RESOLUTION NO.
RESOLUTION GRANTING A VARIANCE
WHEREAS, Morris Goddard, as owner of certain real property
situated at the northeast corner of Lincoln and Manchester Avenues,
in the City of Anaheim, County of Orange, State of California, de-
scribed as a portion of the South one -half (S) of the Southeast
one quarter (SE$) of the Southwest one- quarter (SWj) of Section 9,
Township 4 South, Range 10 West, S. B. B. M., has filed with the
City Planning Commission of the City of Anaheim a petition request
ng that a variance be granted permitting him to use or lease said
property for a Wholesale and Retail Fruit and Vegetable Market on
said real property; and
WHEREAS, the City Council finds from consideration and in-
estigation of the facts and the report and recommendation of the
City Planning Commission that:
(1) Special circumstances and exceptional conditions do

e st as to the property or classes of uses in the same zone or
•istrict;
(2) That a variance is necessary for the preservation and
enjoyment of a substantial property right of said petitioner;
(3) That the granting of such conditional variance will not
e detrimental to the public welfare or injurious to the property
or improvements in the district wherein said property is located,
I• rovided the conditions hereinafter set forth are complied with:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM, that a conditional variance be, and the same is
Hereby granted to Morris Goddard, for a period of six months from th
date hereof, permitting him to use or lease said property for a
holesale and Retail Fruit and Vegetable Market upon the following
conditions:
1. That said business shall be operated in accordance with
all laws of the State of California and Ordinances and Regulations

2. That the appearance of said real property, including all
buildings thereon shall be kept and maintained with a satisfactory
appearance in keeping with the uses herein permitted.
3. That the maintenance and operation of said, buildings
shall comply with all requirements of the Chief of the Fire Depart-
ment of the City of Anaheim as to safety and fire prevention.
4. That all produce must be kept under roof and comply with
the sanitary requirements of the Health Department.
5. That the City Council hereby reserves the right to revok
said variance permit for good cause.
THE FOREGOING RESOLUTION IS SIGNED and approved by me this
