1949-1698RESOLUTION NO./4w RESOLUTION GRANTING A VARIANCE WHEREAS, E. C. Heinze, as owner of certain real proper- ty situated at 1110 West Center Street, in the City of Anaheim, County of Orange, Stale of C described as being in Donahoe Tract, Lot 3, has filed with the City Planning Commission of the City of Anaheim a petition requesting that a variance be granted per mitting him to convert play room over garages and. Tile Shop, now in the back of the pro into two single family apartments; and WHERAS, the City Council finds from consideration and investigation of the facts and the report and recommendation of the City Planning Commission that: (1) Special circumstances and exceptional conditions do exist as to the property or classes of uses in the same zone or district; (2) That a variance is necessary for the preservation and enjoyment of a substantial property right of said petitioner; (3) That the granting of such conditional variance will not be detrimental to the public welfare or injurious to the property or improvements in the district wherein said property is located, provided the conditions hereinafter set forth are complied with: NOW, THEREFOR BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIE, that a conditional variance be, end the same i hereby granted to E. C. Heinze permitting him to convert playroom over garages and. Tile Shop, now on the back of the property, into two single family apartments, upon the following conditions: 1. That the remodeling and conversion of said playroom into two single family apartments shall be in accordance with the plans submitted with the application for a variance and in accord- ance with the Building Code and. That the appearance of said r6a1 property, includ- ing all buildings thereon shall be kept and maintained with a satis- factory appearance in keeping with the uses herein permitted. 3. That the construction and maintenance of said building shall comply with all requirements of the Chief of the Fire Department of the City of Anaheim as to safety and fire pre- vention. 4.
