did rU;ccive a petition from the property oT•rner xxx45=xxxxxxxxxxxxx
of certain real property situated in the City of Anaheim, County of
Oran: e, State of California, described as follows:
Lots 12 and 13 of the Clementine Street Tract located
at 303 ..3 05 West La P lma Avenue. The Petitioner, Mr.
James M. Duffy, 933 North Clementine Street, requests
permission to erect a TRIPLEX DWELLING with Five (5)
Garages and Two (2) Apartments over the Garages. This
petition was later modified to request the erection of
Four (4) Units of One -Story Building with the required
Garages;

Mg at the City Hall in the City of Anaheim upon said petition on
March 2. 1953 notices of which said public hearing were duly
ivcn as required by law and the -provisions of Section S2GO.17 of
the Anaheim iulicipal Code; and
';HER A said Commission, after due inspection, investigation
and studies made by itself and in its behalf and after due consider-
ation of all evidence and rc -orts offered at said hearing, did a olet
its Resolution To. 36 recommending to the City Council of the Cit
of Anaheim that Variance rro j86 be granted upon the conditions
stated in said resolution; and
':THERICAO the City Council does find that:
1. There are exce or extraordinary circumstances
or conditions applicable to the property involved or to the
intended use of the property
that do not apply generally to
the property or class of use in the same vicinity and zone,
2. That such a variance is necessary for the preserva-
tion and enjoyment of a substantial property right possessed
by other property in the same vicinity and zone and denied
to the property in question.
3. That the granting of such variance will not be
raatcrially detrimental to the public welfare or injurious
to the property or improvei:lents in such vicinity and zone
in which the property is located.
4. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NC''r, THEREFORE, BE :T RESOLVED by the City Council of the
City of Anaheim that a conditional zoning variance be, and the same
is '.i :reby granted to Mr. James M. Duffy, 933 North Clementine Street,
Anaheim, California, f or the use of said ;property for the following
nurposcs:
The City Council hereby reserves the right to revoke such
variance 'permit for good cause or failure of said owner their
heirs, successors or assigns to comply with the Anaheim Municipal
Code and regulations and the conditions herein, Said variance is
granted for the term prescribed by the Anaheim Municipal Code unless
otherwise specified herein.
THE TOREGOING RESOLUTIOTN is signed and approved by me this
