WHEREAS, the City Council of the City of Anaheim did
cause to be publiShed in a newspaper of general circulation,
printed, publis!'\ed and oiroulated in the Ciq of Anaheim, to wit:
The Anaheim Bulletin, on the 12th day and the 18th day

proposals for furnIshing tne 1"ollowlng:
All plant, labor, services, _terials and
equipment, and all utilities and tra~8porta-
tion, including power, fuel and water, and
performing al.l work necessary to construct
and complete in a good and workaanlike manber,
in strict accordance with the plans and
speoifications on file in the Office of the
City Clerk of the City of Anaheim, the fol-
lowing public improvement: The Crescent
Avenue Street Improvement, from Manohester
Avenue to Brookhurst Avenue, consisting of
exoavation, oonstruotion of S-inoh plant-mix
surfaoing, adjusting existing manholes to
grade, and appurtenant work as indicated on
the plans, Job No. 107.

all work necessary to oonstruot and oomplete in a good and work:m.arJ-
lik, manner in striot aooordance with the speoifioations, plans
and drawings therefor on file in the office of the City Clerk of
the City of Anaheim of the publio improvement hereinabove mentioned
and desoribed, together with the appurtenanoes thereto, and as
speCified in the notioe inviting sealed proposals, and that said
proposal of said above named bidder should be acoepted and a oon-
tract awarded to said bidder in aooordanoe therewith; and
WHEREAS, the City Council finds that the above mentioned
sea~ed proposal is the lowest responsible proposal received and
that the person, firm or corporation submitting said proposal is a
responsible person, firm or oorporation and that the proposal sub-
mitted is the best suited and fitted for the publio improvement to
be constructed.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM that the sealed proposal submitted by
R J_ NORLW, COMPANY, P. O. BOX 620, ORANGE, CALIFORNIA,
for the furnishing or all plant, labor, servioes, materials and
equtpment, all utilities and transportation, including power, fuel
and water and pe rforming all work necessary to construct and com-
plete in a good and workmanlike manner, in striot aooordance with
the specifioations, plans and drawings therefor on file in the
offioe of the City Clerk of the City of Anaheim and the notioe in-

viting sealed proposals, the publio works and improvements herein-
above more particularly mentioned and described, together with the
app~tenances thoreto,be, and the same is hereby, accepted, and
that a contract for the construction and completion of said public
,~ improvement be, and the same is hereby, awarded to the said above
named bidder.
AND BE IT FURTHER RESOLVED that the successful bidder or
bid<lers upon each contract a\'larded as hereinabove set forth shall
be, and they are hercb;}' required to e;~ecute Ii contract in the re-
quired form with the City of Anaheim upon the terms and conditions
speeified in the notice inviting sealed proposals and the proposal
submitted by said successful bidder or bidrlers and in accordance
with the plans and specifications for said public improvement
hereinabove described and in accordance with the terms, conditions
and provisions of this recolution, and that said successful bidcer
or bidders to whom eaoh contract is awarded shall be required to
furnish a surety bond in an amount eque.l to one hundred per cent
(100%) of the oontract price for all labor, materials and equipment
to be furnished and performed as set forth in the sealed proposals
submitted by said bidder for the oonstruction of said public im-
provement together with the appurtenances thereto or such portion
thereof as is covered by said oontract as security for the faith-
ful performanoe of said oontract and a separate surety bond in an
amount equal to one hundred per cent (lO~;) of the oonstruction
cost of said public improvement covered by said oontraot as
security for the payment of all persons performing labor and furn-
ishing material for said project.
AND Bt IT FURTHER RESOLVED that said successful bidder
or bidders be, and they are hereby r equir ed to furnish to th~ ,
City of Anaheim in oompanies satisfactory to the City of Anaheim
pub11c liability, property damage, compensation, and other insur-
ance in the amounts and for the purposes as set forth and speoified
in the notice inviting sealed proposals and subject to the approval
of the City Attorney as to form and sufficienoy.
AND BE IT FURTHER RESOLVED that the liIayor and the City
Clerk of the City of Anaheim be, and they are hereby, authorized
and ~lrected to m&~e, execute and enter into for and on behalf of
the Oity of Anaheim a written contract with said successful bidder
or bidders for the furnishing of all plant, labor, materials, and
equipment and performing all work as hereinabove more particularly
described for the construction, installation and completion of
said public improvement hereinabove described upon the terms and
conditions as specified in the notice inviting sealed proposals,
the detailed design, plans, profiles, dra~ings and general specifi~
cations and detailed specifications and drawings and all addenda
thereto and all modifications incorporated therein prior to the
date of the opening of bids, on file in the offioe of the City
Clerk of the City of Anaheim and in strict accordance with the
torms, conditions and provisions of thin Resolution, and in aocord-
ance .lith all the contraot documents herein specified.
