ANAHEIM, CALIFORNIA 25 11 26 27 i! 28 29 30 1 3111 32 1 and RESOLUTION NO. 2002 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO CALL A SPECIAL ELECTION TO SUBMIT TO THE QUALIFIED ELECTORS RESIDING IN THE HEREINAFTER DESCRIBED TERRITORY THE QUESTION OF ANNEXATION OF SAID TERRITORY TO THE CITY OF ANAHEIM. _1— WHEREAS, on the 27th day of May, 1952, Patrick B. Boden, A. B. C. Dubach, Edmond Urbano, R. P. Allen, Lester Mitchell, Mrs. R. E. Miller, W. H. Landon, Mrs. 0. H. Anderson, Mr. Fred Thuerer, and 9I Mrs. Mary Ann Thuerer filed a written request with the City Council 10 of the City of Anaheim requesting the consent of the City Council 11 I to the commencement of proceedings for the annexation of certain 12 inhabited territory, more particularly hereinafter described, to 13 the City of Anaheim pursuant to the provisions of the Annexation 14; Aot of 1913 (Title IV, Division 2, Part 2, Chapter 1, Articles 1 15 to 4 inclusive, of the Government Code of California), and 16 WHEREAS, the City Council did on the 27th day of May, 1952, 17 refer said request and application to the City Planning Commission, 18 and 19 WHEREAS, on the 10th day of June, 1952, the City Council 201! did receive from the City Planning Commission its recommendation 21 ii approving the proposed annexation, and 221 WHEREAS, on the 29th day of May, 1952, the City Council did it 23!1 refer said application to the County Boundary Commission for an 24 a il examination of the boundaries of the proposed annexation; and that on the 2nd day of June, 1952, the approval of the boundaries of said proposed annexation was received from the County Boundary Commission, and WHEREAS, said City Council did, on the 27th day of May, 195 adopt Resolution No. 1968 giving its consent to the commencement of said annexation proceedings and approving the circulation of a pet -i ition for the Annexation of said territory to the City of Anaheim,�i 1 2 3 4 5 6 7 8 11 15 30 CITY OF ANAHEIM 204 E. ANAHEIM, CALIFORNIA WHEREAS, on the 13th day of June, 1952, said proponents did publish a notice of intention to circulate a petition for the annex ation of the hereinafter described property to the City of Anaheim, and within ten (10) days thereafter did file with the City Clerk of the City of Anaheim a copy of such notice of intention to circulate a petition for the annexation, to the City of Anaheim, of said terrt itory, which notice contained the names of the proponents intending to circulate the petition and the specific boundaries of the terri- i 9itory proposed to be annexed, accompanied by a printed statement not 10 exceeding five hundred (500) words in length, containing reasons 12lsaid notice of intention to circulate said petition, and 13 it WHEREAS, within fifteen (15) days after the filing of said 14 of intention to circulate said petition, accompanied by said 16 ';June, 1952, adopt Resolution No. 1973 finding and determining that 17iit would be to the advantage and for the best interest of the City ij 18 led Anaheim and the qualified electors residing within the herein I 19 after described territory, to approve the circulation of a petition 20 I f or the annexation of said territory to the City of Anaheim and did 21 thereupon approve the circulation of said petition, and 22 WHEREAS, on the i ?tk. day of^4a€'1: 1952, the City Council did 23 Ireceive a petition signed by not less than one-fourth of the quali- 24i,fied electors residing within the territory hereinafter described, 25 as shown by the County Registration of Voters, containing a descrip -1 26tion of the new territory proposed to be annexed to the City of 27 Anaheim and asking that said territory be annexed to the City; and 28 the City Council does find and determine that said proponents have 29idone and performed the acts and things required to be done and per- 31 as required by the provisions of said Act; and that said petition 32 was circulated more than twenty -one (21) days after the publication for the petition, together with an affidavit of the publication of affidavit of publication, the City Council did, on the 24th day of formed by the Annexation Act of 1913, at the time and in the manner -2- 1 2 3 4 5 6 7 8 9 10;lpetition for said annexation; and does further find, from evidence 11 and reports received and from said petition, that at the time of the 12 'filing and presentation of said petition, that said new territory 13 'proposed to be annexed to said City of Anaheim did not form a part 14 iof any other city or municipal corporation, and that said territory 15 Iwas, at the time of filing said petition, inhabited territory and 16 jis contiguous to the City of Anaheim, and 17 WHEREAS, the City Council does further find that it would be 18 to the advantage and for the best interests of the City of Anaheim 19 land the residents thereof and the qualified electors residing within 20 the territory proposed to be annexed, as hereinafter more particu- 21 Ilarly described, to submit the question of the annexation of said 22 to the City of Anaheim to the electors residing within 23 ;said territory, and 24 WHEREAS, the City Council does further find that said terri- 25Illtory should be designated by some appropriate name by which it may I 26 be referred to upon the ballots used at the election at which the 27 ',question of annexation of said territory to the City of Anaheim shal. 28 ibe submitted to the electors residing within said territory and that i I 29Han appropriate designation for such territory is ACACIA STREET 30 32 of notice of intention to circulate such petition and that it is signed by not less than one fourth of the qualified electors resid- ing within the territory proposed to be annexed, as shown by the County Registration of Voters and as appears from the certificate of the City Clerk of the City of Anaheim presented to the City Council at the time of consideration of said petition and prior to the adoption of this resolution; and does further find that more than twelve (12) qualified electors resided within the boundaries of the territory proposed to be annexed at the time of the filing of said 31 CITY OF ANAHEIM 204 E. CALIFORNIA I I proposed and sought to be annexed to the City of Anaheim and which is situated in the County of Orange, State of California are as A tract of land including a portion of Sections 2 and 3 Township 4 South, Range 10 West San Bernardino Base and Meridian and all of the original lots 18, 19, 20, 22, 23 and 24 of Golden State Tract No. 2 filed in Book 4 Page 68, Miscellaneous Maps, Records of Orange County; Liberty Lane, portions of Acacia Street, Romneya Drive and East La Palma Avenue, also known as North Street, East Street and Raymond Ave., lying within Section 2, Township 4 South, Range 10 West, San Bernardino Base and Meridian also lots 1, 2, 3, 4, 5 and 6 in the Stockwell Subdivision filed in Book 6 page 10, Miscellaneous Maps, Records of Orange County, portions of the Atchinson Topeka and Santa Fe Railroad right -of -way, Los Angeles and Salt Lake Railroad right -of -way, East La Palma Avenue, also known as North Street and Raymond Avenue, lying within Section 3, Township 4 South, iange 10 West, San Bernardino Base and Meridian, and more particularly described as follow Beginning at a point on the existing easterly City Limit Line, said point being at the intersection of the South right -of -way line of La Palma Avenue and the east property line of Lot 1 of Original Tract No. 153, filed in Book 11, Page 46, Miscellaneous Maps, Records of Orange County and a distance of 1669 ft. more or less East of the monumented center line of East Street; thence eastwardly 1344 feet more or less along said South right -of -way line of La Palma Avenue to the intersection of the southerly extension of the East line of the W2 of the W- of the SEi of Section 2, Township 4 South, Range 10 West, San Bernardino Base and Meridian and the South right -of -way line of said La Palma Avenue; thence northwardly along the said East Line of the Wi of Wi of SE4 of said Section 2 and its southerly extension to the north east property corner of Lot 18 of said Golden State Tract No. 2 and the North line of Si of the Ni of Si of said Section 2; thence westwardly a distance of 3300 feet more or less to the West Section Line of said Section 2; thence con- tinuing westwardly a distance of 30 feet more or less along the north line of the Si of Ni of SEi of Section 3, Township 4 South, Range 10 West, San Bernardino Base and Meridian to the West right -of -sway line of Raymond Avenue; thence northwardly along said West right -of —gray line of Raymond Avenue a distance of 2610 feet more or less to the South right -of -way line of Orangethorpe Avenue; thence westwardly along said South right -of -way line of Orangethorpe Avenue a distance of 1300 feet more or less to the north and south existing City Limit Line; thence southwardly along existing City Limit Line a distance of 4436 feet more or less to the monumented center line of La Palma Avenue said center line also being the existing City Limit Line; thence Eestwardly continuing along existing City Limit Line 2755.18 ft. more or less to a point of intersection of the said City Limit Line and the west property line or original Lot 1 of the said Tract Number 153; thence southwardly 31.26 feet more or less to the south right -of -way line -4- 1 2 3 4 5 6 7 8 9 10 11 12 18 19 20 28 29 1 3 ing on the 22nd day of July, 1952, or theretofore authorized; and 14 BE IT FURTHER RESOLVED that the territory so proposed to of La Palma Avenue and the existing City Limit Line; thence eastwardly continuing along existing City Limit Line 536.46 feet to the point of beginning. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does hereby declare its intention to call a special election on the 7th day of October 1952, for the purpose of submitting to the electors residing in the hereinabove described new territory, the question whether said new territory shall be annexed to, incorporated in, and made a part of the City of Anaheim, and the property therein be, after such annexation, ;subject to taxation equally with the property within said City of ;Anaheim, to pay its pro rata share, based upon assessed valuation, of all of the bonded indebtedness of said City of Anaheim outstand- 211iany objections to the proposed annexation, may appear before the l 22 City Council of the City of Anaheim and show cause why such terri- ii 23 'Itory should not be so annexed: That all persons having any object- 24 ;ions to such proposed annexation are hereby notified to appear on I ij 25jlsaid day at said hour and place to show cause, if any they have, wh 26 such territory should not be so annexed, and all such persons are 27 further notified that any protests against the calling of an elect be annexed shall be designated as the ACACIA STREET ANNEXATION; and BE IT FURTHER RESOLVED that the .loth day Of September 1952, at the hour of 8:00 o'clock P.M. in the City Council Chamber of the City Hall of the City of Anaheim be, and the same is hereby, fixed as the day, hour and place when and where any person owning real property within the territory so proposed to be annexed and having ion to submit to the electors residing within said territory the question of annexation of said territory to the City of Anaheim, or 30j`jany protests against the annexation of said territory to the City 31� Anaheim must be in writing and may be filed with the City Clerk 32I of the City of Anaheim at any time not later than the hour and date CITY OF ANAHEIM O 204 E.
