RESOLUTION NO. _2116
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING SUBORDINATION AGREEMENT
AND AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE THE SAME.
WHEREAS, on the ...24th day of Bibrusxy. 1953, the City
Council adopted Resolution No. 2110 authorizing the sale of the
hereinafter described real property to Donald R. Bates; and
WHEREAS, said Resolution provided that said property
was sold upon the condition that it would be improved in accordance
10 !with the plans and specifications submitted with and accompanying
11 the application to purchase said property and that if said purchaser
12 ;should fail to comply with the conditions therein specified, then
131title to said property should revert to the City of Anaheim and the
14 purchase price would be returned to said purchaser; and
15 WHEREAS, the deed made, executed and delivered by the
16 City of Anaheim to said Donald R. Bates contained the same pro
17 visions as above set forth; and
18 WHEREAS, it is the desire of the purchaser of said prop-
19 erty to improve the same by construction of a factory building
20 thereon; that in order to construct said building, said purchaser
21 desires to obtain a loan from The Savings, Loan and Building Associ-
22 ation of Anaheim; and
23 WHEREAS, The Savings, Loan and Building Association of
24 Anaheim is unwilling to make said loan to said Donald R. Bates unles
25 the City of Anaheim is willing to subordinate its rights under said
26 reversionary clause to the rights of The Savings, Loan and Building
27 Association of Anaheim under the Trust Deed and note executed in its
28 favor by said Donald R. Bates; and
29 WHEREAS, the City Council finds that it would be to the
30 advantage of the City of Anaheim to have said property improved
31 for industrial purposes and a factory building erected thereon as
32 contemplated by said purchaser.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that all the rights of the City of Anaheim
under the reversionary clause contained in its Resolution Nu.
and the deed executed pursuant thereto and delivered to Donald. R.
Bates be subordinated to the right of The Savings, Loan and Build-
ing Association of Anaheim under that certain Trust Deed dated
the 27Ch day of February
1953, encumbering the
following described property situated in the City of Anaheim,
County of Orange, State of California:
Those portions of Lots 29, 30, 31, 32
33, 56, 57, 58, 59 and 60 and of Julianna
Street, as vacated July 3, 1923, by Order
recorded in Book 17, page 353 of the Minute
Book of Orange County Board of Supervisors,
of the Schaffer Oswald Subdivision, all in
the City of Anaheim, County of Orange, State
of California, as per map recorded in Book 7,
page 41 of Miscellaneous Maps, of said Orange
County, Described as follows:
Beginning at a point on the East line of
North Olive Street as described in deed to the
City of Anaheim, recorded February 2, 1926
in Book 625, page 367 of Deeds of said County,
Northerly 330,00 feet from its intersection
with the North line of La Palma Avenue as shown
on map of said Schaffer-Oswald Subdivision;
thence Northerly 240.00 feet along said East
line and the East line of North Olive Street,
as described in deed to the City of Anaheim,
recorded August 9, 1938 in Book 958, page 80
of Official Records of said County; to the
South line of Julianne Street as described in

corded June 23, 1948 in Book 1658, pages 176.
to 179 inclusive of Official Records of said
County; thence Easterly along said Southerly
line of Julianna Street 200.00 feet to the
Northwest corner of land described in deed
to George P. Grabill and wife, recorded July
8, 1952 in Book 2353, page 599 of Official
Records of said County; thence Southerly 240.00
feet along the westerly line of said Grabill
land and of the land described in deed to
George P. Grabill and wife, recorded July 8,
1952 in Book 2 353, page 591 of Official Records
of said County, and along the Westerly line
of land described in deed to Albert H. Steffens,
a single man, recorded February 17, 1947 in
Book 1473, page 368 of Official Records of
said County; thence Westerly 200.00 feet on a
line parallel with said La Palma Avenue to the
point of beginning.
SUBJECT to a reservation of the use and
control of cienegas and natural streams of
water, if any, naturally upon, flowing across,
into or by said described tract, and the right
of way for and to construct irrigation or
drainage ditches through said tract to irrigate
or drain the adjacent land, as contained in
deed from the Stearns Ranchos Company, recorded
in Book 91, page 103 of Deeds.
SUBJECT to conditions, restrictions, ease.
ments, reservations and rights of way of record.
1 AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and
2 they are hereby, authorized to execute a subordination agreement for and on
3 behalf of the City of Anaheim as hereinabove provided.
