1952-19542 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO CALL A 3 SPECIAL ELECTION TO SUBMIT TO THE QUALIFIED ELECTORS RESIDING IN THE HEREINAFTER DESCRIBED 4 TERRITORY THE QUESTION OF ANNEXATION OF SAID TERRITORY TO THE. CITY OF ANAHEIM. 5 6 WHEREAS, on the 20th day of November, 1951,Paul W. Goebel, Fred C. Piepenbrink, Harry Meier, Katherine A. Cyprien, Louise 7 8 RESOLUTION NO. Bamesberger, T. A. Teasdale, Harmon Summers, Mrs. Henry Steinbrink, and Mrs. Elise Fritz filed a written request with the City Council 9 of the City of Anaheim requesting the consent of the City Council 10 to the commencement of proceedings for the annexation of certain 11k 12 inhabited territory, more particularly hereinafter described, to 13 the City of Anaheim pursuant to the provisions of the Annexation Act of 1913 (Title IV,Division 2, Part 2, Chapter 1, Articles 1 to 14 4 inclusive, of the Government Code of California), and 15 WHEREAS, the City council did on the llth day of December, 16 1951, refer said request and application to the City Planning 17 Commission, and 19 WHEREAS, on the 20th day of February, 1952, the City Council! 20 did receive from the City Planning Commission its recommendation 18 21 24 25 26 27 28 31 32 approving the proposed annexation, and 22 WHEREAS, on the 26th day of February, 1952, the City Council 23 did refer said appllcation to the County Boundary Commission for an examination of the boundaries of the proposed annexation; and petition for the annexation of said territory to the City of Ana- helm, and that on the 13th day of March, 1952, the approval of the boundaries of said proposed annexation was received from the County Boundary Commission, and WHEREAS, said City Council did, on the llth day of March, 29 1952, adopt Resolution 1929 giving its consent to the commencement 1 30 of said annexation proceedings and approving the circulation of a WHFREAS, on the 20th day of March„ 1952, said proponents did 2 ipublish a notice of intention to circulate a petition for the annexae 73 of the hereinafter described property to the City of Anaheim, I 4 and within ten (10) days thereafter did file with the City Clerk of 5 the City of Anaheim a copy of such notice of intention to circulate 6 'HI petition for the annexation, to the City of Anaheim, of said terr- 7 itory, which notice contained the names of the proponents intending 0 to circulate the petition and the specific boundaries of the terri- 9 tory proposed to be annexed,accompanied by a printed statement, not 10 exceeding five hundred (500) words in length, containing reasons for 11 the petition, together with an affidavit of the publication of said 12 'notice of intention to circulate said petition, and 13,1 14 flotice of intention to circulate said petition, accompanied by said 15 Haffidavit of publication, the City Council did, on the 21st day of 16 March, 1952, adopt Resolution 1937 finding and determining that it 17 would be to the advantage and for the best interest of the City of 18 Anaheim, and the qualified electors residing within the hereinafter 19[ 20 the annexation of said territory to the City of Anaheim and did 21 lthereupon approve the circulation of said petition, and 22 WREREAS, on the 22d day of April, 1952, 23 described territory, to approve the circulation of a petition for receive a petition signed by not less than one-fourth of the quali- 24 fied 25 11 26 tion 27 eel the City 29 30 31 1 32 electors of WHEREAS, within fifteen (15) days after the filing of said residing within the -2- territory the City Council did hereinafter described, as shown by the County Registration of Voters, containing a descrip- the new territory proposed to be annexed to the City of Anaheim and asking that said territory be annexed to the City; and Council does find and determine that said proponents have done and performed the acts and things required to be done and per- formed by the Annexation Act of 1913, at the time and in the manner as required by the provisions of said Act; and that said petition was circulated more than twenty -one (21) days after the publication; 2'I of notice of intention to circulate such petition and that it is 3 signed by not less than one-fourth of the qualified electors re- 4 siding within the territory proposed to be annexed, as shown by the 5 County Registration of Voters and as appears from the certificate 6 of the City Clerk of the City of Anaheim presented to the City 7 Council at the time of consideration of said petition and prior to 8 9 10 11 12 131 14 15 the adoption of this resolution; and does further find that more than twelve (12) qualified electors resided within the boundaries of the territory proposed to be annexed at the time of the filing of said petition for said annexation; and does further find, from evidence and reports received and from said petition, that at the time of the filing and presentation of said petition, that said new territory proposed to be annexed to said City of Anaheim did not form a part of any other city or municipal corporation, and that 16 said territory was, at the time of filing said petition, inhabited 21 22 23 ii 24 i 25 26 27 28 29 30 31 32 territory and is contiguous to the City of Anaheim, and WETREAS, the City Council does further find that it would be I to the advantage and for the best interests of the City of Anaheim,; and the residents thereof, and the qualified electors residing within the territory proposed to be annexed, as hereinafter more particularly described, to submit the question of the annexation of said territory to the City of Anaheim to the electors residing within said territory, and WHEREAS, the City Council does further find tory should be designated by some appropriate name by which it may be referred to upon the ballots used at the election at which the question of annexation of said territory to the City of Anaheim shall be submitted to the electors residing within said territory and that an appropriate designation for such territory is Placenti€ Avenue Annexation, and that said terri 4 5 6 7 WHEREAS, the City Council finds from said petition, and :evidence, and reports received that the boundaries of the territory 3''so proposed and sought to be annexed to the City of Anaheim are as follows, to wit: Said territory is situated in the County of Orange State of California, and, the specific boundaries thereof are as follows: 8, 9 10 11 12 11I 13 14 15 16 17 18 11 19 (I 20 21 22 23 24 25 26 27 28 29 30 31 32 Beginning at a point on the existing City Limit Line, which point is the Northeasterly R/W corner of Placen- tia Avenue and Anaheim -Olive Road; thence Southwardly along the easterly R/W line of Placentia to a point of intersection of the South R/W line of Vermont Ave- nue extended and Placentia Avenue, also known as State Highway Route 180; thence Westwardly along the South R/W line of Vermont Avenue to a point; said point being the existing City Limit Line and 1852 feet, more or less east of the monumented center line of East Street; thence Northwardly along existing City Limit Line 846.62 feet to a point; thence westwardly continuing along existing City Limit Line 1619 feet more or less to the east R/W line on East Street; thence Northwardly continuing along existing City Limit Line and the East R/W line of East Street to a point of intersection of the east R/W line of East Street and the south R/W line of Santa Ana Street; thence Eastwardly continuing along existing City Limit Line and the South R/W line of Santa Ana Street 605.55 feet to a point; thence Southwardly continuing along existing City Limit Line 801.71 feet to a point; thence eastwardly continuing along existing City Limit Line 605059 feet to a point; thence northwardly continuing along the existing City Limit Line 826 feet more or less to a point on the monumented center line of Santa Ana Street; thence Eastwardly continuing along existing City Limit Line and the monumented center line of Santa Ana Street 905 feet more or less to a point of intersection with the westerly line of lot 10 extended; thence Northwardly continuing along existing City Limit Line to a point, 330 feet south of the monumented center line of Center Street, also known as State Highway Route 178, thence Eastwardly continuing along the existing City Limit Line 1063 feet more or less to a point of intersection of the south R/W line of Anaheim Olive Road; thence continuing long existing City Limit also being the south R/W line of Anaheim Olive Road 211 feet more or less to a point on the west R/W line of Placentia Avenue; thence Northwardly continuing along existing City Limit Line 81 feet more or less to the intersection of the north R/W line of Anaheim -Olive Road and the West R/W line of Placentia Avenue; thence East- wardly along existing City Limit Line 63 feet more or less to the point of beginning. -4- NOW, THEREFORE, BE IT RESOLVED by the City Council of the 2 City of Anaheim that it does hereby declare its intention to call 4 5 10 11 6 territory shall be annexed to, incorporated in, and made a part of 7 the City of Anaheim and the property therein be, after such annexa- 8r!tion, subject to taxation equally with the property within said City 9 of Anaheim, to pay its pro rata share, based upon assessed valuation;, 121 13 ;annexed shall be designated as the PLACENTIA AVENUF ANNEXATION, and 14 BE IT FURTHFR RESOLVED that the Ist&4 day of 'i 1 5 1 1952, at the hour of 8 :00 o'clock P.M. in the City Council Chamber 16 lof the City Hall of the City of Anaheim be, and the same is hereby 17 fixed, as the day, hour and place when and where any person owning 18 !real property within the territory so proposed to be annexed and 1 any objections to the proposed annexation, may appear before 20 the City Council of the City of Anaheim and show cause why such 21 4territory should not be so annexed: That all persons having any 22 objections to such proposed annexation are hereby notified to appear 23 s �f on said day, at said hour and place to show cause, if any they have, 24 Hhy such territory should not be so annexed, and all such persons 25 are further notified that any protests against the calling of an 26 selection to submit to the electors residing within said territory 27 the question of annexation of said territory to the City of Anaheim, 28 or any protests against the annexation of said territory to the City 29 Hf Anaheim must be in writing and may be filed with the City Clerk 30 of the City of Anaheim at any time not later than the hour and date 31 forth herein for the hearing of objections to said election. 32 special election on the 25th day of June 1952, all of the bonded indebtedness of said.
