C2Ir j'� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO CALL A SPECIAL ELECTION TO SUBMIT TO THE QUALIFIED ELECTORS RESIDING IN THE HEREINAFTER DESCRIBED TERRITORY THE QUESTION OF ANNEXATION OF SAID TERRITORY TO THE CITY OF ANAHEIM. WHEREAS, on the 13th day of November, 1951, E. E. Heacock, Leah V. McDonald, Mrs. Ted Anderson, Mrs. Daisy D. Acton and Mrs. Wm. Vuksanovich filed a written request with the City Coun- cil of the City of Anaheim requesting the consent of the City Counci to the commencement of proceedings for the annexation of certain inhabited territory more particularly hereinafter described to the City of Anaheim, pursuant to the provisions of the Annexation Act of 1913, (Title IV, Division 2, Part 2, Chapter 1, Articles 1 to 4 inclusive, of the Government Code of California), and WHEREAS the City Council did thereupon refer said application to the City Planning Commission, and WHEREAS on the 13th day of November, 1951, the City Council did receive from the City Planning Commission its recommend- ation approving the proposed annexation, and WHEREAS said City Council did on the 13th day of November, 1951, give its consent to the commencement of said pro- ceedings, and WHEREAS, on the 5th day of December, 1951, said pro- ponents did file with the City Clerk of the City of Anaheim a copy of a notice of intention to circulate a petition for the annexation to the City of Anaheim of the territory hereinafter described, which notice contained the names of the proponents intending to circulate the petition and the specific boundaries of the territory proposed to be annexed, accompanied by a printed statement not exceeding five hundred words in length containing reasons for the petition, togethe with an affidavit of the publication of said notice of intention to circulate said petition, and WHEREAS the City Council did, on the llth day of 1 December, 1951, find and determine that it would be to the advantage 2 and for the best interests of the City of Anaheim and the qualified 3 electors residing within the hereinafter described territory to 4 approve the circulation of a petition for the annexation of said 5 territory to the City of Anaheim, and did thereupon approve the 6 circulation of said petition, which approval was thereupon entered 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 in the minutes of the City Council, and WHEREAS, said matter was referred to the Boundary Commission of the County of Orange, State of California, with respec to the definiteness and certainty of the proposed boundaries of the territory proposed to be annexed to the City of Anaheim; that the report and approval of said boundaries was received from the Bound- ary Commission of said County of Orange, State of California on the 7th day of January, 1952, and WHEREAS the City Council did, on the 13th day of February, 1952, adopt Resolution No. 1925 ratifying and confirming its action of December 11, 1951, approving the circulation of said petition and did further approve the circulation of said petition, and WHEREAS, on the 13th day of February, 1952, the City Council did receive a petition signed by not less than one fourth of the qualified electors residing within the territory hereinafter described as shown by the County Registration of Voters containing a description of the new territory proposed to be annexed to the City of Anaheim and asking that said territory be annexed to the City, and the City Council does find and determine that said pro- ponents have done and performed the acts and things required to be done and performed by the Annexation Act of 1913, at the time and in the manner as required by the provisions of said act, and that said petition was circulated more than twenty -one days after the publication of notice of intention to circulate such petition, and that it is signed by not less than one fourth of the qualified 1 electors residing within the territory proposed to be annexed, as 2 shown by the County Registration of Voters and as appears from the 3 certificate of the City Clerk of the City of Anaheim presented to 4 the City Council at the time of consideration of said petition and 5 prior to the adoption of this resolution, and does further find that 6 more than twelve (12) qualified electors resided within the bound- 7 arses of the territory proposed to be annexed at the time of the 8 filing of said petition for said annexation, and does further find 9 from evidence and reports received and from said petition that at 10 the time of the filing and presentation of said petition that said 11 new territory proposed to be annexed to said City of Anaheim did 12 not form a part of any other city or municipal corporation and that 13 said territory was at the time of filing said petition inhabited 14 territory and is contiguous to the City of Anaheim, and 15 WHEREAS the City Council does further find that it 16 would be to the advantage and for the best interests of the City of 17 Anaheim and the residents thereof and the qualified electors resid- 18 ing within the territory proposed to be annexed as hereinafter more 19 particularly described to submit the question of the annexation of 20 said property to the City of Anaheim to the electors residing within 21 said territory, and 22 WHEREAS the City Council does further find that said 23 territory should be' designated by some appropriate name by which it 24 may be referred to upon the ballots used at the election at which 25 the question of annexation of said property to the City of Anaheim 26 shall be submitted to the electors residing within said territory 27 and that an appropriate designation for said territory is EUCLID 28 AVENUE ANNEXATION NO. 2, and 29 WHEREAS the City Council finds from said petition and 30 evidence and reports received that the boundaries of the territory 31 so proposed and sought to be annexed to the City of Anaheim are as 32 follows, to -wit: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 A tract of land including a portion of the SW+ of the SW+ of Section 9, a portion of the SE of the SE+ of Section 8, a portion of the NW+ of the NW of Section 16, and a portion of the NE+ of the NE+ of Section 17, Township 4 South, Range 10 West, San Bernardino Base and Meridian, and Lots 1, 2, 3, 4 and 5 of Tract 658, as shown on a map thereof recorded in Book 20, Page 36, Miscellaneous Maps, so including a portion of Lincoln Avenue and Euclid Avenue, in the County of Orange, State of California, and more particularly described as follows: Beginning at a point on the present westerly city limit line, said point being on the southerly line of Lincoln Avenue and 346.0 feet westerly from the center line of Loara Street; thence N- 1 02' -45n -W along the present city limit line a distance of 310.38 feet to a point; thence N- 57©- 13t -30n -W along the present city limit line a distance of 1125.44 feet to a point on the easterly line of Euclid Avenue; thence S- 0 43 28tt -W along the present city limit line a distance of 244.41 feet to a point of intersection with the South line of the Ni of the SE+ of the SE+ of Section 8, Township 4 South, Range 10 West, San Bern- ardino Base and Meridian projected eastwardly; thence Westwardly along said South line of the Ni of the SE+ of the SE of Section 8 and said line project 9d to the westerly line of the SE+ of the SE+ of the SE of said Section 8; thence Southwardly along the Westerly line of said SE4 of the SE+ of the SE+ of said Section 8, Township 4 South, Range 10 West, San Bernardino Base and Meridian and along the Westerly line of Lot 5 of Tract 658 as shown on a map thereof recorded in Book 20, Page 36, Miseellaneous Maps, Records of Orange County and said line extended a distance of 689.91 feet, more or less, to the southerly line of Lincoln Avenue; thence Eastwardly along the Southerly line of said Lincoln Avenue to the point of beginning. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does hereby declare its intention to call a special election on the 22mi day of 00r 1952, and does hereby declare its intention to submit the question of annex- ation of the hereinabove described territory to the electors residing within said territory, and BE IT FURTHER RESOLVED that the territory so proposed to be annexed shall be designated as the EUCLID AVENUE ANNEXATION NO. 2, and BE IT FURTHER RESOLVED that the llth day of March, 1952 at the hour of 8:00 otclock P.M. in the City Council chamber of the City Hall of the City of Anaheim be, and the same is hereby, fixed as the day, hour and place when and where any person owning real 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 property within the territory so proposed to be annexed, and having any objections to the proposed annexation, may appear before the City Council of the City of Anaheim and show cause why such terri- tory should not be so annexed; that all persons having any object- ions to such proposed annexation are hereby notified to appear on said day at said hour and place to show cause, if any they have, why such territory should not be so annexed, and all such persons are further notified that any protests against the calling of an election to submit to the electors residing within said territory the question of annexation of said territory to the City of Anaheim or any protests against the anne 2ation of said territory to the City of Anaheim must be in writing and may be filed with the City Clerk of the City of Anaheim at any time not later than the hour and date set forth herein for the hearing of objections to said election. AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and he is hereby, authorized and directed to cause a copy of this resolution to be published at least once a week for two weeks prior to the date hereinabove fixed for the hearing of protests and objections to said election and the annex- ation of said territory to the City of Anaheim, in the Anaheim Bulletin, a newspaper of general circulation published and circula- ted in the City of Anaheim, County of Orange, State of California.
