23 submit their tabulation of said sealed proposals and the Cite Coun
24 cil did thereupon find and determine that the sealed proposal sub-
25 mitted by J. S. Barrett an individual, 1300 State Tlieneaea Pewport
26 Beach, California, for the construction, installatica and colepletion
27 of said trunk sewer line herelnabove mertioned and described, shown
28 as Line 'E a Set forth in Schedule 3 of the plans and specifications
29 Vas the lowest responsible proposal submitted therefor anft there-
30 upon 4 .ed said bid and did award a contract to said J.
31 rearreilt for furnishing all plant, labor, services materials and
32 eouipment and all utilities and teansportation, including Dower,

2 complete in a good and workmanlike manner, in strict ac ordance
3 with the speeifications, plans and drawings for said trunk sewer
4 line as specified in said notice inviting sealed propoeals and did
5 authorize the Mayor and the City Clerk of the Pity of Anaheim to
6 execute a contract for and on behalf of the lity of Anaheim with
7 J. S. fiarrett, an individual which said contrect wae duly made and
8 enterea into on the 20th day of Deoember, 1951; and
9 WHER4US, the eaid J. S. Barrett has furnished all plant,
10 labor, serviees materials and equipment and eLl utilities and
llitransporteelon, and performed ell work necessary for the construct-
12 ion and completion, in a good and workmanlike wanner, in strict
13 accordance with the specifications, plane and drawings, said trunk
14 sewer line as specified in the notice inviting sealer proposals,
15 and in tlee detail, design, plans, profile, drawings and opeeifica-
16 tions prepared by J. R. Lester Boyle, Consulting Engineer, and the
17 oontract rpe..1- and entered into with him by the City of Anaheim,
18 except for the changes speoified and directed in the Ohan6e Order
19 dated Juiv3 1952, eigned by J. R. Lester Boyle Consultin Engin-
20 eer, G. 1. Holyoke, City Engineer, and J. 9, Barrett, Contractor,
21 and
22 WHERTeS, the City Engineer and. J. R. Lester Boy e Consulting
23 Engineer, have duly certified to the construction and oonp1etion of
24 said trunk Bever line hereinabove mentioned and described, aa-
25 cordance with the piano and specifications and the contract dome-
26 ments duly made and entered into with said J. q. Jarrett, and said
2 Change Order dated June 3. 1952, and
28 WT.Plalag, the City Council find that said oontractor has oom
29 pleted said trunk sewer line hereinabove more narticularly described
30 in accordance with the provisions of the contract and the contract
31 documents as modified by the Change Order of June 3, 1952 above re-
32ferred to, and that said contractor has offered to reduce the

2 $5,66C.00 to reimburse the City for the resurfacing of streets
3 within the City of Anaheim and for the changes specified in said

5 work should be finally ccepted as modified by said Change Order of
6 June 3, 1952 and upon the condition that the contract price be re-

duce d by the sum of 1:.5,660.00, and that notice of completion be
8 fileft as required by law, and that the payment of the balance due
9 sai contreotor be authorized in accordance with the contract docu-
