RESOLUTION NO. 1751
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FIXING
INSTALLATION CHARGES FOR WATER INSTALLATION AND RATES TO BE
CHARGED BY THE PUBLIC SERVICE DEPARTMENT FOR WATER FURNISHED TO
CONSUMERS AND FOR ALL SERVICES RENDERED IN CONNECTION THEREWITH.
WHEREAS, the City of Anaheim maintains a water distribution system for
the furnishing of water to residents and inhabitants of the city of anaheim, and
WHEREAS, the City sells surplus water outside the City Limits pursuant to
the provisions of Statutes of 1911 Chapter 715 of the State of California, and
WHEREAS, it is desirable and necessary that certain rules and regulations
be established and that charges for installation and service be fixed, and
WHEREAS, Ordinance No. 626, Section 34 provides that the City Council
shall by Resolution fix installation charges and establish rates to be charged by
the Public Service Department of the City of Anaheim for water installation and
water furnished to consumers and services rendered in connection therewith.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim
that the following rules and regulations for water installation heretofore or here-
after made and rates for such installation and for water furnished and for services
rendered in connection therewith be, and the same are hereby established as follows
to -wit:
1. SUPPLY TO PREMISES UNDER SINGLE OWNERSHIP INSIDE CITY, OCCUPIED BY TWO OR
MORE INDIVIDUAL CONSUMERS OF WATER.
No service connection for water shall be made inside the City Limits for
the purpose of supplying through a common service, two or more independent consumer
occupying premises held under the same ownership, unless said premises are located
on the same lot or the property is what is known as a court, apartment house, or
block, covering more than one lot, then only provided the owner or operator of such
premises shall guarantee payment of all bills for water and water service.
2. SUPPLY TO PREMISES UNDER SINGLE OWNERSHIP OUTSIDE CITY, OCCUPIED BY TWO
OR MORE INDIVIDUAL CONSUMERS OF WATER, AND TWO OR MORE OWNED PARCELS OF PROPERTY
INSIDE OR OUTSIDE THE CITY.
No service connection for water shall be made outside the City Limits for
the purpose of supplying through a common service, two or more independent consumer

service, except when the Department does not have facilities available to render
individual services to each separate consumer. In such case, permission for common
use of a service may be granted only provided:
(a) That the consumer first in order of service shall guarantee payment
of all bills for water service, and,
(b) That all bills for water and water service shall be rendered on the
basis of all minimum charges and all quantities of rate blocks multiplied by the
number of individual consumers so served, and
(c) That the consumer second in order of service, and any other consumer
served secondarily, shall agree to take and pay for an individual service within
30 days of notification by the Department of its availability.
3. RESALE OF WATER
Except as may be permitted by special agreement with the Department, no
consumer shall resell any of the water received by him from the Department. Water
used by any consumer shall be restricted to that use specified in his application
for service.
4. USE OF SERVICE CONNECTION WHEN' PROPERTY IS SUBDIVIDED.
When property provided with a service connection is subdivided, the ser—
vice connection shall be considered as belonging to the lot or parcel of land it
directly enters.
5. WATER MAIN EXTENSIONS
All water mains installed on dedicated streets inside the present City
Limits shall be laid at the expense of the City of Anaheim, provided, however, that
if the City Council finds that the number of users seeking the laying or extension
of a water main on any dedicated street are not sufficient in number to Justify the
laying or extension of a main considered adequate in capacity to ultimately serve tie
entire area involved, said City Council may require the users to pay the cost of
laying or extending such inadequate main.
All water mains installed or extended on non— dedicated streets, streets
annexed to the City of Anaheim subsequent to the adoption of this Resolution, or
any streets in new subdivisions shall be paid for by the person or persons request—

ing such installation or extension on the basis of $2.50 per foot of pipe layed,
beginning at the City *s water source or sources adjacent to the extension. This
charge may be reduced to $1.25 per foot for an extension serving one side of the
street only and where there is a possibility of the property on the other side of
the street desiring water service in the future. These future consumers shall also
pay on the basis of $1.25 per foot of property to be served as determined by the
Superintendent of the Water Department. The reduction referred to above regarding
users to be served from one side of the street only shall, however, be at the sole
discretion of the City Council.
Costs and Specifications for installations and extensions shall be deter..
mined by the Superintendent of the Water Department.
BE IT FURTHER RESOLVED that Resolution No. 1692 be and the same is hereby
rescinded.
BE IT FURTHER RESOLVED that the above regulations and rates become
effective immediately upon the adoption of this Resolution and shall continue ther
after until changed by the City Council of the City of Anaheim.
THE FOREGOING RESOLUTION is signed and approved by me this 27th day of
