RESOLUTION AUTHORIZING THE SUBSTITUTION OF VALVES NOT
SPECIFIED IN THE PLANS AND SPECIFICATIONS AND APPROVAL
OF ADDITIONAL COSTS THEREFOR
WHEREAS, heretofore by proper Resolution, the various Cities
and Senitary Districts which are parties signatory to certain Agree-
ments covering ownership, maintenance, construction and operation of
the facilities known as Orange County Joint Outfall Sewer authorized
the City of Santa Ana to call for bids and award a contract for the
construction of a 75 foot digestor unit and certain other works as
the same were designed by the Engineering Firm of Koebig Koebig; and
WHEREAS, it now appears that the valves originally proposed
to be installed in connection with the work hereinabove referred to,
being valves having only 40% openings, will not result in a satis-
factory installation; and
WHEREAS, it appears that Fred J. Early, Co. Incorporated
has agreed to substitute for seid valves, more expensive valves and
to charge therefor only the exact difference in price in the cost
of the valves without adding thereto any rehandling costs or per-
centage for said general contractor;
NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana as
contracting City be and the same is hereby authorized and directed
to enter into a contract with Fred J. Early, Jr. Co. Inc., to fur-
nish and install at their own proper expense, 30 8" A.C.F. 1400
66% port valves and 2 6" A.C.F. D126 full port valves in lieu of
30 8" and 2 6" Chapman 101 gate valves to comply with require-
ments of Koebig Koebig for and in consideration of the additional
sum of One Thousand Six hundred Seven Dollars and r'orty Cents
($1,607.4
BE IT FURTHER RESOLVED: That the CITY OF ANAHEIM
hereby promises and agrees to pay its
percentage of total cost of such additional work as such percentage
is set out in the joint Agreement and supplements thereto, herein-
above referred to, for the joint construction of additional facil-
ities.
BE IT FURTHER RESOLVED: That any offer heretofore made to
sell the sewerage pipe -lines and treatment plant is hereby modified
to the extent that the percent of total cost of said digester unit
above referred to that is paid by the CITY OF'AIAHEIM
and such percent of total cost. of any other. additional facility that
is paid by tl,,, 2ITY O F ANAHEIM
shall be and is hereby to the price asked to effect a sale
and transfer of title to any agency or group of contracting districts.
PASSED AND ADOPTED by the City Council of the City of Anaheim
this 14th day of November, 1950, approved and signed by me this 14th day of
November, 1950.
