56R-3108 - - RESOLUTION NO. ,108 - r A RESOLUTION OF THE CITY COWNCIL OF THE CITY OF ANAHEIM DENYING VARtANCE NO. 463. WHEREAS, the City Planning ~ommission of the City of Anaheim did receive a petition from t~e owner and/or agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: The Southerly 165 feet of the W.st 1/2 of the N.W. 1/4 of the S.E. 1/4 of the S.W. 1/4 of Section 2 in Town- ship 4 South Range 10 West, S.B.B. & M. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on Deoember 19, 1955, notioes of whioh said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due oonsideration of all evidence and reports offered at said hearing, did adopt Reso.lution No. 91 -- Series 1955-56 denying Varianoe No. 463 for the reasons therein stated; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission denying said var- iance, and said appeal was set for pUblic hearing on the 31st day of January, 1956, at 7:00 o'clock P.M. at the City Hall in the City of Anaheim, and notioe of such public hearing was duly given as required by law and the provisions of Seotion 9200.17 of the Anaheim Munioipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due oonsideration of all evidenoe and reports offered at said hearing held on January 31st, 1956, the City Council does find and determine that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subjeot property can be adequately developed and used under the present zone. r NOW, THEREFORE, BE IT RESOLVED by the City Counoil of the City of Anaheim that the action of the City Planning Commission denying said Variance No. 463, requesting permission to divide the West 135 feet of the hereinabove described property into three lots 55' X 135', fronting on Rosemont Street, be, and the same is hereby sustained, and that Variance No. 463 be, and the same is hereby, denied. -1- .-"- ....., r THE FOREGOING RESOLUTION is approved and signed by .e this 31st day of January, 1956. ~ A'l'TEST: ~~zJ:: ' , .
