A RESOLUTION OF THE CITY UOuNCIL OF Ti-
CITY OF ANAHEIM, CALIFORNIA AUTHORIZING
SALE OF CERTAIN REAL PROPERTY AND AUTH.OR-
IZING TEE EXECUTION OF A CONVEYANCE
THEREOF.
WHEREAS, the City of Anaheim is the owner of the
hereinafter described real property; and
WHEREAS, said real property is no longer needed
for municipal purposes; and
WHEREAS, Essex Wire Corporation has offered to
purchase said real property for the sum of 7,722.00
cash, lawful money of the United States, and which said
purchase price shall be paid into escrow at the Bank of
America, National Trust and Savings Association, Anaheim
Branch, to be paid to the City at the close of escrow; and
WHEREAS, the City Council finds that it is for
the benefit and best interest of the City of Anaheim to
accept said offer and sell and convey said real property
to said Essex Wire Corporation upon the terms and conditions
hereinafter specified;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the offer of Essex Wire Corpora-
tion to purchase the hereinafter described real property for
the sum of 7,722.00 cash, lawful money of the
United States of America, be accepted upon the following
terms and conditions;
1. 7,722.00 cash to be placed in escrow
with the Bank of America, National Trust and Savings Associa-
tion, Anaheim Branch, Anaheim, California, to be paid to the
City at the close of escrow, said escrow to be complied with
on or before August 25, 1953, or as soon thereafter as pos-
sible unless a written demand for return of money or instru-
ments by a party to said escrow is delivered to said escrow
holder subsequent to such date and prior to the recording of
any instruments provided for in said escrow.
2. That said property shall be sold subject to
covenants, conditions, restrictions, reservations, rights,
rights of way and easements of record or in deed executed
and delivered by the City to said purchaser.
3. That the materials of the City stored on said
property will be removed at the expense of Essex Wire Corpora-
tion if the moving is required prior to the time that such
materials would normally be used by the City of Anaheim.
4. That Essex Wire Corporation will fence with the
same type of fencing the new storage area on property owned by
the City required to replace the storage area now located upon
the property being sold to said Essex Wire Corporation.
5. That said property is sold upon the understand-
ing that it is to be used for industrial purposes; and
BE IT FURTHER RESOLVED that the City of Anaheim
does hereby grant to said Essex Wire Corporation an option to
purchase, at the price of Six Thousand Dollars (06,000.00)
per acre, all of the remaining property owned by the City
lying North of the South Line of Lots 23 and 24 of the
Gresswell Subdivision, and lying between the West Line of
the property hereinafter described and the West Line of
Patt Street as proposed. for widening to a 60 -foot width,
excepting therefrom a parcel 75 ft. X 75 ft. at the most
Southeasterly corner of said property and now used as an
electrical substation. Said option is given and granted
upon the understanding and condition that the City does
not use or require said property for flood control purposes.
Said option shall be for a term of ten (10) ___years; and
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, author-
ized to execute a good and sufficient deed conveying to said
Essex Wire Corporation, a corporation, the following de-
scribed real property situated in the City of Anaheim, County
of Orange, State of California, and more particularly de-
scribed as follows:
A tract of land situated in the City of Anaheim,
County of Orange, State of California, being a portion
of the SE 1/4 of the SW 1/4 of Section 3, Township
4 South, Range 10 West, San Bernardino Base and
Meridian and more particularly described as follows:
Beginning at a point on the west property line'
of Patt Street, which point is N0 °02 W a distance of
113.25 feet from the northeast corner of Lot 24,
Gresswell Subdivision, as shown on a map thereof re-
corded in Book 6, Page 47, Miscellaneous Maps, Records
of Orange County, California; said point also being
the northeast corner of land of Grantor; thence west
242.40 feet to a point; thence N 23 °451 E a distance
of 10.93 feet to a point; thence N 22 0 46 *56" E a
distance of 54.23 feet to a point; thence West 7.32
feet to a point; thence N0 °02tEa distance of 167.34
feet to a point; said point hereafter referred to as
point "A thence S 89057* W along the center line of an
eight inch brick party wall and said center line ex-
tended a distance of 66.57 feet to a point; thence
N0 °15; W 12.0 feet to a point; thence S 89 °59* W a
distance of 52.48 feet to the extreme northwest cor-
ner of the land of Grantor; thence S0 0 01* E 352.51
feet to a point of intersection with the westerly
extension of the north line of Lot 23 of the Gresswell
Subdivision; thence East along the north line of said
Lot 23 and its westerly extension a distance 194.14
feet to the northeast corner of saidLot; thence
N 45 °00* E 84.84 feet to a point; thence East 89.14
feet more or less to the westerly property line of
Patt Street; thence NO 0 02* W along the westerly
property line of Patt Street a distance of 13.25 feet
note or less to the point of beginning.
Except therefrom the following described property:
PARCEL I
Beginning at Point "A" as described above thence
S 89 °57 W along the easterly extension of the center
line of an eight inch brick party wall a distance of
20.67 feet to the east line of an existing brick
building to the true point of beginning; thence S0 °02
a distance of 50.28 feet; thence 889 °57 a distance
of 54.90 feet; thence NO °02 a distance of 23.0 feet;
thence N45 °02 a distance of 4.24 feet; thence N89 °57
a distance of 6.0 feet; thence NO °02 a distance of
24.28 feet to a point on the center line of an eight
inch brick party wall; thence N89 along the center
line of said brick party wall a distance of 45.90 feet
to the true point of beginning.
PARCEL 2
The easterly 10 feet of the parcel of property first
hereinabove described along Patt Street for street widen-
ing purposes.
SUBJECT TO:
An easement for ingress and egress to the City
Pumping Plant and for public utilities and the maintenance
thereof under, over and across the following described
portion of said property:
Beginning at a Point on the westerly extension of
the north line of Lot 23 of the Gresswell Subdivision
said Point being 14 feet West of the northwest corner
of said Lot 23; thence NO °Ol a distance of 265.23
feet to a point; thence N89 °57 52.38 feet to a Point;
thence N0 °02 a distance of 25.00 feet to a point;
thence S89 °57 a distance of 54.90 feet to a point;
thence NO a distance of 11.50 feet to a point;
thence S89 °5941 a distance of 43.48 feet more or less
to a point on the west line of property of said Grantor;
thence $0 °01 along said west line a distance of 36.50
feet to a point; thence N89 °59 a distance of 25.00
feet to a point thence S0 °01 a distance of 265.23 feet
to a point on the westerly extension of the north line
of said Lot 23 of the Gresswell Subdivision; thence
East along the north line of said Lot 23 extended a
distance of 21.0 feet to the point of beginning.
Also excepting and reserving to the Grantor its
successors and assigns the perpetual right to use in
common with the grantee and its successors in interest
the railroad spur, siding or service track now exist-
ing on the land hereby conveyed and connected with
the line of the Santa Fe Railroad Company together
with a perpetual right -of -way for such siding or track
and a perpetual right -of -way to maintain, repair and
replace the same and any replacement thereof,
SUBJECT to covenants, conditions, restrictions,
reservations, rights, rights of way and easements of
record.
and to deliver said deed into escrow at the Bank of America,
National Trust and Savings Association, Anaheim Branch, to
be delivered to said purchaser upon c omnletion of said escrow
and the payment of the full purchase price as hereinabove
provided; and
BE I T FURTHER RESOLVED that the City Clerk of the
City of Anaheim be, and he is hereby, authorized and
directed to certify a copy of this Resolution and cause the
same to be attached to the deed to be executed by the City
of Anaheim and delivered to said escrow agent as herein pro-
vided; and said County Recorder is hereby authorized to
record said deed and Resolution.
THE FOREGOING RESOLUTION is approved and signed by
me this 14th day of July, 1953.
