WHEREAS, the City Council of the City of Anaheim, a municipa
corporation of the State of California, did on the /3 day of
19570, pass its Ordinance No. 796, entitled, "AN
ORDINANCCEOLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM TO VACATE AND ABANDON CERTAIN PORTIONS OF A PUBLIC STREE
AND CERTAIN PORTIONS OF PUBLIC ALLEYS AND TO ABANDON THE EASEMENT
UPON, OVER AND ACROSS THE SAME, AND FIXING. A TIME AND PLACE FOR A
HEARING THEREON AND DIRECTING THE POSTING OF NOTICES THEREOF AND
THE PUBLICATION OF THIS ORDINANCE" whereby it declared its intentio
to vacate and abandon and close to public use a street and an ease-
ment for street purposes and portions of two certain alleys and an
easement for alley purposes, upon, aver and along the hereinafter
described property; and.
WHEREAS, said City Council did by said. Ordinance fix the
26th day of February, 1952, at 3:00 o'clock P.M. in the City Hall
of the City of Anaheim as the time and place of public hearing on
the matter of such vacation, abandonment and closing to public use
of said street and easement for street purposes and alleys and
easement for alley purposes for all persons interested in or object-
ing to such proposed vacation, abandonment and closing to public
use to appear and show cause, if any they have, why such street and
easement for street purposes and alleys and easement for alley pur-
poses should not be vacated, abandoned, and closed to public use;
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ORDERING THE VACATION AND ABANDON-
MENT OF CERTAIN PORTIONS OF A PUBLIC STREET
AND CERTAIN PORTIONS OF PUBLIC ALLEYS AND THE
EASEMENT UPON, OVER AND ACROSS THE SAME ALONG
THE HEREINAFTER DESCRIBED PROPERTY.
WHEREAS, said Ordinance was published on

WHEREAS, by said Ordinance said City Council directed that
notices of the passage of said Ordinance and of time and place of
4the hearing of the matter of the vacation, abandonment and closing

to public use of said street and easement for street purposes and
alleys and easements for alley purposes be posted conspicuously
along the line of said street and alleys not more than 300 feet
apart and not less than three such notices should be posted; and
WHEREAS, George E. Holyoke, City Engineer and Superintendent
of Streets, did on the /5 day of 195,, post conspicu-
ously /2 such notices along the line o 4 aid street and alleys,
which notices were posted less than 300 feet apart; and
WHEREAS, said City Council did on February 26, 1952, at 8:00
o'clock P.M. at said City Hall conduct a public hearing on the
matter of whether said street and easement for street purposes and
alleys and easements for alley purposes should be vacated, abandone
and closed to public use, and at said hearing did hear evidence
thereon, and did thereupon continue said matter to February 28, 195
at 2:00 o'clock P.M. for further hearing; and
WHEREAS At the time and place fixed for said further hearing
the City Council did receive further evidence and reports bearing
upon the public use of said street and alleys and the nature of the
uses being made of surrounding property, and the probabilities of
the future use of the portion of said street and the portions of
said alleys proposed to be abandoned, and
WHEREAS, the City Council, after duly considering all of the
27 evidence and reports received by it does find and determine that
28 `very little use is made by the public at large of that portion of
29 Kroeger Street between Santa Ana Street and Water Street and that
said Kroeger Street comes to a dead end at Water Street, and that
Water Street is unimproved and not open for public use at the pres-
ent time; and the City Council further finds that the use of said

1 ;portion of the alley lying south of Santa Ana Street, and for the
2Popening of a 30 foot alley extending southerly from that point to
3 Water Street; and the City Council further finds that the opening
of this alley will promote the most orderly development of said area
for industrial purposes and will be beneficial to the industrial
concerns now located in the area, and that the abandonment of that
portion of Kroeger Street and that portion of the alleys hereinafteJ
8 described will not be materially detrimental to said industrial con_t
cerns; and
WHEREAS, the City Council finds from all the evidence sub—
mitted that that portion of Kroeger Street and those portions of
the alleys described in the Ordinance of intention and hereinafter
described are unnecessary for present or prospective street and
alley purposes, and that an order vacating such portion of Kroeger
Street and such portions of said alleys as described in the Ordin—
ance of intention should be made by the City Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim:
1. That it finds the recitals hereinbefore set forth in

24 present or prospective public purposes;

this resolution to be true;
2. That it finds from all the evidence submitted that said

27 and they are hereby, vacated, abandoned and closed to public use;
28 4. That the said. street and easement for street purposes
29 and alleys and easement for alley purposes herein ordered vacated,
30 abandoned and closed to public use, are those described in said
31 Ordinance No. 796, are situated in the City of Anaheim, County of
32 Otange, State of California, and are more particularly described

South by the Westerly prolongation of the South line
5 of Lot 1 of Block C, and on the North by a line paral-
lel with the North line of Lot 28 of Block C, said
6 line being 10 feet Southerly of the North line of Lot 28.
