A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE MAYOR
AND CITY CLERK TO ENTER INTO AN AGREEMENT
WITH THE SOUTHERN PACIFIC COMPANY GRANT-
ING TO THE CITY A LICENSE TO CONSTRUCT,
RECONSTRUCT, MAINTAIN AND OPERATE AN
18 -INCH CONCRETE WATER PIPE LINE BENEATH
THE RAILROAD RIGHT -OF -SWAY OF THE SOUTHERN
PACIFIC COMPANY AT ES- 977,81.
WHEREAS, the City of Anaheim is constructing an
16 -inch steel cylinder concrete water line along West La
Palma Avenue from Palm Street in the City of Anaheim to
Magnolia Avenue, under Work Order No. 1261; and
�h PL A6, it is necessary to obtain a license and
a permit from the Southern Pacific Company, a corporation,
to construct said water line beneath the railroad and
right-of-way of said Southern Pacific Company's main line
tract at Engineer Station 97781; and
WHEREAS, the Southern Pacific Company has offered
to enter into an agreement granting to the City of Anaheim
a permit and a license to construct said water pipe line
at said point beneath said Coaipanyts main line track at said
Engineer Station 977 ,L81, provided said pipe line is not less
than three (3) feet below the base of ties in said Company's
main line track at said point; and
WHEREAS, the City Council does find and determine
that said licence and permit are necessary and that said
agreement should be made and entered into with said Southern
Pacific Company,
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that that certain agreement dated
October 5, 1953, to be made and entered into by and between
the Southern Pacific Company, a corporation, and the City of
Anaheim, granting to the City of Anaheim a license and permit
to construct, reconstruct, maintain and operate an 18 -inch
concrete pipe encased in 130 feet of 24 -inch smooth steel
pipe with wall thickness of 1/4 -inch, thoroughly coated in-
side and out with preservative, from a point in said Company's
easterly right-of-way line to a point in the westerly right
of -way line and crossing, not less than three (3) feet below
base of ties in said Company's main line track at Engineer
Station 97781, be and the same is hereby approved and the
Mayor and City Clerk be, and they are hereby, authorized and
directed to execute said agreement for and on behalf of the
City of Anaheim.
THE FOREGOING RESOLUTION is signed and approved by
me this 27th day of October, 1953.
