A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING THE OFFER OF E. D.
JOHNSON AND COMPANY TO FURNISH ALL LABOR AND
EQUIPMENT TO INSTALL PRIMARY AND SECONDARY
ELECTRICAL DISTRIBUTION FACILITIES IN TRACTS
NOS. 2369 AND 2501, WORK ORDER NO. 2230; AND
AUTHORIZING THE EXECUTION OF AN AGREEMENT TO
BE ~~DE AND ENTERED INTO WITH SAID E. D.
JOHNSON AND COMPAh~.
WHEREAS, the City Council does find and determine
that public oonvenience and necessity require the installa-
tion of primary and secondary eleotrioal distribution fao-
ilities, consisting of pole lines, cross-arms, secondary
racks, insulators, transformers, fuse out-outs, etc., in
Traots Nos. 2]69 and 2501, Work Order No. 2230; and
WHEREAS, E. D. Johnson and Company has offered to
furnish all labor and equipment to install said primary and
secondary electrical distribution facilities in acoordance
with the design, plans, profiles, dr~wings and/or speoifi-
cations prepared by the Superintendent of the Light, Power
and Water Department of the City of Anaheim, and to install
the same within twenty-one (21) working days from and after
the execution of a contract to be made and entered into by and
between E. D. Johnson and Company and the City, for the price
of $4,271.00; and
WHEREAS, the City Council finds that said price is
the lowest obtainable for the furnishing of all labor and
equipment to install said electrioal distribution facilities,
and that the offer of E. D. Johnson and Company should be
acoepted upon the conditions hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the offer of E. D. Johnson and
Company to furnish all labor and equipment to install primary
and secondary electrical distribution facilities, oonsisting
of pole lines, cross-arms, seoondary raoks, insulators, trans-
formers, fuse cut-outs, etc., in Traots Nos. 2)69 and 2501,
Work Order No. 22)0, in accordance with the design, plans,
profiles, drawings and/or specifications prepared by the
Superintendent of the Light, Power and Water Department of
the City of Anaheim, be, and the same is hereby, accepted,
upon the following conditions:
1. ThE'.t all labor and equipment shall be
furnished and the installation of 'said
electrical distribution facilities com-
pleted within twenty-one (21) working
days from and after the execution of a
contract to be made and entered into by
and between E. D. Johnson and Company
and the City of Anaheim.

2. That ire the furnisU.ng of all labor and

electrical distribution facilities it
shall be expressly understood and agreed
that said E. D. Johnson and Company is
acting as an j.ndependent contractor and
not as an agent, servant or employee of
the City of Anaheim.
AND ':'IE I'l'PURTHEF RESOLVED that the purchase price
for the furnis;lin;; of' all of said labor and equipment for the
installation and oompletion of said public improvement above
described s~al1 be pai d to E. D. Johnson and Company as fol-
lows:
85% thereof upon the completion and acceptance of
said work, and the remaining 15% thereof thirty
(30) days af'ter the fi Hng of notice of completion
of said improvement by the City of Anahelm.
dE IT F'CBTIii:;r:. RSSU::"VED that said E. D. Johnson and
Company shall carry :lblic liabi li ty and property damage in-
surance in an amount not less than $100,000.00 for injuries,
including accidental death, ~or anyone person, and subjeot
to the same limit for each person in an amount not less than
'i~300,000.OO on account of anyone acciient, and property
damage insurance in an amount not less than $50,000.00; and
shall take out and maintain durin'; the life of said contract
workmen's compensation insurance covering all of its employees
on the ~Jroject; and public liability and property damage in-
SUT'ance to cover vehicles used or maintained by it in the
performance of said work connected with said improvement, with
liability limits of not less than #50,000.00 for anyone per-
son! and $100,000.00 for anyone accident, and property damage
of :jjilO,OOO.OO.
That said E. D. Johnson and Company shall also fur-
nish a Pai thful Performance Bond, and a Labor and Material
Bond for 100% of the cost of said public improvement.
AND BE IT ~JRTHER R~SOLVED that the Mayor and the
Ci ty Cl(~rk be, and they are hereby, authorized to enter into
a contract with E. D. Johnson and Company, in the usual form
approved by the City Attcrney, upon the terms and conditions
herein speci~ied, and the terms contained in the standard
form of contract of the City of Anaheim for public improve-
ments.
