72R-242 ,"'-" RESOLUTION NO. 72R-242 A RESOLUTION OF TIlE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1304 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from VACATIONLAND, LTD., Lessee; WRATHER VACATIONLAND, INCORPORATED, agent, to expand an existing travel trailer park, to establish a self-service store as an accessory use and to allow permanent storage areas for campers, boats and trailers on the following described property: PARCEL 1: The Southwest quarter of the Northeast quarter of the Northeast quarter of Section 21, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, as shown on a map recorded in book 51, page 10, Miscellaneous Maps, records of said Orange County. PARCEL 2: The Southeast quarter of the Northeast quarter of the Northeast quarter of Section 21 in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, as shown on a map recorded in book 51, page 10 Miscellaneous Maps, records of Orange County, California. .,-.. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City ot Anaheim upon said application on Ka ~ , 19 72 , notices of which said public hearing ~e~e duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim MUnicipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution ~o. WHEREAS, thereafter within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in qrantinq said conditional use permit and said appeal was set for public hearing on June 13 , 19 72 , at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion in ~rantin~ said conditional use permit be, and the same is he eby sustgined , and that Conditional Use Permit No. 1304 be, an the same is hereby, granted permitting the expansion of an existing travel trailer park, to establish a self-service store as an accessory use and to allow permanent storage areas for campers, boats and trailers on the property hereinbefore described subject to the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 57 feet in width from the centerline of the street along Walnut Street for street widening purposes. ",,""""""" 2. That all engineering requirements of the City of Anaheim along Walnut Street, including preparation of all improve- ments such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; that street lighting facilities along Walnut -2-- ~ Street and West Street shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the office of the Director of Public utilities; and that a bond in an amount and form satisfactory to the city of Anaheim shall be posted with the city to guarantee the installation of the above-mentioned requirements. 3. That the vehicular access rights to Walnut street shall be dedicated to the city of Anaheim. 4. That the owners of subject property shall pay to the City of Anaheim the sum of 159 per front foot along Walnut street for tree planting purposes. 5. That sidewalks shall be installed along West Street as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 6. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 7. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 8. That a 6-foot masonry wall shall be constructed along the north and south property lines and that a 5-foot wide landscaped area including a minimum of 15-gallon trees be extended through the proposed storage area inside the wall along the north and south property lines. 9. That a heavily landscaped minimum 3-foot high earthen berm with a minimum 5-foot high solid masonry wall on the top of the berm shall be constructed 20 feet easterly of the west property line. 10. That a landscape plan indicating the landscape treatment of the areas discussed above in Conditions Nos. 8 and 9 be submitted to and approved by the Development Services Depart- ment. ".""'-" 11. That any parking area lighting proposed shall be down-lighting of a maximum height of 8 feet within 120 feet of the single-family residences to the west, which lighting shall be directed away from the property lines to protect the residen- tial integrity of the area. 12. That subject property shall be served by under- ground utilities. 13. That the proposed development shall be in accord- ance with the requirements of the state Trailer Act, and that plumbing shall be provided in order that the travel trailer park will accommodate all trailers and not be restricted to "California approved trailers" only. 14. That the conditional use permit is granted subject to the completion of Reclassification No. 66-67-61, now pending. 15. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. -3- ..- 16. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2, 3 and 4, except as Conditions Nos. 8, 9 and 10 may modify the plans. 17. That the developer shall pay water and sewer assessment fees as determined by the Director of Public Utilities. 18. That a crash gate shall be constructed along the westerly property line as required by the Chief of the Fire Department for emergency purposes. 19. That Conditions Nos. 1, 2, 3, 4, 5, 8, 9 and 10, above mentioned, shall be complied with prior to final building and zoning inspections of the first phase of development. 20. That Conditions Nos. 6, 7, 11, 12, 13, 14, 15, 16, 17 and 18, above mentioned, shall be complied with prior to final building and zoning inspections on each phase of development. 21. That a fifteen (15) year time limit shall be established for the existing and proposed travel trailer park, self-service store and the camper, boat and trailer storage area, after which time the use shall be reviewed for consideration of an additional period of time or termination without prejudice. 22. That no advertising signs shall be displayed on the convenience market to attract outside trade from other than occupants of trailer space in this park, as stipulated to by the petitioner. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said lessee, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions ~rein.
