A. RESOLUTION OF THE: CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING THE SEALED PROPOSAL AND
AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE
BIDDER FOR THE FURNISHING OF ALL PLANT, LABOR,
SERVICES, MATERIALS AND EQUIPMENT; AND ALL
UTILITIES AND TRANSPORTATION INCLUDING POWER,
FUEL AND WATER AND PERFORMING ALL WORK NEC-
ESSARY TO CONSTRUCT AND COMPLETE A SEWER MAIN
LATERAL, COMMENCING AT PAST CENTER STREET AND
THE EAST STREET IN THE CITY OF ANAHEIM AND
EXTENDING EASTERLY ALONG CENTER STREET TO
EVERGREEN STREET IN SAIL CITY INCLUDING SAID
MANHOLES AND APPURTENANT WORK.
WHEREAS, the City Council of the City of Anaheim did cause
to be published in a newspaper of general circulation, printed,
published and circulated In the City of Anaheim, to wit: The
Anaheim Bulletin, on the 13th
and 20th days of June

1952, a notice
inviting sealed proposals for furnishing the following:
All plant, labor, services, materials and equipment,
all utilities and transportation including power,
fuel and water, and performing all work necessary to
construct and complete in a good and workmanlike manner,
in strict accordance with the specifications, plans and
drawings therefor on file in the office of the City
Clerk of the City of Anaheim, of a Sewer Main Lateral
commencing at Fast Center Street and East Street in
the City of Anaheim, Orange County, California, and
extending easterly along Center Street to Evergreen
Street in said City, including manholes and appurten-
ant work.
in accordance with the design, plans, profiles and specifications
prepared by J. R. Lester 'Boyle, consulting Engineer and the notice
inviting sealed proposals, and
WIFREAS, said notice inviting sealed proposals for said pub-
lic improvement did provide that sealed proposals would be received
the City Council of the City of Anaheim at the office of the
City Clerk of said city up to the hour of 8:00 o'clack P.M. on the
24th day of June, 1952, for the furnishing of all plant, labor,
services, materials and equipment, all utilities and transportation
including power, fuel and water, and performing all work necessary
to construct and complete in a good and workmanlike manner the pub-
lic improvement hereinabove more particularly mentioned. and descrlb
1 ed, and which said notice did state and declare that pursuant to
2 the provisions of Section 1770 of the Labor Code, the City Clerk
3 of the City of Anaheim had ascertained the prevailing rate of
4 wages in the locality in which this type of labor is to be perform-

ed for each craft or type of workman or mechanic needed to execute
the contract and did set forth the prevailing hourly wage scale
so ascertained, and
wHEREAS, the City Council of the City of Anaheim did receive
the following sealed proposals prior to 8:00 o'clock P.M. on June
24, 1952, in response to the notice aforesaid inviting sealed
proposals, to wit:

WHFREAS, the City Council did thereupon refer said bids to
the City Engineer for examination, tabulation and. report to the
City Council, and said City Engineer did thereupon examine and
tabulate said sealed proposals and report back to said City Council

1 WHEREAS, the City Council finds that the sealed proposal sub-
2 mitted by J. E. Popovich, Post Office Box 261, Torrance, California;
3 License 46603, is the lowest responsible proposal submitted
4 for the furnishing of all plant, labor, services, materials and
5 equipment, all utilities and transportation, including power, fuel
6 and water, and performed all work necessary to construct and com-
l. plete in a good and workmanlike manner in strict accordance with
18 posal submitted is best suited and fitted for the public improve-
19 ment to be constructed.
20 NOW, THEREFORE, BF IT RESOLVED by the City Council of the
21 City of Anaheim that the sealed proposal submitted by J. E. Popo-
22 vich of Torrance, California, for the furnishing of all plant,
23 labor, services, materials and equipment, all utilities and trans-
24 1 portation, including power, fuel and water, and performing all work
25 necessary to construct and complete in a good and workmanlike
2611 manner in strict accordance with the specifications, plans and
drawings therefor on file in the office of the City Clerk of the
City of Anaheim, and the notice inviting sealed proposals, the
public works and improvements hereinabove more particularly men-
tioned and described together with the appurtenances thereto be,
and the same is hereby, accepted, and that a contract for the con-
struction and completion of said public improvement be, and the
the specifications, plans and drawings therefor on file in the
office of the City Clerk of the City of .Anaheim of the Sewer Main
Lateral hereinabove more particularly described and set forth
together with the appurtenances thereto, and as specified in the
notice inviting sealed proposals, and that said proposal of said
J. P. Popovich should be used and a contract awarded to said J. E.
Popovich in accordance therewith, and
WHEREAS, the City Council advises that the above mentioned
sealed proposal is the lowest proposal received and that the person
submitting said proposal is a responsible person and that the pro-

AND BE IT FURTHER RESOLVED that the successful bidder or
bidders upon each contract awarded as hereinabove set forth shall
be, and they are hereby, required to execute contracts in the re-
quired form with the City of Anaheim, upon the terms and conditions
specified in the notice inviting sealed proposals and the proposal
submitted by said successful bidder or bidders and in accordance
with the plans and specifications for said public improvement
hereinabove described and in accordance with the terms, conditions
and provisions of this resolution, and that said successful bidder
or bidders to whom each contract is awarded shall be required to
furnish a surety bond in an amount equal to (100%) one hundred per
cent of the contract price for all labor, materials, and equipment
to be performed as set forth in the sealed proposal submitted by
said bidder, for the construction of said public improvement, to-
gether witn the appurtenances thereto or such portion thereof as
is covered by said contract, as security for the faithful perfor-
mance of said contracts, and a separate surety bond in an amount
equal to one hundred per cent (100%) of the construction costs of
said public improvement covered by said contract, as security for
the payment of all persons, performing labor and furnishing mater-
ials for said project.
AND BE IT FURTHER RFSOLVFD that said successful bidder or
bidders be, and they are hereby required to furnish to the City of
Anaheim, in companies satisfactory to the C of Anaheim, public
liability, property damage, compensation and other insurance, in
the amounts and for the purposes as set forth and specified in the
notice inviting sealed proposals and subject to the approval of
the City Attorney as to form and sufficiency.
AND BE IT E RES OLVFD that the Mayor and the City Clerk
be, and they are hereby, authorized to make, execute and enter
into, for and on behalf of the City of Anaheim, a written contract

1 with said successful bidder or bidders for the furnishing of all
2 plant, labor, materials and equipment, and performing all work as
3 hereinabove more particularly described, for the construction,
4 installation and completion of said public improvement herein des-
5 cribed, upon the terms and conditions as specified in the notice
6 inviting sealed proposals, the detailed design, plans, profiles,
7 I drawings and the general specifications and detailed specifications
8 and drawings ana all addenda thereto and all modifications incor-

7 porated therein prior to the date of the opening of bids as pre-

the office of the City Clerk of the City of Anaheim, and in strict

documents therein specified.
THE FOREGOING RESOLUTION is signed and approved by me this
