1951-1886RESOLUTION NO.1886 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MEM RELATIVE TO THE CONSTRUCTION OF ADDITIONAL FACILITIES IN SECTION 1 OF THE JOINT OUTFALL SEWER OF ORANGE COUNTY, CALIFORNIA WHEREAS, the Cities of Anaheim, Fullerton, Orange and Santa Ana and the Sanitary Districts of Buena Park, Garden Grove, La Habra and Placentia have heretofore, to wit, on the 28th day of Fe bruary, 1951, made and entered into an agreement with County San- itation Districts Nos. 1, 2, 3, 5, 6, 7, and 11, wherein and whereby said Cities and Sanitary Districts agreed to sell and said County Sanitation Districts agreed to buy Section 1 of the Orange County Joint Outfall Sewer of Orange County, California, upon the terms and conditions as more particularly set forth in said agreement, and WHEREAS, under and by virtue of the terms of said agreement said County Sanitation Districts did promise and agree to construct additional facilities adequate for the treatment and disposal into the ocean of all sewage arising within the boundaries of said Cities and Sanitary Districts and that they would, in accordance with the requirements of the State Health Department of the State of Califor- nia, treat, handle and dispose of such sewage through the facilities purchased from said Cities and Sanitary Districts and additional facilities to be constructed by said Sanitation Districts, and WHEREAS said County Sanitation Districts have voted bonds to obtain funds with which to construct a land and marine outfall sera! and said additional facilities to treat, handle and dispose of al'_ sewerage in accordance with the terms of the agreement heretofore macw and entered into on the 28th day of February, 1951, and WHEREAS said agreement so made and entered into on the 28th da: of February, 1951, provides that it shall become null and void in event that the proceeds of the bonds of the several County San- itation Districts are insufficient to construct and provide adequa..�. facilities for the treatment and disposal of the sewage aforesaid, NOW, THEREFORE, BE IT RESOLVED by the City Council of the Cit:: of Anaheim that in the event that said County Sanitation -1- Districts :Cos. 1, 2, 3, 5, 6, 7 and 11 shall fail to carry out and perform the terms and provisions of said agreement of February 28, 1951, and shall fail to construct the sewage disposal facilities as provided for in said agreement to adequately treat, handle and dis- pose of all sewage arising within the boundaries of said Cities and Sanitary Districts in accordance with the requirements of the State Health Department of the State of California, that the City of Anaheim join with said Cities and Sanitary Districts in any action or proceedings necessary or required to terminate said agree- ment, and BE IT FURTHER RESOLVED that in the event that said County San'. tation Districts fail to comply with said agreement and construct the sewage disposal facilities therein required to be constructed b them and that it is necessary to terminate said agreement, that the City of Vii, will join with the Cities and Sanitary Dist. ricts above mentioned in the construction of such additional sewag, disposal system and facilities as shall be reasonably necessary to adequately treat, handle and dispose of all sewage arising within the boundaries of said Cities and Sanitary Districts, in accordance with the requirements of the State. Health Department and will pay share of the cost of the construction of such addi- tional sewage disposal system and facilities, as provided for in agreements heretofore made and entered into by and between said Cis• ies and Sanitary Districts or as the same may be hereafter modified, THE 70REGOING RESOLUTION is signed and approved by me this 13th day of November 1951.
