RESOLUTION GRANTING A VARIANCE
WHEREAS, Tarver Montgomery, Gertrude Montgomery and.
Louise Montgomery, as owners of certain real property situated in
the City of Anaheim, County of Orange, State of California, de-
scribed as the southwesterly 21 acres of the Northeast Luarter
(NE) of the Southeast CAlarter (SEi) of Section 8, fronting on
Euclid, Avenue and the Southern Pacific Railroad right-of-way, has
filed with the City Planning Commission of the City of Anaheim, a
petition requesting that a variance be granted permitting them to
construct and operate a plant for light manufacturing, to may
controls for machinery, equipment and appliances; and
WHEREAS, the City Council finds from consideration and
Investigation of the facts and the report and recommendation of the
City Planning Commission that:
(1) Special circumstances and exceptional conditions do
exist as to the property or classes of uses in the same zone or
district;
(2) That a variance is necessary for the preservation
and enjoyment of a substantial property right of said oetitioner;
(3) That the granting of such conditional variance will
not be detrimental to the public welfare or injurious to the prop-
erty or improvements in the district wherein said property is 10-
eated, provided, the conditions hereinafter set forth are complied
with:
NOW, THEREFORE, BE IT RESOLVED BY HE CITY COUNCIL OF
THE CITY OF ANAHEIM, that a conditional variance be, and the same
is hereby granted to Tarver Montgomery, Gertrude Montgomery and
Louise Montgomery oermitting them to construct and operate a plant
for light manufacturing, to manufacture controls for machinery,
equipment and appliances upon the followina conditions:

1. That said building shall be constructed in accord-
ance with the plans submitted with the application for a variance
and in accordance with the Building Code and. Building Regulations
of the City of Anaheim, and the State of California.
2. That the appearance of the said real property, in-
cluding all buildings thereon, shall be kept andmaintained with a
satisfactory appearance in keeping with the uses herein permitted.
3. That the construction, maintenance and operation of
said building shall comply with all requirements of the Chief of
the Fire Department of the City of Anaheim as to safety and fire
prevention.
4. That said business shall be ooerated in accordance
with all laws of the State of California and Ordinances and. Regula-
tions of the City of Anaheim,
5. That the City Council hereby reserves the right to
revoke said variance permit for good cause.
6. Said variance permit is granted for the use and bene-
fit of the parcel of land hercinabove described and for the use
hereinabove mentioned and shall inure to the benefit of the
successors or assigns of Tarver Montgomery, Gertrude Montgomery
and. Louise Montgomery subject nevertheless to the right of the
City Council to revoke said variance permit for good cause.
THE FOPEGOING RESOLUTION is signed and approved by me
this 20th, day of February, 1951.
