owners of all that
certain real property and premises commonly known and re—
ferred to as "The Old Barn," and "The Old Distillery," and
"The Old Horstman Home," situated on West Street in the City
of Anaheim, occupying an area of land with a. frontage of
138.99 feet on West Street and extending to a depth of 166.25
feet, and more particularly hereinafter described; and
WHEREAS, said John J. Dwyer and Lera Y. Dwyer have
heretofore tendered to the City of Anaheim a deed conveying
said property to the City of Anaheim to be maintained as a
museum and /or historical monument, and have tendered to the
City of Anaheim an agreement relating to said property; and
WHEREAS, said John J. Dwyer and Lera M. Dwyer have
requested that said deed and agreement be returned to them,
and have requested that they be permitted to withdraw their
offer to convey said property to the City of Anaheim to be
maintained as a museum and /or an historical monument; and
WHEREAS, said John J. Dryer has contributed to the
City the sum of Ten Thousand (610,000.00) Dollars to be used
by the City for the preservation and maintenance of the
Mother Colony House located on North West Street, adjoining
the property of said John J. Dwyer; and
WHEREAS, the City Council finds that it would be
to the advantage and for the best interest of the City of
Anaheim and the said John J. Dwyer and Lera M. Dwyer to ac—
cept said Ten Thousand (1O.0OC.cc) Dollars in lieu of the
conveyance of said property hereinafter described, and to
permit the withdrawal of said offer to convey said. property
to the City of Anaheim.

Dollars tendered to the City of Anaheim by John J. Dwyer to
be used for the preservation and maintenance for posterity of
the Mother Colony House located on North West Street in the
City of Anaheim, be, and the same is hereby, accepted; and that
the said John J. Dwyer and Lera M. Dwyer be, and they are here—
by, authorized to withdraw their offer to convey the property
hereinafter described to the City of ..ahem, to be maintained
as a museum and /or historical monument, and the City Clerk is
authorized and directed to return to said John J. Dwyer and
Lera. 11. Dwyer the deed and agreement heretofore executed by
them and tendered to the City of Anaheim.

`Jan 'wagoner.
NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: None.
AND I FURTHER CERTIFY that the Mayor of the City of Anaheim
